A person who suffers damage on the surface may be entitled to compensation if the damage was caused by an aircraft in flight or by something falling from it, unless a listed exception applies. The aircraft operator is liable for the damage covered by Article 1, and the registered owner is presumed to be the operator unless that presumption is rebutted. This provision makes the person who granted the aircraft use right jointly liable with the operator in some cases, and limits damage compensation to the applicable liability caps unless liability is unlimited. If an aircraft is used without consent, the person entitled to its navigational control can be jointly liable for the damage unless they prove due care to prevent the use.
