ORGANIC LAW N° 15/2006 OF 24/03/2006 MODIFYING AND COMPLEMENTING THE ORGANIC LAW N ̊03/2004 OF 20/03/2004 DETERMINING THE ORGANISATION, POWERS AND FUNCTIONING OF THE PROSECUTION SERVICE

Ingingo ya mbere : Ingingo ya mbere y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Iri tegeko ngenga rigena imiterere, ububasha n’imikorere by’Ubushinjacyaha, kandi rikagena imiterere, ububasha n’imikorere by’Inama Nkuru y’Ubushinjacyaha. Ubushinjacyaha bugizwe n’Ubushinjacyaha Bukuru bwa Repubulika n’Ubushinjacyaha bwa Gisirikare. Ubushinjacyaha bushinzwe gukurikirana ibyaha”. Article one: Article one of organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “This Organic Law determines the organisation, powers and the functioning of the Prosecution Service and the Supreme Council of the Prosecution. The Prosecution Service shall comprise the Parquet General of the Republic and the Military Prosecution. The Prosecution Service shall be responsible for investigation and prosecution of offences”. Article premier: L’article premier de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « La présente loi organique détermine l’organisation, la compétence et le fonctionnement du Ministère Public ainsi que l’organisation, la compétence et le fonctionnement du Conseil Supérieur du Parquet. Le Ministère Public comprend le Parquet Général de la République ainsi que l’Auditorat Militaire. Le Ministère Public est chargé de la poursuite des infractions ».

Ingingo ya 2 : Ingingo ya 2 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Ubushinjacyaha Bukuru bwa Repubulika bufite ubwigenge mu micungire y’abakozi n‘imari byabwo. Article 2: Article 2 of Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Parquet General of the Republic shall enjoy administrative and financial autonomy. The Parquet General has its headquarter in the City of Kigali and shall have its branches in the whole country as it is indicated on the annexes 1 and 2 of this organic law. The headquarter of the Prosecution at Higher Instance level is determined by the Supreme Council of the Prosecution after consultations with the Minister in charge of local government, after the later has considered views of the relevant District Councils. The headquarter of the Prosecution at Lower Instance level is determined by the Supreme Council of the Prosecution after consideration views of the relevant Sector Councils”. 29 Article 2 : L’article 2 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Parquet Général de la République jouit de l’autonomie de gestion administrative et financière. Le siège du Parquet Général de la République se trouve dans la Ville de Kigali et ses entités décentralisées se trouvent sur tout le territoire de la République du Rwanda tel que mentionné dans les annexes 1 et 2 de la présente loi organique. Le siège du Ministère Public au niveau de Grande Instance est déterminé par le Conseil Supérieur du Parquet en concertation avec le Ministre ayant l’administration locale dans ses attributions, après avis des Conseils de District concernés. Le siège du Ministère Public au niveau de Base est déterminé par le Conseil Supérieur du Parquet après avis des Conseils de Secteur concernés ».

Ingingo ya 3: Article 3: Article 3 : L’article 4 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié comme suit : 47 « Les Officiers du Ministère Public sont classés en trois (3) catégories suivantes : 1° 2° 3° les Officiers du Ministère Public de carrière ; les Auditeurs militaires; les Officiers du Ministère Public auxiliaires ».

Ingingo ya 4 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe ku buryo bukurikira: 2 “Abashinjacyaha barimo ibyiciro bitatu (3) bikurikira: 1° Abashinjacyaha b’umwuga; 2° Abashinjacyaha ba Gisirikare; 3° Abashinjacyaha b’abafasha”. Ingingo ya 4 : Article 4 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified as follows: “Prosecutors are in three (3) categories: 1° Career Prosecutors; 2° Military Prosecutors; 3° Auxiliary Prosecutors”. Article 4: Article 4 : L’article 5 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Les Officiers du Ministère Public de carrière sont les suivants : 1° 2° 3° 4° 5° 6° le Procureur Général de la République ; le Procureur Général de la République Adjoint ; les Procureurs à compétence nationale ; l’Officier du Ministère Public qui assure la direction du Parquet au niveau de Grande Instance; l’Officier du Ministère Public au niveau de Grande Instance; l’Officier du Ministère Public au niveau de Base. Les Auditeurs Militaires sont les suivants : 1° 2° 3° l’Auditeur Général Militaire ; l’Auditeur Général Militaire Adjoint ; les Auditeurs Militaires. Les Officiers du Ministère Public auxiliaires sont : Les Officiers de Police Judiciaire désignés à cet effet qui assistent l’Officier du Ministère Public au niveau de Base ».

