LAW N°41/2006 OF 29/9/2006 ESTABLISHING THE RESPONSIBILITIES, STRUCTURE AND FUNCTIONING OF RWANDA ANIMAL RESOURCES DEVELOPMENT AUTHORITY (RARDA)

Ingingo ya mbere: Iri tegeko rishyiraho rikanagena inshingano, imiterere n’imikorere by’Ikigo cy’Igihugu Gishinzwe Guteza imbere Ubworozi n’ibikomoka ku matungo mu Rwanda, cyitwa “Rwanda Animal Resources Development Authority”, RARDA mu magambo ahinnye y’icyongereza. RARDA ifite ubuzimagatozi n’ubwigenge mu miyoborere, mu micungire y’umutungo n’abakozi bayo kandi icungwa hakurikijwe amategeko agenga inzego z’imirimo za Leta. Article one: This law establishes and determines the responsibilities, the organisation and the functioning of the Rwanda Animal Resources Development Authority (RARDA). RARDA has legal personality, administrative and financial autonomy and it shall be governed in accordance with laws governing organs of Public Service. Article premier : La présente loi porte création, attributions, organisation et fonctionnement de l’Office Rwandais de développement des ressources animales, dénommé « Rwanda Animal Resources Development Authority », RARDA en sigle anglais. RARDA est doté de la personnalité juridique et de l’autonomie financière et administrative et il est géré conformément aux lois relatives à la fonction publique.

Ingingo ya 2: Icyicaro cya RARDA kiri mu Mujyi wa Kigali, Umurwa Mukuru wa Repubulika y’u Rwanda. Gishobora kwimurirwa ahandi hose mu Rwanda igihe bibaye ngombwa. RARDA ishobora kugira amashami ahandi hose mu gihugu bibaye ngombwa kugira ngo igere ku nshingano zayo, byemejwe n’Iteka rya Minisitiri w’Intebe. UMUTWE WA II : INSHINGANO ZA RARDA Article 2: The headquarters of RARDA is located in the City of Kigali, the Capital of the Republic of Rwanda. It may be transferred elsewhere in Rwanda if considered necessary. RARDA may have branches elsewhere in the country if considered necessary, upon approval by an order of the Prime Minister, in order to fulfil its responsibilities. CHAPTER II: RESPONSIBILITIES OF RARDA Article 2 : Le siège de RARDA est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda. RARDA peut, en cas de nécessité, établir des agences en tout autre lieu du territoire national sur Arrêté du Premier Ministre pour mieux s’acquitter de sa mission. CHAPITRE II : DES ATTRIBUTIONS DE RARDA

