PRESIDENTIAL ORDER N° 29/01 OF 05/07/2005 DESIGNATING GOVERNMENT OFFICERS TO SERVE AS NOTARIES, HEAD OFFICE AND JURISDICTION OF NOTARIAL AREAS

Ingingo ya mbere: Iri teka rigena abakozi ba Leta bakora imirimo ya notariya, icyicaro n’ifasi by’ibiro bya notariya. Article One: This Order designates Government Officers meant to discharge notarial duties and states notarial areas’ number, head offices and jurisdictions. Article premier : Le présent arrêté détermine les agents de l’Etat désignés pour remplir les fonctions de Notaire et fixe le nombre, le siège et les ressorts des offices notariaux

Ingingo ya 2: Muri buri Ntara, mu Mujyi wa Kigali, no muri Minisiteri ishinzwe ubutabera hari ibiro bya noteri. Hashyizwe kandi ibiro bya noteri mu Kigo cya Leta gishinzwe guteza imbere ishoramari. Ibiro bya noteri muri Minisiteri ishinzwe ubutabera ni Ibiro bya noteri by’Igihugu. Article 2: To each Province and Kigali City as well as in the Ministry holding justice in its remit shall be found one Notarial office. One notarial office will also be found in the Government Department in charge of investment promotion. The Justice Ministry’s notarial office will also serve as the national office. Article 2 : Il y a un Office Notarial dans chaque Province, dans la Ville de Kigali et au Ministère chargé de la Justice. Il est institué un Office Notarial auprès du Service de l’Etat chargé de la promotion des investissements. L’Office Notarial au Ministère chargé de la Justice est l’Office Notarial National.

Ingingo ya 3: Ifasi y’Ibiro bya Noteri by’Igihugu ni Repubulika y’u Rwanda yose. Ifasi y’Ibiro bya Noteri by’Intara cyangwa Umujyi wa Kigali ni Intara cyangwa Umujyi wa Kigali. Ifasi y’Ibiro bya Noteri wo mu Kigo cya Leta gishinzwe guteza imbere ishoramari ni Repubulika y’u Rwanda yose. Article 3: The area jurisdiction for the national notarial office shall be the whole country’s area. The area jurisdiction for the Government Department in charge of investment promotion shall be the whole country’s area. The area jurisdiction for the Province’s or the Kigali City’s notarial offices shall be the Province or the Kigali City. Article 3 : Le ressort de l’Office Notarial National est tout le territoire de la République. Le ressort de l’Office Notarial du Service de l’Etat chargé de la promotion des investissements est tout le territoire de la République. Le ressort de l’Office Notarial de la Province ou de la Ville de Kigali est la Province ou la Ville de Kigali.

Ingingo ya 4: Icyicaro cy’ibiro bya Noteri by’Igihugu kiri muri Minisiteri ishinzwe ubutabera. Icyicaro cy’ibiro bya Noteri by’Intara cyangwa Umujyi wa Kigali biri ku cyicaro cy’Intara cyangwa Umujyi wa Kigali. Icyicaro cy’ibiro bya Noteri wo mu Kigo gishinzwe guteza imbere ishoramari kiri ku cyicaro cy’icyo kigo. Article 4: Head office for the National notarial office shall be at the Justice Ministry. Notarial office’s head office for the Province or Kigali City shall be at their respective head office. Notarial office’s head office for the Government Department in charge of investment promotion shall be at the latter’s head office. Article 4 : Le siège de l’Office Notarial National est fixé au Ministère chargé de la Justice. Le siège de l’Office Notarial de la Province ou de la Ville de Kigali est fixé au chef lieu de Province ou de la Ville de Kigali. Le siège de l’Office Notarial auprès du Service de l’Etat chargé de la promotion des investissements est fixé à son siège.