Ingingo ya 5 y’Itegeko ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira : “Abashinjacyaha b’umwuga ni aba bakurikira : 1° Umushinjacyaha Mukuru wa Repubulika ; 2° Umushinjacyaha Mukuru wa Repubulika Wungirije ; 3° Abashinjacyaha bafite ububasha mu Gihugu hose ; 4° Umushinjacyaha uyobora Urwego rw’Ubushinjacyaha Rwisumbuye ; 5° Umushinjacyaha wo ku Rwego Rwisumbuye ; 6° Umushinjacyaha wo ku Rwego rw’Ibanze. Abashinjacyaha ba Gisirikare ni aba bakurikira : 1° Umushinjacyaha Mukuru wa Gisirikare ; 2° Umushinjacyaha Mukuru wa Gisirikare Wungirije ; 3° Abashinjacyaha ba Gisirikare. Abashinjacyaha b’abafasha ni Abagenzacyaha babiherewe ububasha bunganira Umushinjacyaha wo ku Rwego rw’Ibanze”. Ingingo ya 5 : Article 5 of the organic law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “Career Prosecutors are the following: 1° the Prosecutor General of the Republic; 2° the Deputy Prosecutor General of the Republic; 3° the Prosecutors with jurisdiction over the whole country; 4° the Prosecutor heading the Prosecution Service at Higher Instance level; 5° the Prosecutor at Higher Instance level; 6° the Prosecutor at Lower Instance level. Military Prosecutors are the following: 1° the Military Prosecutor General; 2° the Deputy Military Prosecutor General; 3° the Military Prosecutors. Auxiliary Prosecutors are: Authorised Judicial Police Officers who deputise the Prosecutor at Lower Instance level”. Article 5: Article 5: L’article 6 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Dans sa mission, le Parquet Général de la République est assisté par un Secrétariat Général régi par le Statut Général de la Fonction Publique Rwandaise. Le Parquet Général de la République est également assisté par l’Inspection et par le Conseil Supérieur du Parquet ».

Ingingo ya 6 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Ubushinjacyaha Bukuru bwa Repubulika mu mirimo yabwo ya buri munsi bwunganirwa n’Ubunyamabanga Bukuru bugengwa na sitati rusange igenga abakozi ba Leta n’inzego z’imirimo ya Leta. Bufashwa kandi n’Ubugenzuzi n’Inama Nkuru y’Ubushinjacyaha”. Ingingo ya 6 : Article 6 of the Organic Law N° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Parquet General of the Republic, in its daily activities, shall be administratively supported by the General Secretariat governed by the general statutes of Rwanda Public Service. It shall also be assisted by the Inspectorate and the Supreme Council of the Prosecution”. Article 6: Article 6 : L’article 7 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Devant les juridictions ordinaires, l’action publique est exercée par le Bureau du Procureur Général de la République ainsi que le Ministère Public au niveau de Base et au niveau de Grande Instance ».

Ingingo ya 7 y’Itegeko ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Mu nkiko zisanzwe ikurikiranabyaha rikorwa n’Ibiro by’Umushinjacyaha Mukuru wa Repubulika kimwe n’Ubushinjacyaha ku Rwego rw’Ibanze, n’Ubushinjacyaha ku Rwego Rwisumbuye”. Ingingo ya 7 : Article 7 of the organic law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “In ordinary Courts, investigation and prosecution of offences shall be conducted by the Office of the Prosecutor General of the Republic as well as the Prosecution at the Lower Instance level and the Prosecution at the Higher Instance level”. Article 7: Article 7 : L’article 13 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Au niveau de Base, les services du Parquet sont composés d’au moins un Officier du Ministère Public. Au niveau de Grande Instance, les services du Parquet sont composés d’un Procureur qui assure la Direction du Parquet au niveau de Grande Instance et d’au moins cinq (5) Officiers du Ministère Public au niveau de Grande Instance et d’autant d’autres agents nécessaires pour le bon fonctionnement du service ». 48

Ingingo ya 13 y’Itegeko ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Ubushinjacyaha bwo ku Rwego rw’Ibanze bugizwe n’Umushinjacyaha nibura umwe. Ubushinjacyaha bwo ku Rwego Rwisumbuye bugizwe n’Umushinjacyaha uyobora Ubushinjacyaha bwo ku Rwego Rwisumbuye n’abashinjacyaha bo kuri urwo rwego nibura batanu (5), n’abandi bakozi ba ngombwa bakenewe kugira ngo imirimo y’ubushinjacyaha igende neza”. Ingingo ya 13 Article 13 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: 30 “The Prosecution at the Lower Instance level shall comprise at least one Prosecutor, the Prosecution at Higher Instance level shall comprise the Prosecutor heading the prosecution at Higher Instance level and at least five Prosecutors (5) at that level, and other necessary qualified staff for the smooth running of the activities of the Prosecution service”. Article 13: Article 13: L’article 20 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « L’Auditeur Général Militaire est responsable devant le Ministre ayant la défense dans ses attributions. L’Auditeur Général Militaire informe trimestriellement et chaque fois que de besoin le Procureur Général de la République de l’état général d’avancement des activités de son service. Toutefois, le Procureur Général de la République ne dispose pas du droit d’injonction à l’égard de l’Auditeur Général Militaire ».

Ingingo ya 8 : Article 8: Article 8 : L’article 14 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Procureur qui assure la Direction du Parquet au niveau de Grande Instance, les Officiers du Ministère Public au niveau de Grande Instance ainsi que les Officiers du Ministère Public au niveau de Base sont nommés et démis de leurs fonctions par Arrêté du Premier Ministre sur demande du Conseil Supérieur du Parquet ».

