Statute overview

About this statute

In arbitration under this Annex, only the parties referred to in Article XVI may be disputants. The Parties establish ITSO, and a properly constituted three-member arbitral tribunal may decide disputes that fall under Article XVI. This provision sets ITSO’s core telecom purpose, treats certain domestic telecom services as international in specific cases, and gives the Assembly, Parties, executive organ, and panel detailed meeting, voting, nomination, and selection rules. ITSO must take appropriate steps to supervise the Company’s core principles, including non-discriminatory access to its system when capacity is available. The procedure also requires the respondents to appoint a tribunal member within 60 days, and lets them submit responses and counter-claims; the executive organ must pass any such document to the panel chair. ITSO has juridical personality and related legal capacities; Parties must take necessary measures to give effect to this article; and, in certain tribunal vacancy cases, a replacement must be selected or the remaining tribunal may continue.