Ingingo ya 3: Inshingano z’ingenzi za RARDA ni izi zikurikira: 1° gushyira mu bikorwa politiki y’Igihugu y’ubworozi ; 2° kugeza ku borozi n’abakoresha ibikomoka ku matungo ubumenyi, tekinike na serivisi zibafasha kuvugurura umwuga wabo kugira ngo bageze ku isoko umusaruro utubutse kandi ubaha inyungu ; J.O. n° 23 bis du 01/12/2006 3° kugeza ku borozi n’abafite uruhare mu bikorwa by’ubworozi, ubumenyi n’ikoranabuhanga bituma ibikomoka ku bworozi byongerwa agaciro; kugira uruhare mu bikorwa byo kubika no gushaka amasoko y’ibikomoka ku bworozi; 4° kurwanya no kugenzura indwara z’amatungo no gushyira mu bikorwa ingamba zihamye zo gukumira, kurinda, gusuzuma, no kuvura indwara z’amatungo n’izanduza abantu by’umwihariko ; 5° guhuza ibikorwa by’abakora umwuga w’ubworozi n’abafite uruhare mu bikorwa by’ubworozi ; 6° kongerera ubushobozi aborozi kugira ngo barusheho kugira uruhare mu iterambere ry’umwuga wabo n’iry’Igihugu ; 7° guhuriza hamwe ibikorwa byose bijyanye no guteza imbere ubworozi kugira ngo byuzuzanye ; 8° guhuriza hamwe no kumenyekanisha imibare n’amakuru bijyanye n’indwara n’umusaruro by’amatungo ku rwego rw’Igihugu ; 9° kunganira Guverinoma mu gushyira mu bikorwa amategeko n’amabwiriza agenga ubworozi n’ibikomoka ku matungo ; 10° gushyikirana no gukorana n’ibindi bigo bihuje inshingano byo mu rwego rw’Akarere cyangwa mu rwego Mpuzamahanga. UMUTWE WA III : URWEGO RUREBERERA RARDA Article 3: RARDA has the following main responsibilities: 1° 2° 3° 4° to implement the national policy for animal resources development; to provide stockbreeders and consumers of animal products with information, techniques and services meant for improving their profession and supplying the market with increased produce and raising their incomes; to provide stockbreeders and individuals dealing with animal products with knowledge and technology meant for value added animal products; to play a role in storage activities and market for animal products; to control animal diseases and implement appropriate strategies meant for ensuring prevention, protection, diagnosis and treatment of animal diseases and particularly zoonosis; J.O. n° 23 bis du 01/12/2006 5° 6° 7° 8° 9° to coordinate activities of stockbreeders and individuals dealing with animal production; to build stockbreeders’ capacity so as to allow them play their role in their profession improvement and the country’s development; to coordinate all animal production related activities so as to ensure their complementarity; to collect and publicize statistics and information linked with animal diseases and production at the national level; to assist Rwandan Government in implementing laws and regulations governing animal resources and animal products; 10° to establish relations and collaborate with other regional and international authorities with the same mission. CHAPTER III: SUPERVISING AUTHORITY OF RARDA Article 3 : RARDA a les attributions suivantes : 1° mettre en application la politique nationale de l’élevage ; 2° fournir aux éleveurs et aux utilisateurs des ressources animales, les connaissances, les techniques et les services susceptibles de les aider à améliorer leur profession en vue de mettre sur le marché des productions animales en quantité et en qualité suffisantes qui leur procurent des bénéfices ; faire parvenir aux éleveurs et aux partenaires du secteur les technologies susceptibles d’accroître la valeur des productions animales ; contribuer aux activités de stockage et assurer la recherche de marchés pour les produits agricoles ; 3° J.O. n° 23 bis du 01/12/2006 4° 5° 6° 7° 8° 9° assurer la lutte et le contrôle des maladies animales, les zoonoses en particulier, et mettre en place des stratégies appropriées en matière de prévention, protection, diagnostic et de traitement ; coordonner les activités des professionnels d’élevage et des partenaires du secteur d’élevage ; renforcer les capacités techniques des éleveurs susceptibles d’accroître leur contribution au développement de leur profession ; coordonner toutes les activités liées au développement de l’élevage en vue d’assurer leur complémentarité ; compiler et diffuser les données et les informations relatives aux maladies et aux productions animales du pays ; assister le Gouvernement dans la mise en application efficace des lois et règlements régissant l’élevage et les ressources animales ; 10° établir des relations et collaborer avec les autres Agences tant régionales qu’internationales ayant les attributions similaires à celles de RARDA. CHAPITRE III : DE L’ORGANE DE TUTELLE DE RARDA

Ingingo ya 4: RARDA irebererwa na Minisiteri ifite ubworozi mu nshingano zayo. Hagati y’iyo Minisiteri n’Inama y’Ubuyobozi hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza ububasha, uburenganzira n’inshingano za buri ruhande mu kugera ku nshingano za RARDA. Ayo masezerano amara igihe gihwanye na manda y’abagize Inama y’Ubuyobozi ashyirwaho umukono na Perezida w’Inama y’Ubuyobozi na Minisitiri ureberera RARDA. Article 4: RARDA is supervised by the Ministry in charge of Animal Resources Development. There shall be concluded a contract of performance between the Ministry and the Management, indicating powers, rights and responsibilities of each party in fulfilling the responsibilities of RARDA. Such a contract shall be valid for a period of the mandate of the members of the Board of Directors and it shall be signed by the Chairperson of the Board of Directors and the Minister supervising RARDA. Article 4 : RARDA est placé sous tutelle du Ministère ayant l’élevage dans ses attributions. Il est signé, entre ce Ministère et le Conseil d’Administration, un contrat de performance déterminant les pouvoirs, les droits et les obligations de chaque partie en vue de la réalisation de la mission de RARDA. Ce contrat est valide pour une durée égale au mandat des membres du Conseil d’Administration et est conjointement signé par le Président du Conseil d’Administration et le Ministre de tutelle de RARDA.