Ingingo ya 5: Abakozi bashinzwe imirimo ya Notariya mu Biro bya Noteri by’Igihugu kimwe n’umuyobozi ufite mu nshingano ze imirimo ya notariya muri Minisiteri ishinzwe ubutabera ni ba Noteri b’Igihugu. Bakorera imirimo yabo muri Biro bya Noteri by’Igihugu biri i Kigali. Article 5: Officers entrusted with notarial duties within the National Notarial Office and the Director of the Unit holding notarial duties in its remit within the Justice Ministry are hereby designated to discharge notarial duties. They shall do so within the National Notarial Office. Article 5 : Les agents chargés des fonctions de notaire dans l’Office Notarial National et le Directeur de l’Unité ayant dans ses attributions les fonctions de notaire au Ministère chargé de la Justice sont désignés pour remplir les fonctions de notaire. Ils exercent leurs fonctions auprès de l’Office Notarial National à Kigali.

Ingingo ya 6: Abakozi bo mu Mujyi wa Kigali bakurikira ni ba Noteri: 1. Umukozi ushinzwe serivisi ishinzwe iby’amategeko na notariya; 2. Umukozi ushinzwe inyandiko n’amasezerano muri serivisi ishinzwe iby’amategeko na notariya; Imirimo yabo bayikorera mu Biro bya Noteri biri mu Mujyi wa Kigali. Article 6: Officers of the Kigali City hereafter named are hereby designated to discharge notarial duties; 1. Officer in charge of the Department for legal and notarial duties; 2. Officer in charge of deeds and contracts within the Department for legal and notarial duties. They do so within the Kigali City’s notarial office. Article 6 : Les agents de la Ville de Kigali nommés ci-après sont désignés pour remplir les fonctions de notaire : 1. L’agent chargé du service chargé des affaires juridiques et du notariat ; 2. L’agent chargé des actes et contrats dans le service chargé des affaires juridiques et du notariat Ils exercent leurs fonctions auprès de l’Office Notarial de la Ville de Kigali.

Ingingo ya 7: Umuyobozi mu Ntara ufite mu nshingano ze ibyerekeye amategeko ni noteri, akorera imirimo ya Notariya mu biro bya Noteri by’Intara. Article 7: The Director in charge of legal affairs in the Province is hereby designated to discharge his duties at the Province’s notarial office. Article 7 : Le Directeur chargé des affaires juridiques à la Province est désigné pour remplir ses fonctions auprès de l’Office notarial de cette province.

Ingingo ya 8: Umukozi ushinzwe imirimo ya Notariya mu Kigo gishinzwe guteza imbere ishoramari ni Noteri. Ububasha bwe buteganijwe mu ngingo ya 9 y’iri teka, ariko bugarukira ku mirimo ikorerwa abashoramari baturuka hanze baje gushora imari yabo mu Rwanda cyangwa abohereza ibintu mu mahanga. Article 8: The Officer in charge of notarial duties at the Government Department for investment promotion is hereby appointed as notary public. Article 8 : L’agent chargé des fonctions de notaire au Service de l’Etat chargé de la promotion des investissements est désigné notaire.

Ingingo ya 9: Noteri afite ububasha bushingiye ku bikorwa bukurikira: 1° Guha agaciro k’inyandikompamo inyandiko ashyiraho umukono; 2° Kwemeza imikono iri ku nyandiko zinyuranye; 3° Gutanga za kopi z’inyandiko yakoze; 4° Gutegura amasezerano anyuranye; 5° Kurangiza imanza, mu gihe iyo nshingano ayihabwa n’andi mategeko; 6° Kugira inama abamugana mu byerekeye akazi akora. Icyakora ku byerekeye inyandiko zijya mu mahanga imikono ya ba Noteri bo mu biro bya Noteri by’Intara n’iby’Umujyi wa Kigali igomba kubanza kwemezwa na ba Noteri bo mu biro bya Noteri by’Igihugu. Inyandiko zikozwe n’abanoteri bo mu Ntara, Umujyi wa Kigali, na noteri wo mu Kigo cya Leta gishinzwe ishoramari zifite agaciro kamwe mu gihugu hose. Article 9: The notary public shall exercise the following powers in discharging his duties : 1. authenticating documents by their signing; 2. legalizing signatures found on documents; 3. issuing copies of his own affidavits; 4. drafting contracts; 5. executing court orders when so required by law; 6. advising/counseling customers on his own services. However for deeds to be used abroad, signatures from Provinces and the Kigali City notaries shall be legalized by the National Notarial office’s notaries. Deeds drafted by notaries from Provinces, Kigali City and by the Notary in the Government Department in charge of Investment Promotion are valid all over the whole country. Article 9 : Le notaire a les compétences ci-après dans l’exercice de ses fonctions : 1. Authentifier les écrits en opposant sa signature ; 2. Légaliser les signatures apposées sur les documents ; 3. Délivrer les copies des actes qu’il a rédigés ; 4. Préparer les contrats ; 5. Exécuter les jugements lorsqu’il en est chargé par d’autres lois ; 6. Conseiller les bénéficiaires de ses services public sur ses fonctions. Toutefois pour les actes destinés à l’étranger, les signatures des Notaires des Provinces et de la Ville de Kigali doivent être légalisées par les Notaires de l’Office Notarial National. Les actes rédigés par les notaires des Provinces, de la Ville de Kigali et du Notaire du Service de l’Etat chargé de la promotion des investissements sont également valables sur tout le territoire de la République.

