LAW N°43/2006 OF 05/10/2006 DETERMINING THE RESPONSIBILITIES, ORGANISATION AND FUNCTIONING OF THE RWANDA BUREAU OF STANDARDS (RBS)

Ingingo ya mbere: Iri tegeko rigena inshingano, imiterere, n’imikorere by’Ikigo cy’Igihugu Gitsura Ubuziranenge, cyitwa “Rwanda Bureau of Standards”, RBS mu magambo ahinnye y’icyongereza. RBS ifite ubuzimagatozi n’ubwigenge mu miyoborere, mu micungire y’umutungo n’abakozi bayo, kandi icungwa hakurikijwe amategeko agenga inzego z’imirimo za Leta. Article one: This Law determines the responsibilities, organization and functioning of the National Bureau of Standards referred to as ‘‘Rwanda Bureau of Standards’’, abbreviated as RBS. RBS has a legal personality, administrative and financial autonomy and it shall be governed in accordance with laws governing organs of Public Service. Article premier: La présente loi détermine les attributions, l’organisation et le fonctionnement de l’Office Rwandais de Normalisation dénommé « Rwanda Bureau of Standards », RBS en sigle anglais. RBS est doté de la personnalité juridique et de l’autonomie financière et administrative et il est géré conformément aux lois relatives à la fonction publique.

Ingingo ya 2: Icyicaro cya RBS kiri mu Mujyi wa Kigali, Umurwa Mukuru wa Repubulika y’u Rwanda. Gishobora kwimurirwa ahandi hose mu Rwanda igihe bibaye ngombwa. RBS ishobora kugira amashami ahandi hose mu Gihugu bibaye ngombwa kugira ngo igere ku nshingano zayo, byemejwe n’Iteka rya Minisitiri w’Intebe. UMUTWE WA II : INSHINGANO ZA RBS Article 2: The head office of RBS is in the City of Kigali, the Capital of the Republic of Rwanda, but it may be transferred elsewhere in Rwanda if considered necessary. RBS may, upon approval by an order of the Prime Minister, have branches elsewhere in the country in order to fulfill its responsibilities. CHAPTER II: RESPONSIBILITIES OF RBS Article 2: Le siège de RBS est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda. RBS peut, en cas de nécessité, établir des agences en tout autre lieu du territoire national sur Arrêté du Premier Ministre pour mieux s’acquitter de sa mission. CHAPITRE II : DES ATTRIBUTIONS DE RBS

Article 3: RBS is the only body with powers to define national standards. Public services and public or private firms must present their standards proposals to RBS for adoption at national level. The main responsibilities of RBS are: 1° defining national standards, co-ordinating all the activities in relation to standards, ensuring their application and metrology observance in the country, providing reference metrology standard, controlling its observance and ensuring its dissemination all over the country; 2° collecting, keeping and implementing a system for the control of the contamination of agricultural, breeding and industrial products; J.O. n° 23 bis du 01/12/2006 3° analysing the performance of the Rwandan organisations meant for analysis of products in order to grant standards certificates; 4° promoting and co-ordinating all the activities in relation to the definition of standards, their application, and metrology observance; 5° assisting the Government in defining, devising and implementing standardisation policy and determining priorities in this domain; 6° ensuring the dissemination of information, publicizing and providing training in matters relating to standardization; 7° assisting the Government in ensuring equity and fairness in trade by enforcing the regulations and provisions of legal metrology and measures; 8° advising on all issues pertaining to standardization in the country and collaborating with World Trade Organization or any other international organizations in matters relating to standardization; taking part to public tenders and approving certification of goods sold to the Government; 9° 10° setting up a standards inspection system for imported and exported products and ensuring control at all points of their production, marketing and consumption within the country; 11° setting up a national program for the issuance of certificates for agricultural and breeding products which were not subjected to phytosanitary products and fertilizers; 12° providing facilities or making arrangements for the examination and testing of commodities and any material or substance from or with which they may be manufactured, produced or treated; 13° formulating and assisting in setting up a national system of certification and accreditation; 14° establishing relations and collaborating with other establishments with the same responsibilities at regional or international level. Article 3 : RBS est le seul organe habilité à définir les normes nationales de normalisation au Rwanda. Les services publics, les entreprises publiques et privées doivent transmettre à RBS leurs propositions de normes pour adoption au niveau national. J.O. n° 23 bis du 01/12/2006 Les principales attributions de RBS sont les suivantes: 1° définir les normes nationales et coordonner des activités y relatives, assurer le suivi de l’application des normes et du respect de la métrologie, fournir les étalons de référence de la métrologie; veiller à leur mise en application et à leur diffusion partout dans le pays ; 2° collecter, archiver et appliquer le système de contrôle de contamination des produits agricoles, d’élevage et industriels ; 3° examiner le fonctionnement des établissements rwandais d’analyse des produits en vue de l’octroi des certificats 4° 5° de normalisation ; promouvoir et coordonner toutes les activités relatives à la définition et à l’application des normes ainsi qu’au respect de la métrologie; assister le Gouvernement dans la définition, l’élaboration et la mise en œuvre de la politique en matière de normalisation et déterminer les priorités dans ce domaine ; 6° assurer l’information, la vulgarisation et la formation en matière de normalisation ; 7° assister le Gouvernement dans la mise en place d’un système approprié et équitable dans le domaine du commerce en appliquant les lois et règlements relatifs au respect de la métrologie et des mesures ; 8° donner des conseils sur toutes les questions relatives à la normalisation dans le pays et coopérer avec l’Organisation Mondiale du Commerce ou les autres organisations internationales en matière de normalisation ; 9° contribuer à la passation des marchés publics et certifier l’originalité des produits vendus à l’Etat ; 10° instaurer un système de contrôle de la qualité des produits à l’importation et à l’exportation, de leurs lieux de production, de leurs lieux de mise en consommation et de leurs lieux de commercialisation dans le pays ; 11° mettre en place un plan national d’octroi des certificats pour les produits agricoles et d’élevage qui n’ont pas fait l’objet de produits phytosanitaires ou d’engrais chimiques ; 12° fournir des facilités ou aider au contrôle et à l’analyse des produits fabriqués ou des matières qui ont servi à leur fabrication ; 13° concevoir et contribuer à mettre en place un système national de certification et d’accréditation dans le pays ; 14° établir des relations et collaborer avec d’autres institutions ayant des attributions similaires au niveau régional ou international.