Ingingo ya 5: Mu byo amasezerano avugwa mu ngingo ya 4 agomba guteganya mu buryo bwumvikana harimo: 1° inshingano z’Inama y’Ubuyobozi, iz’Ubuyobozi n’iz’inzego zose z’ingenzi za RARDA; 2° ibigomba kugerwaho na RARDA; 3° aho umutungo wa RARDA uva, imikorere yayo n’uburyo buhoraho bwo kubigenzura. UMUTWE WA IV: IMITERERE N’IMIKORERE BYA RARDA Article 5: Among the contents of the contract of performance referred to in article 4 of this law there should clearly be the following: 1◦ the attributions of the Board of Directors and the administration as well as the main organs of RARDA; 2◦ expected results of RARDA; 3◦ the source of the property of RARDA; its functioning and permanent procedures applied in its evaluation. CHAPTER IV: ORGANISATION AND FUNCTIONING OF RARDA Article 5 : Le contrat de performance visé à l’article 4 doit préciser notamment les points suivants : 1° les engagements du Conseil d’Administration, celles de la Direction et de tous les organes principaux de RARDA ; 2° les réalisations attendues de RARDA ; 3° la provenance des ressources de RARDA, ses modalités de fonctionnement et d’audit permanent. CHAPITRE IV : DE L’ORGANISATION ET DU FONCTIONNEMENT DE RARDA

Ingingo ya 6: RARDA igizwe n’inzego z’ubuyobozi ebyiri (2) zikurikira: 1º Inama y’Ubuyobozi; 2º Ubuyobozi. Icyiciro cya mbere: Inama y’Ubuyobozi Article 6: RARDA is comprised of the following two (2) administrative organs: 1° the Board of Directors; 2° the Management. Section one: The Board of Directors Article 6 : RARDA est doté de deux (2) organes administratifs suivants : 1° 2° le Conseil d’Administration ; la Direction. Section première : Du Conseil d’Administration

Ingingo ya 7: Inama y’Ubuyobozi ya RARDA ni rwo rwego ruyiyobora kandi rushinzwe gufata ibyemezo. Ifite ububasha busesuye n’inshingano byo gucunga umutungo wa RARDA kugira ngo ishobore kugera ku nshingano zayo. Iteka rya Minisitiri w’Intebe rishyiraho abagize Inama y’Ubuyobozi barindwi (7) barimo Perezida na Visi Perezida. Nibura mirongo itatu ku ijana (30%) by’abagize Inama y’Ubuyobozi bagomba kuba ari abagore. Abagize Inama y’Ubuyobozi bafite manda y’imyaka itatu (3) ishobora kongerwa inshuro imwe gusa. J.O. n° 23 bis du 01/12/2006 Article 7: The Board of Directors of RARDA is the authority’s supreme directing and decision making organ. It shall have full powers and responsibilities to manage its property in order to achieve RARDA’s mission. An order of the Prime Minister determines seven (7) members of the Board of Directors including the President and the Vice President. At least thirty percent (30%) of the members of the Board of Directors shall be women. Members of the Board of Directors are appointed for a period of three (3) years which may be renewable only once. Article 7 : Le Conseil d’Administration de RARDA est l’organe suprême de direction et de décision. Il est investi des pouvoirs étendus et de la mission d’assurer la gestion du patrimoine en vue de la réalisation de la mission de RARDA. Un Arrêté du Premier Ministre nomme sept (7) membres du Conseil d’Administration dont un Président et un Vice- Président. Trente pour cent (30%) au moins des membres du Conseil d’Administration sont de sexe féminin. Les membres du Conseil d’administration sont désignés pour un mandat de trois (3) ans renouvelable une seule fois. J.O. n° 23 bis du 01/12/2006