Ingingo ya 14 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: 3 “Umushinjacyaha uyobora Ubushinjacyaha bwo ku Rwego Rwisumbuye, abashinjacyaha bo kuri urwo Rwego n’abashinjacyaha bo ku Rwego rw’Ibanze bashyirwaho bakanakurwa ku mirimo yabo n’iteka rya Minisitiri w’Intebe abisabwe n’Inama Nkuru y’Ubushinjacyaha”. Ingingo ya 14 : Article 14 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecutor in charge of Prosecution at Higher Instance level, Prosecutors at that level and Prosecutors at Lower Instance level are appointed and removed from office by a Prime Minister’s order upon request by the Supreme Council of the Prosecution”. Article 14: Article 14 : L’article 22 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Conseil Supérieur du Parquet est composé des membres suivants : le Ministre de la Justice, Président de droit ; le Procureur Général de la République ; le Procureur Général de la République Adjoint ; 1° 2° 3° 4° un Procureur à compétence nationale élu par ses pairs ; 5° le Commissaire Général de la Police Nationale ; 6° le Président de la Commission Nationale des Droits de la Personne; 7° l’Auditeur Général Militaire et l’Auditeur Général Militaire Adjoint ; 8° trois (3) Officiers du Ministère Public au niveau de Grande Instance élus par leurs pairs ; 9° cinq (5) Officiers du Ministère Public au niveau de Base élus par leurs pairs ; 10° deux (2) doyens des facultés de Droit des Universités agréées élus par leurs pairs ; 11° le Bâtonnier de l’Ordre des Avocats ; 12° l’Ombudsman. Le mandat des membres prévus aux points 4°, 8°, 9° et 10° du présent article est de trois (3) ans renouvelables une fois ».

Ingingo ya 9 : Article 9: Article 9 : L’article 15 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Pour être nommé au poste de Procureur qui assure la direction du Parquet au niveau de Grande Instance ou d’Officier du Ministère Public au niveau de Grande Instance, le candidat doit : 1° être détenteur d’au moins une Licence en Droit ; 2° être détenteur d’un certificat sanctionnant le cycle de formation à l’Ecole de la Magistrature ou à celle du Ministère Public reconnue par l’Etat; 3° être de bonne conduite, vie et mœurs ; 4° être exempt de tout sectarisme et de toute autre forme de divisionnisme; 5° être caractérisé par l’impartialité et l’indépendance. Sous réserve des dispositions de l’alinéa premier du présent article, le candidat au poste de Procureur qui assure la direction du Parquet au niveau de Grande Instance doit avoir une expérience d’au moins cinq (5) ans dans le domaine juridique ».

Ingingo ya 15 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Kugira ngo umuntu ashyirwe mu mwanya w’Umushinjacyaha uyobora Ubushinjacyaha ku Rwego Rwisumbuye cyangwa umushinjacyaha wo kuri urwo rwego agomba kuba yujuje ibi bikurikira : 1° kuba afite nibura impamyabumenyi ihanitse mu by’amategeko; 2° kuba afite icyemezo cy’uko yatsindiye inyigisho zijyanye n’umwuga w’ubucamanza cyangwa w’ubushinjacyaha mu ishuri ryemewe na Leta; 3° kuba indakemwa mu mico no mu myifatire; 4° kuba atarangwa n’amacakubiri ayo ari yo yose; 5° kuba atazwiho kubogama kandi atavugirwamo. Haseguriwe ibivugwa mu gika cya mbere cy’iyi ngingo, umukandida ku mwanya w’Umushinjacyaha uyobora Ubushinjacyaha ku Rwego Rwisumbuye agomba kuba afite uburambe ku kazi nibura bw’imyaka (5) mu by’amategeko“. Ingingo ya 15 : Article 15 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “In order to be appointed as Prosecutor in charge of the Office of the Prosecutor at Higher Instance level or as a Prosecutor at that level, the candidate shall: 1° hold at least a bachelor’s degree in law; 2° have a certificate indicating that he or she passed exams relating to the Judicial or prosecution career from a government recognised institute; 3° be of irreproachable morals and conduct; 4° not be characterised by any sectarianism and discrimination tendencies; 5° be impartial and independent minded. Without prejudice to the provisions of paragraph one of this article, the candidate for the Prosecutor heading the Prosecution at Higher Instance level is required to have a working experience of at least five (5) years in the legal field”. Article 15: Article 15 : L’article 34 de la loi organique n°03/2004 du 20/03/2004 est modifié et complété comme suit : « Le Service d’Inspection du Parquet Général de la République est composé d’inspecteurs qui sont des Officiers du Ministère Public. Ils exercent leurs fonctions au niveau du Bureau du Procureur Général de la République. Ils sont nommés et démis de leurs fonctions par le Conseil Supérieur du Parquet. Le Service d’Inspection du Parquet Général de la République est chargé d’assurer le suivi et le contrôle du fonctionnement des organes du Ministère Public. Le service d’Inspection du Parquet Général de la République est aussi chargé de : 1° enquêter sur les plaintes de service déposées contre les Officiers du Ministère Public ou le personnel d’appui du Ministère Public ; 2° contrôler la gestion des biens, des fonds et des équipements des organes du Parquet Général de la 3° République; transmettre au Procureur Général de la République le rapport sur les enquêtes et contrôles menés, qui doit le transmettre à son tour au Conseil Supérieur du Parquet ; 4° conseiller le Procureur Général de la République ou le Conseil Supérieur du Parquet sur toute question liée à la direction et au fonctionnement des organes du Ministère Public ; 50 5° préparer le projet d’instructions destinées aux Officiers du Ministère Public ; 6° s’occuper de toute autre tâche lui confiée par le Procureur Général de la République ou par le Conseil Supérieur du Parquet. Dans l’exercice de leurs fonctions d’officiers du Ministère Public, les inspecteurs du Parquet Général de la République ne sont pas autorisés à faire fonction de poursuite des infractions ».