Ingingo ya 4: RBS ishobora kwegurira imwe mu mirimo ikora ibindi bigo cyangwa amashyirahamwe, ibiha icyemezo cy’ubushobozi bwo kuyihagararira. UMUTWE WA III: URWEGO RUREBERERA RBS Article 4: RBS may entrust some of its responsibilities to other organizations or to private associations on the basis of accreditation. CHAPTER III: SUPERVISING AUTHORITY OF RBS Article 4 : RBS peut déléguer une partie de ses activités à d’autres organisations ou associations sur base d’accréditation. CHAPITRE III : DE L’ORGANE DE TUTELLE DE RBS

Ingingo ya 5: RBS irebererwa na Minisiteri ifite inganda n’ubucuruzi mu nshingano zayo. Hagati y’iyo Minisiteri n’Inama y’Ubuyobozi hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza ububasha, uburenganzira n’inshingano za buri ruhande mu kugera ku nshingano za RBS. J.O. n° 23 bis du 01/12/2006 Ayo masezerano amara igihe gihwanye na manda y’abagize Inama y’Ubuyobozi, ashyirwaho umukono na Perezida w’Inama y’Ubuyobozi na Minisitiri ufite inganda n’ubucuruzi mu nshingano ze. Article 5: RBS is supervised by the Ministry in charge of industry and commerce. There shall be concluded, between the Ministry in charge of industry and commerce and the Board of Directors, a performance contract relating to a plan of action indicating powers, rights and responsibilities of each party in fulfilling the responsibilities of RBS. Such a contract shall be valid for a period of the mandate of the members of the Board of Directors and signed by the Chairperson of the Board of Directors and the Minister in charge of industry and commerce. Article 5 : RBS est placé sous tutelle du Ministère ayant l’industrie et le commerce dans ses attributions. Il est signé, entre ce Ministère et le Conseil d’Administration, un contrat de performance déterminant les pouvoirs, les droits et les obligations de chaque partie en vue de la réalisation de la mission de RBS. Ce contrat est valide pour une durée égale au mandat des membres du Conseil d’Administration et est conjointement signé par le Président du Conseil d’Administration et le Ministre ayant l’industrie et le commerce dans ses attributions.

Ingingo ya 6: Mu byo amasezerano avugwa mu ngingo ya 5 agomba guteganya harimo: 1° inshingano z’Inama y’Ubuyobozi, iz’Ubuyobozi n’iz’inzego zose z’ingenzi za RBS; 2° ibigomba kugerwaho na RBS; 3° aho umutungo wa RBS ukomoka, imikorere yayo n’uburyo buhoraho bwo kubigenzura. UMUTWE WA IV: IMITERERE N’IMIKORERE BYA RBS Article 6: Among the contents of the contract mentioned in article 5 that should be provided in a clear way are: 1° 2° 3° the responsibilities of the Board of Directors and the Management as well as those of all main organs of RBS; the results expected from RBS; the source of the property of RBS, its functioning and evaluation procedures. CHAPTER IV: ORGANISATION AND FUNCTIONING OF RBS Article 6 : Le contrat visé à l’article 5 doit préciser notamment les points suivants : 1° les engagements du Conseil d’Administration, ceux de la Direction ainsi que ceux de tous les organes principaux de RBS; 2° les réalisations attendues de RBS; 3° la provenance des ressources de RBS ainsi que ses modalités de fonctionnement et d’audit permanent. CHAPITRE IV : DE L’ORGANISATION ET DU FONCTIONNEMENT DE RBS J.O. n° 23 bis du 01/12/2006

Ingingo ya 7: RBS igizwe n’ inzego z’ubuyobozi ebyiri (2) zikurikira: 1° Inama y’Ubuyobozi; 2° Ubuyobozi. Icyiciro cya mbere: Inama y’Ubuyobozi Article 7: RBS is comprised of the following two (2) administrative organs: 1° The Board of Directors; 2° The Management. J.O. n° 23 bis du 01/12/2006 Section one: The Board of Directors Article 7 : RBS est doté de deux (2) organes administratifs suivants : 1° le Conseil d’Administration ; 2° la Direction. Section première : Du Conseil d’Administration