Ingingo ya 8: Inshingano z’Inama y’Ubuyobozi ya RARDA ni izi zikurikira : 1° gutanga icyerekezo cy’ibikorwa na gahunda y’imikorere bya RARDA; 2° kwemeza umushinga w’amategeko ngengamikorere ya RARDA ashyirwaho na Minisitiri ureberera RARDA; 3° kwemeza imbanzirizamushinga y’ingengo y’imari ya buri mwaka, mbere yo kuyishyikiriza inzego zibishinzwe ; 4° gusuzuma imikorere ya RARDA hakurikijwe gahunda n’ingengo y’imari; 5° kwemeza raporo y’ibikorwa na raporo y’imikoreshereze y’umutungo z’umwaka urangiye ; 6° gukurikirana imikorere y’Ubuyobozi bwa RARDA n’abakozi bayo. Article 8: Responsibilities of the Board of Directors of RARDA: 1° to provide the strategic vision and the plan of action of RARDA; 2° to approve the internal rules and regulations of RARDA to be established by an order of the Minister supervising RARDA; J.O. n° 23 bis du 01/12/2006 3° to approve the annual draft budget proposal before it is transmitted to relevant authorities; 4° to examine the performance of RARDA in accordance with the plan of action and the budget; 5° to approve the activity report and the previous financial reports; 6° to monitor the performance of the administration and the personnel of RARDA. Article 8 : Les attributions du Conseil d’administration de RARDA sont les suivantes : 1° déterminer la vision stratégique et le plan d’action de RARDA ; 2° adopter le projet de règlement d’ordre intérieur de RARDA qui sera approuvé par un arrêté du Ministre de tutelle ; 3° approuver l’avant-projet de budget annuel avant de le transmettre aux organes compétents ; 4° évaluer les performances de RARDA sur base du plan d’action et du budget ; 5° approuver le rapport d’activités et le rapport d’utilisation du patrimoine pour l’exercice précédent ; 6° faire le suivi de la performance de la Direction de RARDA et de son personnel.

Ingingo ya 9: Inama y’Ubuyobozi ya RARDA iterana rimwe mu gihembwe n’igihe cyose bibaye ngombwa itumijwe na Perezida wayo cyangwa Visi-Perezida igihe Perezida adahari, babyibwirije cyangwa bisabwe mu nyandiko nibura na kimwe cy’agatatu (1/3) cy’abayigize. Ubutumire bukorwa mu nyandiko ishyikirizwa abagize Inama y’Ubuyobozi hasigaye nibura iminsi cumi n’itanu (15) ngo inama iterane. Icyakora, inama idasanzwe itumizwa mu nyandiko hasigaye nibura iminsi itanu (5) kugira ngo iterane. Mu byigwa n’Inama y’Ubuyobozi mu gihembwe cya mbere cy’umwaka harimo kwemeza raporo y’ibikorwa n’imikoreshereze y’umutungo mu mwaka urangiye; mu gihembwe cya gatatu hakabamo gahunda yo gusuzuma umushinga w’ingengo y’imari na gahunda y’ibikorwa by’umwaka ukurikira. Buri gihembwe kandi igomba gusuzuma raporo y’imari n’iy’ibikorwa byerekeranye n’igihembwe kirangiye igashyikirizwa Minisitiri ureberera RARDA. Uburyo inama iterana n’uko ibyemezo bifatwa biteganywa n’amategeko ngengamikorere ya RARDA. Article 9: The meeting of the Board of Directors of RARDA is held once in every term and at any time it is considered necessary after it is convened by its Chairperson or its Vice Chairperson, in case of absence of its Chairperson, at own initiative, or upon proposal in writing by a third (1/3) of its members. The invitation shall be submitted in writing to the Board of Directors at least fifteen (15) days before the meeting is held. However, the extra ordinary meeting shall be convened in writing at least five (5) days before the meeting is held. Items to be examined by the Board of Directors in the first term of the year shall include approval of the activity report and the use of the property in the previous year. In the third term, there shall be included the examination of the annual draft budget and the plan of action of the following year. Also, in every term, the Board of Directors shall examine the financial and activity reports relating to previous term and the report shall be transmitted to the Minister supervising RARDA. The procedures through which the meeting is held and the mode of taking decisions shall be determined by the Rules and regulations of RARDA. Article 9 : Le Conseil d’Administration de RARDA se réunit une fois par trimestre et chaque fois que de besoin, sur convocation de son Président ou de son Vice-Président en cas d’absence du Président, à leur propre initiative, ou à la demande écrite d'un tiers (1/3) de ses membres. La convocation est faite par notification écrite et doit parvenir aux membres du Conseil d’Administration au moins quinze (15) jours avant la tenue de la réunion. Toutefois, en cas de réunion extraordinaire, la convocation se fait par notification écrite au moins cinq (5) jours avant sa tenue. A l’ordre du jour du premier trimestre de l’année figurent notamment les points relatifs à l’approbation des rapports d’activités et de gestion du patrimoine pour l’exercice précédent. L’ordre du jour de la réunion du troisième trimestre comprend notamment l’examen de l’avant-projet de budget et du programme d’activités pour l’exercice suivant. Chaque trimestre, le Conseil d’Administration doit également examiner le rapport financier et le rapport d’activités pour le trimestre écoulé et le soumettre au Ministre de tutelle. Les modalités de réunion et de prise de décisions sont prévues par le règlement d’ordre intérieur de RARDA.