Ingingo ya 10 : Article 10: Article 10 : L’article 16 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Avant d’entrer en fonction, le Procureur qui assure la direction du Parquet au niveau de Grande Instance, les Officiers du Ministère Public au niveau de Grande Instance et les Officiers du Ministère Public au niveau de Base prêtent serment devant le Premier Ministre ».

Ingingo ya 16 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Umushinjacyaha uyobora Ubushinjacyaha bwo ku Rwego Rwisumbuye, abashinjacyaha bo kuri urwo rwego n’abashinjacyaha bo ku Rwego Rw’Ibanze, mbere yo gutangira imirimo, barahirira imbere ya Minisitiri w’Intebe”. Ingingo ya 16 : Article 16 of the organic law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecutor in charge of Prosecution at Higher Instance level, Prosecutors at that level and Prosecutors at Lower Instance level shall take oath before the Prime Minister before they begin duties”. Article 16: Article 16 : L’article 38 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Devant la Cour Suprême et la Haute Cour de la République, l’action publique est exercée par le Procureur Général de la République assisté d’autres Procureurs membres de son Bureau. En cas d’action publique dirigée contre des militaires devant la Cour Suprême, la poursuite des infractions est assurée par l’Auditeur Général Militaire assisté par d’autres auditeurs militaires. Dans ce cas, les auditeurs militaires peuvent, seuls ou assistés par les Procureurs à compétence nationale, assurer la fonction d’Officier du Ministère Public. Devant les Tribunaux de Base et de Grande Instance, le Parquet est représenté par un Procureur qui assure la direction du Parquet au niveau de Grande Instance assisté des Officiers du Ministère Public au niveau de Grande Instance et de Base ».

Ingingo ya 11 : Article 11: Article 11: L’article 17 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est abrogé.

Ingingo ya 17 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ivanyweho. Ingingo ya 17 : Article 17 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is repealed. Article 17: Article 17 : L’article 39 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Procureur Général de la République est responsable des activités du Parquet sur tout le territoire national. A cet effet : 1° 2° 3° 4° il dirige, coordonne et surveille les activités du Parquet ; il soumet au Conseil Supérieur du Parquet le projet de budget du Parquet Général de la République avant sa transmission au Ministère ayant les finances dans ses attributions pour incorporation dans le budget général de l’Etat ; il donne des avis en matière d’extradition, de grâce présidentielle, de libération provisoire et de réhabilitation judiciaire ; il peut, s’il y a urgence et à la suite d’une plainte relative aux faits de nature à entraîner des poursuites, suspendre de ses fonctions, tout Officier du Ministère Public à l’exception des Officiers du Ministère Public membres du Bureau du Procureur Général de la République et en informe le Conseil Supérieur du Parquet à sa plus prochaine séance pour décision ; 5° en cas de besoin, il donne les pouvoirs au Procureur qui assure la direction du Parquet au niveau de Grande Instance ou tout autre Officier du Ministère Public au niveau de Grande Instance ou de Base d’exercer l’action publique en dehors de son ressort et en informe le Conseil Supérieur du Parquet à sa plus prochaine séance pour décision ; 7° 6° en cas de besoin, il délègue le Procureur à compétence nationale dans tout endroit autre que le siège du Parquet Général de la République pour exercer l’action publique pour une période déterminée et en informe le Conseil Supérieur du Parquet à sa plus prochaine séance pour décision ; il signe le règlement d’ordre intérieur des Officiers du Ministère Public de carrière après son adoption par le Conseil Supérieur du Parquet; il exerce personnellement l’action publique contre les personnalités jouissant du privilège de juridiction qui sont justiciables devant la Cour Suprême en premier et en dernier ressort, et en cas d’empêchement, il est remplacé par le Procureur Général Adjoint ; 8° 9° il détermine, après avis du Conseil Supérieur du Parquet, la tenue des Officiers du Ministère Public dans les audiences et les cérémonies officielles ; 10° il fait un rapport général chaque année précisant au moins les activités du Parquet au cours de l’année écoulée, les réalisations et les difficultés rencontrées ainsi que les suggestions ou recommandations 51 jugées nécessaires pour le bon déroulement des activités du Parquet. Il transmet ce rapport au Ministre ayant la Justice dans ses attributions et réserve copie aux hautes institutions du pays. Ce rapport doit être transmis au cours du premier trimestre qui suit l’année de l’exercice des activités ; 11° il est l’ordonnateur principal du budget du Parquet Général de la République ».