Ingingo ya 8: Inama y’Ubuyobozi ya RBS ni rwo rwego ruyiyobora kandi rushinzwe gufata ibyemezo. Ifite ububasha busesuye n’inshingano byo gucunga umutungo wa RBS kugira ngo ishobore kugera ku nshingano zayo. Iteka rya Minisitiri w’Intebe rishyiraho abagize Inama y’Ubuyobozi barindwi (7) barimo Perezida na Visi Perezida. Nibura mirongo itatu (30%) by’abagize Inama y’Ubuyobozi bagomba kuba ari abagore. Abagize Inama y’Ubuyobozi bafite manda y’imyaka itatu (3) ishobora kongerwa inshuro imwe gusa. Article 8: The Board of Directors of RBS is the authority which directs RBS and is in charge of taking decisions. It shall have full powers and responsibilities to manage its property in order for RBS to fulfill its responsibilities. The Prime Minister appoints, by an order, seven (7) members of the Board of Directors including the Chairperson and the deputy Chairperson. At least thirty percent (30%) of the members of the Board of Directors shall be women. Members of the Board of Directors are appointed for a period of three (3) years which may be renewable only once. Article 8 : Le Conseil d’Administration de RBS est l’organe suprême de direction et de décision. Il est investi des pouvoirs étendus et de la mission d’assurer la gestion du patrimoine de RBS en vue de la réalisation de la mission de RBS. Un Arrêté du Premier Ministre nomme sept (7) membres du Conseil d’Administration dont un Président et un Vice- Président. Trente pour cent (30%) au moins des membres du Conseil d’Administration sont de sexe féminin. Les membres du Conseil d’Administration sont désignés pour un mandat de trois (3) ans renouvelable une seule fois.

Ingingo ya 9: Inshingano z’Inama y’Ubuyobozi ya RBS ni izi zikurikira: 1° gutanga icyerekezo cy’ibikorwa na gahunda y’imikorere bya RBS; 2° kwemeza umushinga w’amategeko ngengamikorere ya RBS ashyirwaho n’Iteka rya Minisitiri ureberera RBS; 3° kwemeza imbanzirizamushinga y’ingengo y’imari ya buri mwaka, mbere yo kuyishyikiriza inzego zibishinzwe; 4° gusuzuma imikorere ya RBS hakurikijwe gahunda n’ingengo y’imari; 5° kwemeza raporo y’ibikorwa na raporo y’imikoreshereze y’umutungo z’umwaka urangiye; 6° gukurikirana imikorere y’Ubuyobozi bwa RBS n’abakozi bayo. Article 9: Responsibilities of the Board of Directors of RBS are as follows: 1° to provide the strategic vision and plan of action of RBS; 2° to approve the internal rules and regulations which shall be established by an order of the Minister supervising RBS; to approve the annual draft budget proposal before it is submitted to relevant organs; to monitor the performance of RBS in accordance with the program and budget; to approve the activity and financial reports for the previous year; to monitor the performance of the Management and the personnel of RBS. 3° 4° 5° 6° Article 9 : Les attributions du Conseil d’Administration de RBS sont les suivantes : 1° déterminer la vision stratégique et le plan d’action de RBS; 2° approuver le projet de règlement d’ordre intérieur de RBS qui sera adopté par un Arrêté du Ministre de tutelle de RBS; 3° approuver l’avant-projet de budget annuel avant de le soumettre aux organes compétents; 4° évaluer les performances de RBS sur base du plan d’action et du budget; 5° approuver le rapport d’activités et le rapport d’utilisation du patrimoine pour l’exercice précédent; 6° faire le suivi de la performance de la Direction de RBS et de son personnel.

