About this statute

Members must implement the agreement’s provisions, may adopt stronger protection if it does not conflict with the agreement, and must apply certain Berne Convention rules and treatment for other Members’ nationals. Members must follow specified Paris Convention articles when applying Parts II to IV of the Agreement. Members must give nationals of other Members treatment no less favourable than their own nationals for intellectual property protection, subject to listed exceptions. For intellectual property protection, a Member must give nationals of all other Members the same advantage, favour, privilege, or immunity it gives to nationals of any other country, immediately and unconditionally. The obligations in Articles 3 and 4 do not apply to procedures covered by certain WIPO multilateral agreements on acquiring or maintaining intellectual property rights.