Ingingo ya 10: Inama y’Ubuyobozi ishobora gutumira mu nama yayo umuntu wese ibona ashobora kuyungura inama ku ngingo runaka ifite ku murongo w’ibyigwa. Uwatumiwe ntiyemerewe gutora no gukurikira iyigwa ry’izindi ngingo ziri ku murongo w’ibyigwa. Article 10: The Board of Directors may invite in its meeting any person from whom it may seek advice on a certain issue on the agenda. The invitee is not allowed to vote and to follow the debates of other issues on the agenda. Article 10 : Le Conseil d’Administration peut, au cours de ses réunions, consulter toute personne qu’il juge compétent pour l’examen d’un point inscrit à l’ordre du jour. La personne invitée n’a pas de voix délibérative et participe uniquement aux débats concernant le point sur lequel elle est consultée.

Ingingo ya 11: Inyandiko y’ibyemezo by’inama y’Inama y’Ubuyobozi ishyirwaho umukono n’abayigize inama ikirangira, kopi yayo ikohererezwa Minisitiri ureberera RARDA mu gihe kitarenze iminsi itanu (5) kugirango agire icyo abivugaho mu gihe kitarenze iminsi cumi n’itanu (15) kuva ayishyikirijwe. Iyo icyo gihe kirenze ntacyo arabivugaho imyanzuro y’inama iba yemewe burundu. Inyandikomvugo y’inama ishyirwaho umukono na Perezida w’inama n’umwanditsi bayo, ikemezwa mu nama ikurikira. Kopi y’inyandikomvugo yohererezwa Minisitiri ureberera RARDA mu gihe kitarenze iminsi cumi n’itanu (15) guhera umunsi yemerejweho. Article 11: The document of the resolutions of the meeting of the Board of Directors shall be signed by its members immediately at its completion, and its copy shall be sent to the Minister supervising RARDA in a period not exceeding five (5) days in order to give his or her views in a period not exceeding fifteen (15) days from its reception. If this period expires when he or she has not given his or her views, the resolutions of the meeting shall be definitively approved. The minutes of the meeting shall be signed by the President and its secretary, and it shall be approved in the following session. The copy of minutes shall be sent to the Minister supervising RARDA in a period not exceeding fifteen (15) days from the day of its approval. Article 11 : Les résolutions du Conseil d’Administration sont immédiatement signées par les membres présents à la séance et transmises au Ministre de tutelle de RARDA dans un délai ne dépassant pas cinq (5) jours pour avis et considérations endéans quinze (15) jours à dater de leur réception. Passé ce délai sans réaction du Ministre, les résolutions du Conseil sont réputées définitives. Le procès-verbal de la réunion du Conseil d’Administration est signé conjointement par son Président et son rapporteur et soumis à la séance suivante pour approbation. Une copie du procès-verbal est envoyée au Ministre de tutelle de RARDA dans un délai ne dépassant pas quinze (15) jours à compter du jour de son approbation.

Ingingo ya 12: Abagize Inama y’Ubuyobozi bitabiriye inama z’Inama y’Ubuyobozi bahabwa amafaranga agenwa n’Iteka rya Perezida. Article 12: Members of the Board of Directors who are present in the meeting of the Board of Directors shall receive sitting allowances determined by a Presidential Order. Article 12 : Les membres du Conseil d’Administration bénéficient de jetons de présence dont le montant est déterminé par Arrêté Présidentiel.