Ingingo ya 10: Inama y’Ubuyobozi ya RBS iterana buri gihembwe n’igihe cyose bibaye ngombwa, itumijwe na Perezida wayo cyangwa Visi-Perezida igihe Perezida adahari, babyibwirije cyangwa bisabwe mu nyandiko nibura na kimwe cya gatatu (1/3) cy’abayigize. Ubutumire bukorwa mu nyandiko ishyikirizwa abagize Inama y’Ubuyobozi hasigaye nibura iminsi cumi n’itanu (15) ngo inama iterane. Icyakora, inama idasanzwe itumizwa mu nyandiko hasigaye nibura iminsi itanu (5) kugira ngo iterane. J.O. n° 23 bis du 01/12/2006 Mu byigwa n’Inama y'Ubuyobozi mu gihembwe cya mbere cy’umwaka harimo kwemeza raporo y’ibikorwa n’imikoreshereze y’umutungo mu mwaka urangiye. Mu gihembwe cya gatatu hakabamo gahunda yo gusuzuma imbanzirizamushinga y’ingengo y’imari na gahunda y’ibikorwa by’umwaka utaha. Buri gihembwe kandi igomba gusuzuma raporo y’imari n’iy’ibikorwa byerekeranye n’igihembwe kirangiye igashyikirizwa Minisitiri ureberera RBS. Uburyo inama iterana n’uko ibyemezo bifatwa biteganywa n’amategeko ngengamikorere ya RBS. Article 10: The meeting of the Board of Directors of RBS is held once every term and at any time it is considered necessary, after it is convened by its Chairperson or its Vice Chairperson, in case of absence of its Chairperson, on own initiative, or upon proposal in writing by a third (1/3) of its members. The invitation shall be submitted in writing to the Board of Directors at least fifteen (15) days before the meeting is held. However, the extra ordinary meeting is convened in writing at least five (5) days before it is held. Items to be examined by the meeting of the Board of Directors in the first term of the year shall include approval of the activity report and the use of the property in the previous year; in the third term, there shall be included the examination of the annual draft Budget proposal and the plan of action of the following year. Also, in every term, the Board of Directors shall examine the financial and activity reports relating to previous term and the report shall be transmitted to the Minister supervising RBS. The procedures through which the meeting is held and the mode of taking decisions shall be determined by the internal rules and regulations of RBS. Article 10 : Le Conseil d’Administration de RBS se réunit une fois par trimestre et chaque fois que de besoin, sur convocation de son Président ou de son Vice-Président en cas d’absence du Président, de leur propre initiative ou à la demande écrite d'au moins un tiers (1/3) de ses membres. La convocation est faite par notification écrite et doit parvenir aux membres du Conseil d’Administration au moins quinze (15) jours avant la tenue de la réunion. Toutefois, en cas de réunion extraordinaire, la convocation se fait par notification écrite au moins cinq (5) jours avant sa tenue. A l’ordre du jour du premier trimestre de l’année figurent notamment les points relatifs à l’approbation du rapport d’activités et au rapport de gestion du patrimoine pour l’exercice précédent. L’ordre du jour de la réunion du troisième trimestre comprend notamment l’examen de l’avant-projet de budget et du programme d’activités pour l’exercice suivant. Chaque trimestre, le Conseil d’Administration doit également examiner le rapport financier et le rapport d’activités pour le trimestre écoulé et le soumettre au Ministre de tutelle. Les modalités de réunion et de prise de décisions sont prévues par le Règlement d’ordre intérieur de RBS. J.O. n° 23 bis du 01/12/2006

Ingingo ya 11: Inama y’Ubuyobozi ishobora gutumira mu nama yayo umuntu wese ibona ashobora kuyungura inama ku ngingo runaka ifite ku murongo w’ibyigwa. Uwatumiwe ntiyemerewe gutora no gukurikira iyigwa ry’izindi ngingo ziri ku murongo w’ibyigwa. Article 11: The Board of Directors may invite in its meeting any person from whom it may seek advice on a certain issue on the agenda. The invitee is not allowed to vote and follow debates on other issues on the agenda. Article 11 : Le Conseil d’Administration peut, au cours de ses réunions, consulter toute personne qu’il juge compétente pour l’examen d’un point inscrit à l’ordre du jour. La personne invitée n’a pas de voix délibérative et participe uniquement aux débats concernant le point sur lequel elle est consultée.

Ingingo ya 12: Inyandiko y’ibyemezo by’inama y’Inama y’Ubuyobozi ishyirwaho umukono n’abayigize inama ikirangira, kopi yayo ikohererezwa Minisitiri ureberera RBS mu gihe kitarenze iminsi itanu (5) kugira ngo agire icyo abivugaho mu gihe kitarenze iminsi cumi n’itanu (15) kuva ayishyikirijwe. Iyo icyo gihe kirenze ntacyo arabivugaho, imyanzuro y’inama iba yemewe burundu. Inyandikomvugo y’inama ishyirwaho umukono na Perezida n’umwanditsi bayo, ikemezwa mu nama ikurikira. Kopi y’inyandikomvugo yohererezwa Minisitiri ureberera RBS mu gihe kitarenze iminsi cumi n’itanu (15) guhera umunsi yemerejweho. Article 12: Resolutions of a meeting of the Board of Directors shall be signed by its members immediately after the session, and its copy shall be sent to the Minister supervising RBS in a period not exceeding five (5) days in order to give his or her views in a period not exceeding fifteen (15) days from its reception. If this period expires before he or she has not given his or her views, the resolutions shall be deemed definitively approved. The minutes of the meeting shall be signed by the Chairperson and its rapporteur, and it shall be approved in its following session. The copy of the minutes shall be sent to the Minister supervising RBS in a period not exceeding fifteen (15) days from the day of its approval. J.O. n° 23 bis du 01/12/2006 Article 12 : Les résolutions du Conseil d’Administration sont signées par les membres présents après la séance et transmises au Ministre de tutelle de RBS dans un délai ne dépassant pas cinq (5) jours pour avis endéans quinze (15) jours à dater de leur réception. Passé ce délai sans réaction du Ministre, les décisions du Conseil sont réputées définitives. Le procès-verbal de la réunion du Conseil d’Administration est signé conjointement par son Président et son rapporteur et soumis à la séance suivante pour approbation. Une copie du procès-verbal est envoyée au Ministre de tutelle de RBS dans un délai ne dépassant pas quinze (15) jours à compter du jour de son approbation.