Ingingo ya 12 : Article 12: Article 12 : L’article 19 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « L’exercice de l’action publique devant les Juridictions Militaires est sous l’autorité de l’Auditeur Général Militaire. Dans ses fonctions, il est assisté d’un Auditeur Général Militaire Adjoint ainsi que d’autres auditeurs militaires. L’Auditeur Général Militaire a les attributions suivantes: 1° poursuivre, sur tout le territoire national ou à l’étranger, conformément à la loi toutes les infractions commises par les militaires et par leurs complices ; 2° assurer le suivi et coordonner les activités des Auditeurs Militaires ; 3° préparer et soumettre au Ministre ayant les Forces Rwandaises de Défense dans ses attributions le projet du budget de fonctionnement de l’Auditorat Militaire ; 4° fixer, après avis du Conseil Supérieur du Parquet, le Règlement d’Ordre Intérieur de l’Auditorat Militaire ; 49 5° donner des conseils en matière de grâce présidentielle, de libération provisoire et de réhabilitation judiciaire pour les personnes condamnées par les juridictions militaires ».

He or she shall be assisted by Deputy Military Prosecutor General and other Military Prosecutors. The Military Prosecutor General of the Republic shall have the following responsibilities: 1° prosecuting all offences committed in and out of the territory of Rwanda by soldiers and their accomplices, in accordance with law; supervising and coordinating the activities of Military Prosecutors; 2° 31 3° preparing and transmitting to the Minister in charge of Rwanda Defense Forces the draft Budget which shall be utilized by the military Prosecution; 4° establishing the internal rules of Prosecution in Military Prosecution after consultations with the Supreme Council of the Prosecution; 5° providing advice on issues relating to presidential pardon, provisional release and rehabilitation of the persons convicted by the Military Courts”. Article 19: Article 19 : L’article 43 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Procureur qui assure la direction du Parquet au niveau de Grande Instance coordonne et répond des activités du Parquet au niveau de Grande Instance. A cet effet : 2° 3° 4° 1° au nom du Procureur Général de la République, il assure le suivi, dirige et coordonne les activités du Parquet et des Officiers de la Police Judiciaire, il distribue les tâches aux agents et donne les directives, ordres et instructions auxquelles doit obéir toute action des Officiers du Ministère Public au niveau de Grande Instance et de Base ; il dirige et coordonne l’exercice de l’action publique au niveau de Base et de Grande Instance et supervise particulièrement les activités des Officiers du Ministère Public auxiliaires au niveau de Base et de Grande Instance ; il peut représenter personnellement le Parquet devant les juridictions de son ressort ; il fait, au moins, trimestriellement et chaque fois que de besoin, rapport au Procureur Général de la République, faisant état des activités du Parquet et celles des Officiers de Police Judiciaire ainsi que des difficultés rencontrées ; il réalise, en collaboration avec les services de la Police, des études sur les facteurs de la criminalité et sa nature et en fait semestriellement rapport au Procureur Général de la République ; il est l’interlocuteur des instances locales de son ressort sur les questions intéressant le Parquet et l’ordre public ; il participe aux réunions du Comité de Sécurité ». 5° 6° 7°

The Military Prosecutor General shall inform in each quarter and at any time it is considered necessary, the Prosecutor General of the Republic, issues relating to general performance of the Military Prosecution However, the Prosecutor General of the Republic shall not give orders to the Military Prosecutor General”. Article 20: Article 20 : L’article 45 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le pouvoir de décider de diligenter les poursuites ou d’interjeter appel appartient au Parquet Général de la République et au Ministère Public au niveau de Grande Instance ou au Ministère Public au niveau de Base. Le Parquet Général de la République interjette appel devant la Cour Suprême. Le Ministère Public au niveau de Grande Instance interjette appel devant le Tribunal de Grande Instance et devant la Haute Cour de la République ». 52

Ingingo ya 22: Article 22 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Supreme Council of the Prosecution shall be composed of the following members: the Minister of Justice who shall be its chairperson; the Prosecutor General of the Republic; the Deputy Prosecutor General of the Republic; 1° 2° 3° 4° one Prosecutor with the jurisdiction over the whole country elected byhis or her peers; 5° the Commissioner General of Police; 6° the Chairperson of the National Commission of Human Rights; 7° the Military Prosecutor General and the Deputy Military Prosecutor General; 8° three (3) Prosecutors of Higher Instance level elected by their pairs, 9° five (5) Prosecutors of Lower Instance level elected by their pairs, 10° two (2) Deans of the authorised Faculties of Law elected by their peers; 11° the President of the Bar Association 12° the Ombudsman. Persons mentioned in point 4°, 8°, 9° and 10° of this article shall be appointed for a period of three (3) years which may be renewed only once”. Article 34 of the organic law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The inspectorate of the Parquet General of the Republic is composed of inspectors who are required to be Prosecutors. They are based in the office of the Prosecutor General of the Republic. They are appointed and removed from office by the Supreme Council of Prosecution. The inspectorate of the Parquet General of the Republic shall be responsible for supervision and control of the functioning of the Prosecution Service The inspectorate of the Parquet General of the Republic shall also be responsible for: 1° investigating on the complaints relating to performance of the prosecutors or other staff of the Prosecution Service; 2° controlling the use of the property, funds and equipment of the organs of the Parquet General of the Republic; 32 3° submitting a report of matters on which it carried out investigations or supervision to the Prosecutor General of the Republic who, in turn, submits it to the Supreme Council of the Prosecution; 4° advising the Prosecutor General of the Republic and the Supreme Council of the Prosecution Service on matters concerning administration and functioning of the organs of the Prosecution Service; 5° preparing proposals of regulations concerning prosecutors; 6° performing other activities as may be assigned by the Prosecutor General of the Republic or the Supreme Council of the Prosecution. During the performance of the inspectorate duties, the inspectors of the Parquet General of the Republic shall not be allowed to carry out duties of investigation and prosecution of offences”.