Ingingo ya 13: Ntibyemewe ku bagize Inama y’Ubuyobozi cyangwa ibigo bafitemo imigabane gukora umurimo uhemberwa muri RARDA. Article 13: The members of the Board of Directors or companies in which they are shareholders are not allowed to perform any remunerated activity in RARDA. Article 13 : Il est interdit aux membres du Conseil d’Administration et aux sociétés dont ils sont associés d’exercer des fonctions rémunérées au sein de RARDA. J.O. n° 23 bis du 01/12/2006

Ingingo ya 14: Ugize Inama y’Ubuyobozi ava muri uwo mwanya iyo: J.O. n° 23 bis du 01/12/2006 1° manda ye irangiye; 2° yeguye akoresheje inyandiko; 3° atagishoboye gukora imirimo ye kubera ubumuga bw’umubiri cyangwa uburwayi bwo mu mutwe, byemejwe na muganga wemewe na Leta; akatiwe burundu igihano cy’igifungo kingana cyangwa kirengeje amezi atandatu (6) nta subikagihano; asibye inama inshuro eshatu (3) zikurikirana mu mwaka umwe nta mpamvu zifite ishingiro; bigaragaye ko atacyujuje ibyashingiweho ashyirwa mu nama y’Ubuyobozi; agaragaje imyitwarire itajyanye n’inshingano ze; abangamira inyungu z’Ikigo ; yireze akemera icyaha cya jenoside; 4° 5° 6° 7° 8° 9° 10° apfuye. Minisitiri ureberera RARDA agaragaza muri raporo igenewe inzego zibifitiye ububasha ko umwe mu bagize Inama y’Ubuyobozi adakwiriye kuba mu bayigize cyangwa ko atakiri mu mwanya we hakurikijwe ibiteganywa mu gika kibanziriza iki. Iyo umwe mu bagize Inama y’Ubuyobozi avuye mu mirimo ye mbere y’uko manda ye irangira, Ubuyobozi bubifitiye ububasha bushyiraho umusimbura. Ushyizweho arangiza iyo manda. Icyiciro cya kabiri: Ubuyobozi n’inzego z’imirimo bya RARDA Article 14: A member of the Board of Directors shall leave such an office if: the term of office expires; 1° 2° he or she resigns in writing; 3° he or she is no longer able to perform his or her duties due to physical or mental disability certified by an authorized medical doctor; J.O. n° 23 bis du 01/12/2006 4° he or she is definitively sentenced to a term of imprisonment equal to or exceeding six (6) months; 5° he or she is absent in meetings for three (3) consecutive times in a year with no justified reasons; 6° he or she no longer fulfils the requirements considered at the time of his or her appointment in the Board of Directors; 7° he or she demonstrates behaviours contrary to his or her responsibilities; 8° he or she jeopardises the interests of the Authority; 9° he or she confesses and pleads guilty to the crime of genocide; 10° he or she dies. The Minister supervising RARDA shall indicate in a report meant for competent authorities, whether one of its members is not worth its membership or if he or she is no longer in his or her position in accordance with the preceding paragraph. In case one of the members of the Board of Directors leaves his or her duties before the expiration of his or her term of office, competent authorities shall appoint the substitute. The new member thus appointed shall complete that term of office. Section 2: Management and organisational structures of RARDA Article 14 : Un membre du Conseil d’Administration perd la qualité de membre dans les cas suivants : 1° expiration du mandat ; 2° démission par notification écrite ; 3° incapacité physique ou mentale constatée par un médecin agréé ; 4° condamnation définitive à une peine d’emprisonnement supérieure ou égale à (6) mois sans sursis ; 5° trois (3) absences consécutives dans une année aux réunions sans raisons valables ; 6° constat qu’il ne remplit plus les conditions requises pour lesquelles il avait été nommé ; 7° comportement incompatible avec ses fonctions ; 8° agissement contre les intérêts de RARDA ; 9° aveu et plaidoyer de culpabilité pour crime de génocide ; 10° décès. Le Ministre de tutelle de RARDA constate que l’un des membres du Conseil d’Administration n’a plus la qualité d’être membre ou que son poste est vacant dans un rapport adressé à l’organe compétent conformément aux dispositions de l’alinéa précédent. Si un membre du Conseil d’Administration perd la qualité de membre avant l’expiration de son mandat, l’autorité de nomination désigne le remplaçant. Celui-ci termine le mandat de celui qu’il a remplacé. Section 2 : De la Direction et du cadre organique de RARDA