Ingingo ya 13: Abagize Inama y’Ubuyobozi bitabiriye inama z’Inama y’Ubuyobozi bagenerwa amafaranga agenwa n’Iteka rya Perezida. Article 13: Members of the Board of Directors who are present in the meeting of the Board of Directors shall receive sitting allowances determined by a Presidential Order. Article 13 : Les membres du Conseil d’Administration bénéficient de jetons de présence dont le montant est déterminé par Arrêté Présidentiel.

Ingingo ya 14: Ntibyemewe ku bagize Inama y’Ubuyobozi cyangwa ibigo bafitemo imigabane gukora umurimo uhemberwa muri RBS. Article 14: Members of the Board of Directors and the companies in which they are shareholders are not allowed to perform any remunerated activity within RBS. Article 14: Il est interdit aux membres du Conseil d’Administration ou aux sociétés dont ils sont associés d’exercer des fonctions rémunérées au sein de RBS.

Icyiciro cya 2: Ubuyobozi n’inzego z’imirimo bya RBS Article 15: A member of the Board of Directors shall leave such an office if: 1° his or her term of office expires; 2° he or she resigns through writing; 3° he or she is no longer able to perform his or her duties due to physical or mental disability certified by an authorized medical doctor; 4° he or she is definitively sentenced to a term of imprisonment equal to or exceeding six (6) months without benefit of suspension of sentence; 5° he or she is absent in meetings for three (3) consecutive times in a year with no justified reasons; 6° he or she no longer fulfils the requirements considered at the time of his or her appointment to the Board of Directors; 7° he or she demonstrates behaviors contrary to his or her responsibilities; 8° he or she jeopardizes the interests of the Authority; 9° 10° he or she dies. he or she confesses and pleads guilty of the crime of genocide; The Minister supervising RBS shall indicate in a report meant for competent organs, whether one of the members of the Board of Directors is not worth its membership or if he or she is no longer in his or her position in accordance with the provisions of the preceding paragraph. In case one of the members of the Board of Directors leaves his or her duties before the expiration of his or her term of office, the competent authority shall appoint the substitute. The appointee shall complete the remaining term of office. Section 2: Management and services of RBS Article 15: Un membre du Conseil d’Administration perd la qualité de membre dans les cas suivants: 1° expiration du mandat; 2° démission par notification écrite; 3° incapacité physique ou mentale constatée par un médecin agréé ; 4° condamnation définitive à une peine d’emprisonnement égale ou supérieure à (6) mois sans sursis; 5° trois (3) absences consécutives dans une année aux réunions sans raisons valables ; 6° constat qu’il ne remplit plus les conditions pour lesquelles il avait été nommé; 7° comportement incompatible avec ses fonctions ; 8° agissement contre les intérêts de l’Institut; 9° aveu et plaidoyer de culpabilité pour crime de génocide; 10° décès. Le Ministre de tutelle de RBS constate dans un rapport adressé à l’organe compétent que l’un des membres du Conseil d’Administration n’a plus la qualité d’être membre ou que son poste est vacant conformément aux dispositions de l’alinéa précédent. Si un membre du Conseil d’Administration perd la qualité de membre avant l’expiration de son mandat, l’autorité de nomination désigne le remplaçant. Celui-ci termine le mandat de celui qu’il a remplacé. Section 2 : De la Direction et des Services de RBS

Ingingo ya 16: Imicungire ya buri munsi ya RBS ishinzwe Umuyobozi wayo ushyirwaho n’Iteka rya Minisitiri w’Intebe. Hagati y’Inama y’Ubuyobozi n’Ubuyobozi hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza nibura inshingano za buri ruhande n’ibyangombwa bikenewe kugira ngo RBS igere ku nshingano zayo. Article 16: The daily management of RBS is entrusted to its Director who is appointed by an Order of the Prime Minister. The Director coordinates and directs the daily activities of RBS and shall be answerable to the Board of Directors on how its recommendations are implemented. In particular, the Director is responsible for: 1° issuing work instructions within RBS; 2° preparing and transmitting to the Board of Directors the draft Budget proposal for the following year and the Budget report of the previous year; 3° executing the budget of RBS and managing the property of RBS; 4° ensuring the management of the personnel of RBS in accordance with law; 5° informing the Board of Directors, in writing, about the performance and the progress of activities of RBS at least once a term; J.O. n° 23 bis du 01/12/2006 6° representing RBS before the law. There shall be concluded, between the Board of Directors and Management, a contract of performance indicating at least the responsibilities of each party and the conditions required in order for RBS to fulfill its responsibilities. Article 16: La gestion journalière de RBS est assurée par son Directeur nommé par Arrêté du Premier Ministre. Le Directeur coordonne et dirige les activités journalières de RBS et est responsable devant le Conseil d’Administration de la mise en œuvre de ses décisions. J.O. n° 23 bis du 01/12/2006 Le Directeur de RBS est spécialement chargé de : 1° donner des instructions de service au sein de RBS ; 2° élaborer et soumettre au Conseil d’Administration l’avant-projet de budget pour l’exercice suivant ainsi que le rapport d’exécution du budget pour l’exercice précédent ; 3° assurer l’exécution du budget et la gestion du patrimoine de RBS; 4° assurer la gestion du personnel de RBS conformément à la loi; 5° informer par écrit le Conseil d’Administration de l’état d’avancement des activités de RBS, au moins une fois par trimestre ; 6° représenter RBS devant la loi. Il est signé, entre le Conseil d’Administration et la Direction, un contrat de performance déterminant au moins les obligations de chaque partie et les besoins nécessaires à la réalisation de la mission de RBS.