Article 38 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the Prosecution Service is modified and complemented as follows: “In the Supreme Court and in the High Court of the Republic, prosecution shall be carried out by the Prosecutor General of the Republic assisted by other Prosecutors based in his or her office. In the Supreme Court cases, where the Prosecution is against soldiers, investigation and prosecution shall be carried out by the Military Prosecutor General assisted by other Military Prosecutors. In such cases, military prosecutors may themselves prosecute or may be assisted by the Prosecutors with national competence”. At Lower and Higher Instance Courts, the Prosecution shall be represented by the Prosecutor heading the Prosecution at the Higher Instance level assisted by Prosecutors at that level and Prosecutors at the Lower Instance level.

Article 39 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecutor General of the Republic shall direct and be answerable for all prosecution related matters over the whole country. Due to such reasons: 1° he or she shall direct, follows up and coordinates the activities of the Prosecution Service; 2° he or she shall submit to the Supreme Council of the Prosecution the annual budget proposal of the Parquet General of the Republic before its submission to the Minister in charge of finance for incorporation into the overall State budget; 3° he or she shall give advice on extradition proceedings, application for presidential pardon, provisional release and rehabilitation of offenders; 4° in case of urgency, and upon complaint that may be prosecuted, he or she may order temporary suspension of any Prosecutor except members of the Office of the Prosecutor General, and informs the next Supreme Council of the Prosecution session for decision; 5° where necessary, he or she may authorise a Prosecutor in charge of prosecution at Higher Instance, other Prosecutors at that level or Prosecutors at Lower Instance Level to perform activities of investigation and prosecution in another jurisdiction not in their usual operation, and shall inform the Supreme Council of the Prosecution in the next session for decision; 33 6° where necessary, he or she sends a Prosecutor with jurisdiction over the whole country to any other seat other than that of the Parquet General of the Republic, to carry out activities of investigation and prosecution for a given period and informs the Supreme Council of the Prosecution in its next session for decision; 7° he or she signs internal rules and regulations for the career Prosecutors after approval by the Supreme Council of the Prosecution; 8° he or she shall prosecute all persons enjoying the special privilege to be prosecuted before the Supreme Court on first and last degree and shall represent the Court in such prosecution, and in case of absence, he or she is replaced by the Deputy Prosecutor General. 9° he or she shall determine, upon advice by the Supreme Council of the Prosecution, the dress code of prosecutors in Courts and in official ceremonies; 10° he or she shall publish an annual general report detailing the amount of work done, achievements, and the problems encountered any proposals of amendment and recommendations necessary to ensure the smooth operation of the prosecution activities. The report shall be submitted to the Minister in charge of justice and copies reserved to higher State organs. The report shall be submitted during the first quarter following the reporting year. 11° he or she shall be the paymaster of the Parquet General of the Republic”

Ingingo ya 18 : Article 18: Article 18 : L’article 42 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : «Le Procureur Général de la République est représenté au niveau de Grande Instance par un Procureur qui assure la direction du Parquet au niveau de Grande Instance assisté par d’autres Officiers du Ministère Public au niveau de Grande Instance ainsi que par les Officiers du Ministère Public au niveau de Base. Le Procureur Général de la République peut leur donner des injonctions écrites concernant les dossiers à instruire. Toutefois, il ne peut dessaisir l’Officier du Ministère Public au niveau de Grande Instance ou au niveau de Base du dossier de poursuite de son ressort pour le faire personnellement ».

Article 42 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecutor General of the Republic shall be represented at Higher Instance by the Prosecutor in charge of Prosecution at Higher Instance, assisted by other Prosecutors at that level as well as Prosecutors at the Lower Instance level. The Prosecutor General of the Republic may issue written instructions to them on the investigation and prosecution of the suspects. However, he or she shall not be entitled to the right of stopping a prosecutor at Higher or Lower Instance level in order to carry out the prosecution personally”.

Ingingo ya 43 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Umushinjacyaha uyobora Ubushinjacyaha bwo ku Rwego Rwisumbuye ayobora kandi akabazwa imikorere y’Ubushinjacyaha kuri urwo rwego. Article 43 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecutor in charge of the Prosecution at Higher Instance level shall be responsible and answerable for the functioning of the prosecution at that level. Due to such reasons,: 1o on behalf of the Prosecutor General of the Republic, he or she shall make a follow up, direct and coordinate prosecution and investigation activities, allocate duties to members of staff and issues instructions to prosecutors at Lower and Higher Instance level; 2o he or she shall direct and coordinate prosecution activities at the Lower and Higher Instance levels and particularly inspect the activities of Auxiliary Prosecutors at that level; 3o he or she may personally represent the prosecution before Courts of law in his or her respective area of jurisdiction; 4o he or she shall submit to the Prosecutor General of the Republic, at least once a term, and at any time it is considered necessary, a report of investigation and prosecution activities, achievements and difficulties encountered; 34 5o in collaboration with the Police, he or she shall conduct research on the cause and nature of the offences and submits to the Prosecutor General of the Republic, report in every six (6) months; 6o he or she shall liaise with the local authorities in his or her jurisdiction on matters concerning Prosecution and public order; 7o he or she shall attend Security Committee meeting .