Ingingo ya 10: Mu mirimo yabo, ba Noteri bo mu Ntara no mu Mujyi wa Kigali, na Noteri wo mu Kigo cya Leta gishinzwe guteza imbere ishoramari bagenzurwa kandi bakagirwa inama n’abakozi bashinzwe imirimo ya notariya mu biro bya Noteri by’Igihugu biri muri Minisiteri y’Ubutabera. Bitabangamiye amategeko asanzwe agenga imirimo y’ibanze bakora, Minisitiri ushinzwe ubutabera ashobora guha ibihano abakozi bakora imirimo ya notariya kubera amakosa bakoze mu kazi kabo ka notariya cyangwa bitwaje ako kazi. Article 10: While discharging their duties, notaries in Provinces and Kigali City as well as in the Department for Investment Promotion shall be monitored and advised by officers with notarial duties at the National Notarial Office of the Justice Ministry. Without prejudice to statutes regulating their main duties, the Minister in charge of justice can take disciplinary measures towards irregularities performed by notaries within their functions or while executing them. Article 10 : Dans l’exercice de leurs fonctions, les Notaires des Provinces, de la Ville de Kigali et du Service chargé de la promotion des investissements sont contrôlés et conseillés par les agents exerçant les fonctions de notaire auprès de l’Office Notarial National au Ministère de la Justice. Sans préjudice aux lois régissant leurs fonctions principales, le Ministre chargé de la justice peut prendre des sanctions disciplinaires contre les fautes commises par les notaires dans leurs fonctions ou à l’occasion de leur exercice.

Ingingo ya 11: Ba Noteri birengera ubwabo amakosa bakoze mu kazi, yaba aturutse ku burangare cyangwa ku kutubahiriza amategeko. Article 11 : Notaries shall commit their individual responsibility for any faults made while discharging their duties by negligence or breaking the Law . Article 11 : Les notaires engagent leurs responsabilités personnelles pour les fautes commises dans l’exercice de leurs fonctions suite à une négligence ou au non respect des lois.

Ingingo ya 12: Minisitiri w’Intebe, Minisitiri ufite Ubutabera mu nshingano ze, Minisitiri ufite Ishoramari mu nshingano ze na Minisitiri ufite Ubutegetsi by’Igihugu mu nshingano ze bashinzwe kubahiriza iri teka buri wese mu bimureba. Article 12: The Prime Minister, the Minister holding Justice, the Minister holding Investment and the Minister holding Local Administration in their remit are entrusted with implementing this Order. Article 12 : Le Premier Ministre, Le Ministre chargé de la Justice, le Ministre chargé des Investissements et le Ministre chargé de l’Administration Locale sont chargés de l’exécution du présent arrêté.

Ingingo ya 13: Ingingo zose z’amateka yabanjirije iri kandi zinyuranye naryo zivanyweho. Article 13: All prior and contrary provisions to this Order are hereby repealed. Article 13 : Toutes les dispositions antérieures contraires au présent arrêté sont abrogées