Ingingo ya 17: Umuyobozi akurikira inama z’Inama y’Ubuyobozi , akazibera umwanditsi. Ashobora kuzitangamo ibitekerezo ariko ntatora mu ifatwa ry’ibyemezo. Umuyobozi ntajya mu nama zifata ibyemezo ku bibazo bimureba; icyo gihe Inama y’Ubuyobozi yitoramo umwanditsi. Amategeko ngengamikorere ya RBS agena umusimbura iyo adahari. Article 17: The Director shall attend meetings of the Board of Directors and serve as their rapporteur. He or she may give views but is not allowed to vote in decision-making. The Director shall not participate in the meetings that take decisions on issues that concern him or her; in that case, the Board of Directors shall elect from among itself a rapporteur. The internal rules and regulations of RBS shall determine his or her substitute in case of his or her absence. Article 17 : Le Directeur assiste aux réunions du Conseil d’Administration et en est le rapporteur. Il peut participer aux débats du Conseil mais sans voix délibérative. Il est interdit au Directeur de prendre part aux réunions du Conseil d’Administration qui traitent des points qui le concernent personnellement. Dans ce cas, le Conseil d’Administration élit en son sein un rapporteur. Le Règlement d’Ordre Intérieur de RBS détermine son remplaçant en cas d’absence.

Ingingo ya 18: Ibyo Umuyobozi n’abakozi ba RBS bagenerwa biteganywa n’amategeko agenga ibyo abakozi b’ibigo bya Leta bagenerwa. Article 18: Benefits of the Director and the members of staff of RBS shall be provided for by legal provisions that govern members of staff of public institutions. Article 18 : Les appointements accordés au Directeur et au personnel de RBS sont prévus par les lois régissant la rémunération du personnel des établissements publics.

Ingingo ya 19: Imiterere n’inshingano by’inzego z’imirimo ya RBS, kimwe n’amashami yayo bigenwa n’Iteka rya Minisitiri w’Intebe, abisabwe na Minisitiri ureberera RBS , amaze kumva icyo Inama y’Ubuyobozi ibivugaho. Abakozi ba RBS bagengwa n’amategeko rusange agenga abakozi ba Leta n’inzego z’imirimo ya Leta. Article 19: The organisational structure and the responsibilities as well as the branches of RBS shall be determined by an order of the Prime Minister, upon request by the Minister supervising RBS after consulting the Board of Directors. RBS personnel shall be governed by the general statutes for Rwanda Public Service. Article 19: L’organisation et les attributions des services de RBS et de ses agences sont déterminées par Arrêté du Premier Ministre, sur proposition du Ministre de tutelle de RBS, après avis du Conseil d’Administration. Le personnel de RBS est régi par le Statut général de la fonction publique rwandaise.

CHAPTER V: PATRIMONY AND FINANCE Article 20 : Les agents de RBS chargés du contrôle du respect des normes ou de la métrologie sont investis des pouvoirs d’Officier de Police Judiciaire dans l’exercice de leurs fonctions. CHAPITRE V: DU PATRIMOINE ET DES FINANCES

Ingingo ya 21: Umutungo wa RBS ugizwe n’ibintu byimukanwa n’ibitimukanwa. Ukomoka kuri ibi bikurikira: 1° 2° 3° 4° 5° ingengo y’imari igenerwa na Leta; inkunga zaba iza Leta cyangwa iz’abaterankunga; ibituruka ku mirimo ikora; inyungu ku mutungo wayo; impano n’indagano. Article 21: The patrimony of RBS comprises of movables and immovables. It comes from the following sources: 1° State budget allocation; 2° subsidies from the government or donors ; 3° proceeds of services performed by RBS; 4° 5° donation and bequest. income from its patrimony; Article 21 : Le patrimoine de RBS comprend des biens meubles et immeubles. Il provient des sources suivantes: 1° les dotations budgétaires de l’Etat; 2° les subventions de l’Etat ou des donateurs; 3° le produit de ses services; 4° les revenus de son patrimoine; 5° les dons et legs. Ingingo ya 22: Imikoreshereze, imicungire n’imigenzurire by’umutungo wa RBS bikorwa hakurikijwe amategeko abigenga. Ubugenzuzi bushinzwe igenzura rya buri munsi ry’imikoreshereze y’umutungo wa RBS buha raporo Inama y’Ubuyobozi bukagenera kopi Umuyobozi wa RBS. Article 22: The use, management and audit of the patrimony of RBS shall be carried out in accordance with relevant legal provisions. The service in charge of internal audit of RBS shall submit a report to the Board of Directors and reserve a copy to the Management of RBS. Article 22 : L’utilisation, la gestion et l’audit du patrimoine de RBS sont régis par les dispositions légales en la matière. Le service chargé de l’audit interne de RBS transmet son rapport au Conseil d’Administration et réserve copie au Directeur de RBS.