Ingingo ya 45 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Ububasha bwo kwemeza ko habaho ikurikirana cyangwa ijurira bugirwa n’Ubushinjacyaha Bukuru bwa Repubulika cyangwa Ubushinjacyaha bwo Rwego Rwisumbuye cyangwa ubushinjacyaha bwo ku Rwego rw’Ibanze. Ubushinjacyaha Bukuru bwa Repubulika bujurira mu Rukiko rw’Ikirenga, Ubushinjacyaha bwo ku Rwego Rwisumbuye bukajurira mu Rukiko Rwisumbuye no mu Rukiko Rukuru rwa Repubulika”. Article 45 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: The powers to institute criminal prosecutions or file appeals, rest with the Parquet General of the Republic or the Prosecution at Higher Instance level or the Prosecution at the Lower Instance level. The Parquet General of the Republic files appeals before the Supreme Court, while the Prosecution at the Higher Instance level files appeals at the Higher Instance Court and in the High Court of the Republic.

Ingingo ya 21: Article 21: Article 21: L’article 49 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Parquet assure de droit la direction des Officiers de la Police Judiciaire. A cet effet, il élabore chaque trimestre et chaque fois que de besoin un rapport sur le service des Officiers de la Police Judiciaire et le soumet à leur supérieur hiérarchiques ».

Article 49 of the organic law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecution shall supervise criminal investigators in criminal investigation activities. In that regard, it reports on their superiors every term and when it is considered necessary, on the activities of criminal investigators”.

Ingingo ya 52 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Mu Rukiko rw’Ibanze, ubushinjacyaha buhagararirwa n’Umushinjacyaha wo ku Rwego rw’Ibanze. Bushobora ariko no guhagararirwa n’abagenzacyaha babiherewe ububasha n’Umushinjacyaha Mukuru wa Repubulika. Iyo abo bagenzacyaha basanze ari ngombwa kujuririra urubanza baburanye, bahita babimenyesha Umushinjacyaha wo ku Rwego Rwisumbuye”. Article 52 of the organic law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “At Lower Instance Courts, the Prosecution shall be represented by a Prosecutor at the Lower Instance level. It may also be represented by Criminal Investigators upon being authorised by the Prosecutor General of the Republic. In case such criminal investigators consider it necessary to appeal to cases which they heard, they shall immediately inform the Prosecutor at Higher Instance level”.

Ingingo ya 23: Article 23: Article 23 : L’article 55 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « L’organisation et la structure des Parquets de Districts et de Villes, de Province et de la Ville de Kigali sont maintenues jusqu’à leur remplacement par les nouveaux services prévus par la présente loi organique ».

Ingingo ya 55 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Inzego z’imirimo zinyuranye z’ubushinjacyaha bw’Uturere n’ubw’Imijyi, ubw’Intara n’ubw’Umujyi wa Kigali zikomeza gukora kugeza igihe zisimbujwe inzego nshya ziteganywa n’iri tegeko ngenga”. Article 55 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “All various existing structures of District, Town and Municipalities Prosecution, of the Province and of the City of Kigali shall remain in place until they are replaced by the new ones provided for by this organic law”.

Ingingo ya 24: Article 24: Article 24 : L’article 57 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Le Procureur Général de la République décide du transfert des dossiers qui se trouvaient au sein des Parquets de Province dès l’entrée en vigueur de la présente loi organique ».

Ingingo ya 57 y’Itegeko Ngenga n° 03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira: “Umushinjacyaha Mukuru wa Repubulika agena uko ihererekanya ry’amadosiye yose yari mu bushinjacyaha bwo ku rwego rw’Intara rizakorwa iri tegeko ngenga ritangiye gukurikizwa”. Article 57 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: “The Prosecutor General of the Republic shall determine how the hand over of all files pending in the Prosecution offices at Provincial level is conducted when this organic law comes into force”.

Ingingo ya 25: Article 25: Article 25 : L’article 58 de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est modifié et complété comme suit : « Dans un délai n’excédant pas quatre (4) ans après la publication de la présente loi organique, les Officiers du Ministère Public seront nommés sans tenir compte de l’expérience exigée pour ce poste, de même que le certificat visé aux articles 11, 2° et 15, 2° de la loi organique nº 03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public ».

Ingingo ya 58 y’Itegeko Ngenga n°03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha, ihinduwe kandi yujujwe ku buryo bukurikira : “Mu gihe kitarenze imyaka ine (4) ikurikira itangazwa ry’iri tegeko ngenga, ishyirwaho ry’abashinjacyaha rizakorwa hatitawe ku burambe ku kazi busabwa Umushinjacyaha n’icyemezo kivugwa mu ngingo ya 11, 2° n’iya 15, 2° y’Itegeko Ngenga n° 03/2004 ryo ku wa 20/03/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha”. Article 58 of the Organic Law n° 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is modified and complemented as follows: 35 “The appointment of Prosecutors shall be conducted in a period of four (4) years following the publication of this organic law regardless of the experience required of the Prosecutor as well as the certificate mentioned in articles 11, 2(cid:1) and 15, 2(cid:1) of the organic law n(cid:1) 03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service”.