Ingingo ya 15: Imicungire ya buri munsi ya RARDA ishinzwe Umuyobozi wayo ushyirwaho n’Iteka rya Minisitiri w’Intebe. Ni we uhuza akanayobora ibikorwa bya buri munsi bya RARDA kandi akabazwa n’Inama y’Ubuyobozi uko ibyemezo byayo bishyirwa mu bikorwa. By’umwihariko Umuyobozi ashinzwe ibi bikurikira: 1° gutanga amabwiriza y’akazi ka RARDA n’ay’Ubuyobozi bw’amashami yose y’Ubuyobozi; 2° gutegura no gushyikiriza Inama y’Ubuyobozi imbanzirizamushinga w’ingengo y’imari izakoreshwa mu mwaka ukurikira na raporo y’ingengo y’imari y’umwaka ushize; 3° gushyira mu bikorwa ingengo y‘imari no gucunga umutungo wa RARDA; 4° gukurikirana imicungire y’abakozi ba RARDA akurikije amategeko; 5° kumenyesha mu nyandiko Inama y‘Ubuyobozi imigendekere n‘ibikorwa bya RARDA, nibura rimwe mu gihembwe; 6° guhagararira Ikigo imbere y’amategeko. Hagati y’Inama y’Ubuyobozi n’Ubuyobozi hakorwa amasezerano yerekeye gahunda y‘ibikorwa agaragaza nibura inshingano za buri ruhande n‘ibyangombwa bikenewe kugira ngo RARDA igere ku nshingano zayo. Article 15: The daily management of RARDA is entrusted to its Director appointed by an order of the Prime Minister. He or she coordinates and directs the daily activities of RARDA and shall be answerable to the Board of Directors on how its decisions are implemented. In particular, the Director is responsible for: 1° issuance of RARDA work and all administrative branch directives; 2° preparing and submitting to the Board of Directors the draft budget proposal of the following year and the budget report of the previous year; 3° executing the budget and managing the property of RARDA; 4° ensuring the appointment and the performance of the employees of RARDA in accordance with law; 5° informing, in writing, the Board of Directors the progress and the activities of RARDA at least once a term; 6° to represent RARDA before the law. There shall be concluded, between the Board of Directors and the administration, a contract of performance indicating at least the responsibilities of each party and the conditions required in order for RARDA to fulfil its attributions. Article 15 : La gestion journalière de RARDA est assurée par son Directeur nommé par Arrêté du Premier Ministre. Il coordonne et dirige les activités journalières de RARDA et est responsable devant le Conseil d’Administration de la mise en œuvre de ses décisions. Le Directeur de RARDA est spécialement chargé de : 1° donner des instructions de service de RARDA ; 2° élaborer et soumettre au Conseil d’Administration l’avant-projet de budget pour l’exercice suivant ainsi que le rapport d’exécution du budget pour l’exercice précédent ; 3° assurer l’exécution du budget et la gestion du patrimoine de RARDA ; 4° assurer la gestion du personnel de RARDA conformément à la loi ; 5° informer par écrit une fois par trimestre le Conseil d’Administration de l’état d’avancement des activités de RARDA ; 6° représenter RARDA devant la loi. Est signé, entre le Conseil d’Administration et la Direction, un contrat de performance déterminant au moins les obligations de chaque partie et les besoins nécessaires à la réalisation de la mission de RARDA.

Ingingo ya 16: Umuyobozi akurikira inama z’Inama y’Ubuyobozi akazibera umwanditsi. Ashobora kuzitangamo ibitekerezo ariko ntatora mu ifatwa ry‘ibyemezo. Umuyobozi ntajya mu nama zifata ibyemezo ku bibazo bimureba; icyo gihe Inama y’Ubuyobozi yitoramo umwanditsi. Amategeko ngengamikorere ya RARDA agena umusimbura iyo adahari. J.O. n° 23 bis du 01/12/2006 Article 16: The Director shall attend the proceedings of the meeting of the Board of Directors and act as its rapporteur. He or she may give views but does not vote during decision making. The Director shall not participate in the meetings that take decisions in issues that concern him or her; in that case, the Board of Directors shall elect from among itself a secretary. The Internal rules of procedure of RARDA shall determine his or her substitute in case of his or her absence. J.O. n° 23 bis du 01/12/2006 Article 16 : Le Directeur assiste aux réunions du Conseil d’Administration et en est le rapporteur. Il peut participer aux débats du Conseil mais sans voix délibérative. Il est interdit au Directeur de prendre part aux réunions du Conseil d’Administration qui traitent des points qui le concernent personnellement. Dans ce cas, le Conseil d’Administration élit en son sein un rapporteur. Le Règlement d’Ordre Intérieur de RARDA détermine son remplaçant en cas d’absence. J.O. n° 23 bis du 01/12/2006