Ingingo ya 23: Ingengo y’imari ya RBS yemezwa kandi igacungwa hakurikijwe amategeko abigenga . UMUTWE WA VI: AMABWIRIZA Y’UBUZIRANENGE Article 23: The budget of RBS shall be approved and managed in accordance with relevant provisions. J.O. n° 23 bis du 01/12/2006 CHAPTER VI: STANDARDS Article 23 : Le budget de RBS est adopté et géré conformément aux dispositions légales en la matière. CHAPITRE VI : DES NORMES

Ingingo ya 24: Amabwiriza y’ubuziranenge akurikizwa mu Rwanda aba ari ay’Igihugu, ay’Ibigo, cyangwa akoreshwa ku rwego mpuzamahanga cyangwa urw’Akarere . Muri yo hari amabwiriza ntarengwa n’akurikizwa ku bushake. Article 24: Standards that are applied in Rwanda may be either national or enterprise standards or those applied at international or regional level. Among these standards are compulsory standards and optional standards. Article 24 : Les normes qui sont d’application au Rwanda sont, soit des normes nationales, soit des normes des entreprises, soit des normes appliquées au niveau international ou régional. Parmi ces normes, il y en a qui sont obligatoires et d’autres facultatives.

Ingingo ya 25: Amabwiriza y’ubuziranenge ntarengwa ni ajyanye n’inyungu z’igihugu, isuku, ubuzima bw’abantu n’ubw’inyamaswa, umutekano n’ibidukikije. Amabwiriza aba ntarengwa bitewe n’uko ari mu mategeko cyangwa mu zindi nyandiko z’amabwiriza y’ubuyobozi bubifitiye ububasha. Amabwiririza ntarengwa atangazwa mu Igazeti ya Leta ya Repubulika y’u Rwanda. Article 25: Compulsory standards are those applicable to areas of public interest, hygiene, human and animal health, security and environment. Standards become compulsory following regulations expressed by a law or any other regulatory document issued by competent authorities. The compulsory standards are published in the Official Gazette of the Republic of Rwanda. Article 25 : Les normes obligatoires sont d’application dans le domaine de l’intérêt public, de l’hygiène, de la santé humaine et animale, de la sécurité et de l’environnement. Les normes deviennent obligatoires par suite d’une réglementation contenue dans une loi ou un autre texte réglementaire émis par une autorité compétente. Les normes obligatoires sont publiées au Journal Officiel de la République du Rwanda.

Ingingo ya 26: Amabwiriza y’ubuziranenge akurikizwa ku bushake ni agamije akarusho ku bicuruzwa. Ashyirwaho ku buryo butandukanye n’ibivugwa mu ngingo ya 25 y’iri tegeko. Article 26: Optional standards are those that aim to increase the value of the products. They are set in a way different from that provided for in article 25 of this law. Article 26 : Les normes facultatives sont celles établies en vue d’assurer la plus-value aux produits. Elles sont édictées dans une forme différente de celle énoncée à l’article 25 de la présente loi.

Ingingo ya 27: Amabwiriza y’ubuziranenge y’Ibigo ashyirwaho na byo ubwabyo bikurikije inyungu zabyo n’imiterere y’ibintu bikora. Ntagomba na gato kuvuguruza amabwiriza y’ubuziranenge y’Igihugu. J.O. n° 23 bis du 01/12/2006 Article 27: Enterprise standards are set on the initiative of the concerned enterprises taking into account their proper interests and their products specifications. These standards should not in any case contradict the prescriptions of national standards. Article 27 : Les normes relevant des entreprises sont définies par les entreprises elles-mêmes compte tenu de leur intérêt ainsi que de la nature de leurs produits. Ces normes ne doivent en aucun cas contredire les normes nationales.

Ingingo ya 28: Amabwiriza y’ubuziranenge abaye ntarengwa bitewe n’uko afitanye isano n’itegeko cyangwa indi nyandiko y’amabwiriza y’ubuyobozi bubifitiye ububasha, agenzurwa hakurikijwe ibiteganywa n’izo nyandiko. Article 28: Standards that have become compulsory in reference to a law or to another regulatory document issued by a competent authority are controlled according to the clauses stated in these documents. Article 28 : Les normes devenues obligatoires par suite d’une référence à une loi ou à un autre instrument d’instructions émis par une autorité compétente, sont contrôlées selon les clauses contenues dans ces textes.

Ingingo ya 29: Kugira ngo ibintu biva hanze u Rwanda rufitiye amabwiriza y’ubuziranenge ntarengwa bishobore gucuruzwa, RBS igomba gushyiraho uburyo bwo kugenzura inyandiko zerekana ko umwimerere wabyo wemejwe n’Ibigo byo hanze bizwiho ubushobozi, mbere y’uko byinjira mu gihugu. RBS ifite ububasha bwo gutegeka ko byongera gupimwa iyo isanze ari ngombwa. Article 29: In order to allow for the selling of imported products for which the Rwandan compulsory standards have been established, RBS must set up a system of controlling the certificates of these products conformity ascertained by competent foreign agencies before they are introduced in the country. RBS has the right, if necessary, to check the quality of those products by analysis of double-check. Article 29 : Avant la commercialisation des produits importés pour lesquels le Rwanda dispose des normes obligatoires, RBS doit mettre en place un système de contrôle des documents certifiant que la conformité de ces produits est certifiée par des organismes étrangers reconnus compétents avant qu’ils n’entrent dans le pays. RBS a le droit, s’il le juge nécessaire, d’en vérifier la conformité par une analyse de contre-expertise.