Ingingo ya 26: 8 Itegeko Ngenga n° 03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha ryujujwe n’ingingo ya 59 bis iteye itya: “Ingingo ya 59 bis: Inama Nkuru y’Ubushinjacyaha yariho ikomeza imirimo yayo kugeza igihe iri tegeko ngenga ritangarijwe. Inama Nkuru y’Ubushinjacyaha yemerewe guterana hatubahirijwe ibivugwa mu ngingo ya 14 y’iri Tegeko Ngenga kugeza igihe hazatorerwa abashinjacyaha bahagarariye abo ku nzego z’Ibanze n’abo ku nzego Zisumbuye. Mu mirimo y’ingenzi igomba gukorwa harimo: 1° ishyirwaho ry’abashinjacyaha bo ku Rwego rw’Ibanze n’abo ku Rwego Rwisumbuye; 2° itoresha ry’abahagarariye abashinjacyaha ku Rwego rw’Ibanze n’abo ku Rwego Rwisumbuye bahagararira bagenzi babo mu Nama Nkuru y’Ubushinjacyaha”. Article 26: The Organic Law n°03/2004 of 20/3/2004 determining the organisation, powers and functioning of the prosecution service is supplemented by article 59 bis worded as follows: “Article 59 bis: The present Supreme Council of the Prosecution shall continue its functions until this organic law is published. The Supreme Council of the Prosecution shall be allowed to meet regardless of provisions of article 14 of this organic law until the Prosecutors representing those of the Lower and Higher levels are appointed. In that case, the Supreme Council of the Prosecution composed of the following persons shall meet: 1(cid:1) the Minister of Justice who shall convene and chairs it; 2(cid:1) the Prosecutor General of the Republic; 3(cid:1) the Deputy Prosecutor General of the Republic; 4(cid:1) the Prosecutor with National Competence elected by his or her peers; 5(cid:1) the Commissioner General of National Police; 6(cid:1) the Military Prosecutor General and the Deputy Military Prosecutor 7(cid:1) the Chairperson of the National Commission of Human Rights; 8(cid:1) two (2) Deans of the Faculties of Law from the recognised Universities elected by their peers; 9(cid:1) the President of the Bar Association; 10(cid:1)the Ombudsman. Among the major functions to be conducted are: 1° 2° the appointment of the Prosecutors of the Lower and Higher Instance levels; the election of the representatives of Prosecutors at Lower and Higher Instances representing their peers in the Supreme Council of the Prosecution”. Article 26 : La loi organique n°03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est complétée par l’article 59 bis libellé comme suit : «Article 59 bis: Le Conseil Supérieur du Parquet reste en fonction jusqu’à la publication de la présente loi organique. Nonobstant les dispositions de l’article 14 de la présente loi organique, le Conseil Supérieur du Parquet a la compétence de siéger jusqu’aux élections des Officiers du Ministère Public représentant les Officiers 53 du Ministère Public au niveau de Base et de Grande Instance. Dans ce cas, il siège en présence des membres suivants: le Ministre de la Justice qui le convoque et en assure la présidence; le Procureur Général de la République ; le Procureur Général de la République Adjoint ; 1° 2° 3° 4° un Procureur à compétence nationale élu par ses pairs ; 5° le Commissaire Général de la Police Nationale ; 6° l’Auditeur Général Militaire et l’Auditeur Général Militaire Adjoint ; 7° le Président de la Commission Nationale des Droits de la Personne ; 8° deux (2) doyens des facultés de Droit des Universités agréées élus par leurs pairs ; 9° 10° l’Ombudsman. le Bâtonnier de l’Ordre des Avocats ; Parmi ses tâches principales figurent : 1° 2° la nomination des Officiers du Ministère Public au niveau de Base et de Grande Instance ; l’organisation des élections des représentants des Officiers du Ministère Public au niveau de Base et de Grande Instance au sein du Conseil Supérieur du Parquet. »

Ingingo ya 27: Itegeko Ngenga n° 03/2004 ryo kuwa 20/3/2004 rigena imiterere, ububasha n’imikorere by’ubushinjacyaha ryujujwe n’ingingo ya 59 ter iteye itya: “Ingingo ya 59 ter: Ibyakozwe n’ubushinjacyaha bw’Intara, ubw’Umujyi wa Kigali, ubw’Uturere n’ubw’Imijyi bijyanye no gukurikirana ibyaha byakozwe hagati y’itangazwa ry’ivugururwa rya kabiri ryo ku wa 08/12/2005 ry’Itegeko Nshinga rya Repubulika y’u Rwanda ryo kuwa 4 Kamena 2003 nk’uko ryavuguruwe kugeza ubu, n’itangazwa ry’iri tegeko ngenga, bigumana agaciro”. Article 27 : La loi organique n°03/2004 du 20/03/2004 portant organisation, compétence et fonctionnement du Ministère Public est complétée par l’article 59 ter libellé comme suit : «Article 59 ter Les actes de procédure en rapport avec la poursuite des infractions commises accomplis par le Parquet de Province, de la Ville de Kigali, de Districts et de Villes entre la publication de la deuxième révision du 08/02/2005 de la Constitution de la République du Rwanda du 4 juin 2003 telle que révisée à ce jour et la publication de la présente loi organique gardent leur validité ».

Ingingo ya 28: Ingingo zose z’amategeko abanziriza iri kandi zinyuranye na ryo zivanyweho.