Ingingo ya 17: Ibyo Umuyobozi n’abakozi ba RARDA bagenerwa biteganywa n’amategeko agenga ibyo abakozi b’ ibigo bya Leta bagenerwa. Article 17: Benefits of the Director and the members of staff of RARDA shall be determined by laws that govern the personnel of public institutions. Article 17 : Les appointements accordés au Directeur et au personnel de RARDA sont déterminés conformément aux lois régissant la rémunération du personnel des établissements publics.

Ingingo ya 18: Imiterere n’inshingano by’inzego z’imirimo ya RARDA, kimwe n’amashami yayo bigenwa n’Iteka rya Minisitiri w’Intebe, abisabwe na Minisitiri ureberera RARDA, amaze kumva icyo Inama y’Ubuyobozi ibivugaho. Abakozi ba RARDA bagengwa n’amategeko rusange agenga abakozi ba Leta n’inzego z’imirimo ya Leta. UMUTWE WA V : UMUTUNGO N’IMARI Article 18: The organisational structure and the responsibilities as well as the branches of RARDA shall be determined by an order of the Prime Minister, upon proposal by the Minister supervising RARDA, after consulting the Board of Directors. The personnel of RARDA shall be governed by the general statutes governing Rwanda Public Service. CHAPTER V: PATRIMONY AND FINANCE Article 18 : L’organisation et le cadre organique de RARDA sont déterminés par Arrêté du Premier Ministre, sur proposition du Ministre de tutelle de RARDA, après avis du Conseil d’Administration. Le personnel de RARDA est régi par le Statut général de la fonction publique rwandaise. CHAPITRE V: DU PATRIMOINE ET DES FINANCES

Ingingo ya 19: Umutungo wa RARDA ugizwe n’ibintu byimukanwa n’ibitimukanwa. Ukomoka kuri ibi bikurikira : 1° ingengo y’imari igenerwa na Leta; 2° inkunga zaba iza Leta cyangwa iz’abaterankunga; 3° ibituruka ku mirimo ikora; 4° inyungu ku mutungo wayo; 5° impano n’indagano. Article 19: The Patrimony of RARDA comprises movables and immovables: It comes from the following: 1° State budget allocation; 2° Government or donor subsidies; 3° 4° 5° donation and bequest. funds from its services; interest from its investment; Article 19 : Le patrimoine de RARDA comprend les biens meubles et immeubles. Il provient des sources suivantes : 1° les dotations budgétaires de l’Etat ; 2° les subventions de l’Etat ou des donateurs ; 3° le produit des services prestés par RARDA ; 4° les revenus de son patrimoine ; 5° les dons et legs.

Ingingo ya 20: Imikoreshereze, imicungire n’imigenzurire by’umutungo wa RARDA bikorwa hakurikijwe amategeko abigenga. Ubugenzuzi bushinzwe igenzura rya buri munsi ry’imikoreshereze y’umutungo wa RARDA buha raporo Inama y’Ubuyobozi bukagenera kopi Umuyobozi wa RARDA. Article 20: The use, management and audit of the patrimony of RARDA shall be carried out in accordance with laws and regulations thereto related. The audit responsible for daily auditing of the use of the property of RARDA shall submit a report to the Board of Directors and reserves a copy to the director of RARDA. Article 20 : L’utilisation, la gestion et l’audit du patrimoine de RARDA sont effectués conformément aux dispositions légales en la matière. Le service d’audit interne de RARDA transmet son rapport au Conseil d’Administration et réserve copie au Directeur de RARDA.

Ingingo ya 21: Ingengo y’imari ya RARDA yemezwa kandi igacungwa hakurikijwe amategeko abigenga. UMUTWE WA VI : INGINGO ZISOZA Article 21: The budget of RARDA is approved and managed in accordance with relevant laws. Ingingo ya 22: Ingingo zose z’amategeko abanziriza iri kandi zinyuranyije na ryo zivanyweho. Article 22: All previous legal provisions contrary to this law are hereby abrogated. Article 22 : Toutes les dispositions légales antérieures et contraires à la présente loi sont abrogées.