Ingingo ya 30: Ikigo gishinzwe gutanga amasoko ya Leta kigomba kwaka abapiganwa, inyandiko zemeza ko umwimerere w’ibintu n’imirimo bifuza gutanga uhuye n’amabwiriza y’ubuziranenge y’Igihugu cyangwa ari mu masezerano. UMUTWE WA VII: IBYAHA N’IBIHANO Article 30: The institution responsible for public procurement must require from its suppliers of goods and services the documents of conformity to national standards or to other specifications expressed in the contract. CHAPTER VII: VIOLATIONS AND SANCTIONS Article 30 : L’institution chargée de l’attribution des marchés publics doit exiger des soumissionnaires les documents de conformité de leurs offres aux normes nationales ou aux normes contenues dans le cahier de charges. Ingingo ya 31: Umuntu wese ku giti cye, umuryango cyangwa ikigo cy’ubucuruzi, bifite ubuzimagatozi, bitubahirije amabwiriza y’ubuziranenge ntarengwa, hakoreshejwe imvugo y’ikinyoma ibangamira igenzura mu gihe rikorwa, itangwa ry’impapuro z’ibinyoma zemeza umwimerere, impapuro z’impimbano zemeza umwimerere n’ibindi bikorwa byose byica iri tegeko, bihanishwa igihano kimwe cyangwa bimwe muri ibi bikurikira hakurikijwe uburemere bw’ikosa: 1° kwihanangiriza mu nyandiko; 2° kubuza gucuruza ibintu cyangwa imirimo; 3° gufatira ibintu; 4° gusenya ibintu; 5° guhagarika by’agateganyo cyangwa burundu gukoresha indangabintu cyangwa ibyemezo by’umwimerere; 6° 7° gufunga ikigo cy’ubucuruzi by’agateganyo; 8° gufunga burundu ikigo cy’ubucuruzi bivuye ku cyemezo cy’urukiko. ihazabu itarengeje inshuro ebyiri agaciro k’ibintu; Article 31: Any natural person or corporate body and business enterprise endowed with legal status not complying with compulsory standards, obstructing the inspection, by using false certifications of conformity, using forged certificates of conformity and any other violation of the provisions of this law and of its implementation measures, is liable to one or some of the following sanctions, according to seriousness of the violation: 1° warning through writing; 2° banning of selling goods or services; J.O. n° 23 bis du 01/12/2006 temporary or permanent suspension of trademarks or conformity certificates; 3° seizure of goods; 4° destruction of goods; 5° 6° fines not exceeding twice the goods value; 7° temporary closure of the enterprise; 8° closing down of the commercial enterprise following the decision by the judicial court. Article 31 : interdiction de vendre les biens et services ; Toute personne physique, morale ou société commerciale jouissant d’une personnalité juridique qui ne respecte pas les normes obligatoires, par de fausses déclarations faisant obstruction au contrôle, par l’octroi de faux documents de certification de conformité, et toute autre manœuvre qui viole la présente loi est passible de l’une ou de certaines sanctions ci-après ou selon la gravité de la faute : 1° avertissement écrit; 2° 3° saisie des produits ; 4° destruction des produits ; 5° suspension temporaire ou définitive d’usage des marques ou certificats de conformité ; 6° amende ne dépassant pas le double de la valeur des produits ; 7° fermeture temporaire de l’entreprise commerciale ; 8° fermeture définitive de l’entreprise commerciale, suite à une décision du tribunal.

Ingingo ya 32: Ibihano biteganyijwe mu ngingo ya 31 y’iri tegeko ntibibuza ko uwabikoze akurikiranwa agashyikirizwa inkiko kubera icyaha cyangwa indishyi hakurikijwe ibiteganywa n’amategeko y’u Rwanda. Article 32: The sanctions mentioned in article 31 of this law do not preclude the offender from being sued to the court in relation to criminal and civil laws in force in Rwanda. Article 32 : Les sanctions prévues à l’article 31 de la présente loi ne dispensent pas le contrevenant des poursuites pénales ou civiles prévues par les lois en vigueur au Rwanda.

Ingingo ya 33: Ibihano bitanzwe bishobora kujuririrwa mu bakemurampaka bumvikanyweho mbere n’impande zombi cyangwa mu nzego z’ubucamanza zibifitiye ububasha. UMUTWE WA VIII: INGINGO ZISOZA Article 33: Sanctions may be appealed against to the arbitration council agreed upon by the parties or to competent judicial institution. CHAPTER VIII: FINAL PROVISIONS Article 33 : Les sanctions infligées peuvent faire l’objet d’appel devant un conseil d’arbitrage préalablement convenu entre les parties ou devant les instances judiciaires compétentes. CHAPITRE VIII : DES DISPOSITIONS FINALES

Ingingo ya 34: Ingingo zose z’amategeko abanziriza iri kandi zinyuranye na ryo zivanyweho.
