It shall be in charge of supervision, following up and ensuring that issues relating to foretsry receive attention in all national development plans. In particular, the responsibilities of NAFA shall be the following: participating in designing the 1° policies and strategies relating to forestry as well as promoting agroforestry and ensuring the implementation of such policies and strategies; advising the Government on 2° policies, strategies and legislation related to the forestry management as well as to the implementation of international conventions relating to the forestry and to the protection of natural resources such as land, water and forest biodiversity in forestry area; supporting organs that are in 3° charge of fighting soil erosion the aim of safeguarding forestry and environment; with preparing national programs in 4° matters of reforestation, forestry management and helping Districts to prepare their own forestry management and processing and supervising the implementation of such programs; 5° advising, assisting and encouraging private sector stakeholders in participating in activities of reforestation, their effective management and to make them productive; 6° making and updating the list of tree species to be planted in the country and their respective suitable areas according to the type of soil and the NAFA peut, sur Arrêté du Premier Ministre, établir des branches en tout autre lieu du territoire national pour mieux s'acquitter de sa mission. Article 4: Competences of NAFA In order to fulfill its responsibilities described in this law, and in the framework of protection and preservation of forestry resources and tracking all those who abuse the aforementioned resources without prejudice to laws on environment, NAFA shall have the following competence: to order the suspension of 1° activities of reforestation or deforestation, trade of forestry products, importing and exporting trees and their products which in case they do not respect the provisions of laws relating to forestry in Rwanda; publier les résultats de 9° recherche sur la technologie dans le domaine de la plantation des arbres dans les champs cultivables et dans les pâturages et de reboisements spécifiques, entretenir les forêts et l’exploitation de cette ressource pour générer des revenus, utiliser rationnellement des forêts et de leurs dérivés et rassembler toutes les données nécessaires sur les forêts et leurs dérivés ; 10° dans le cadre des activités de reboisement, d’entretien, de protection et de valorisation des produits forestiers; élaborer les normes techniques assurer l’évaluation et le suivi 11° du programme des projets de développement pour veiller au respect des normes de gestion et d’utilisation rationnelle des forêts ; 12° établir des relations avec d’autres offices et les organismes internationaux dont la mission est en rapport avec les activités de la foresterie. Article 4 : Compétences de NAFA Pour s’acquitter de la mission lui conférée par la présente loi et dans le cadre de la protection, de la conservation et de la poursuite de tous ceux qui en abusent des ressources forestières et sans préjudice des lois sur l’environnement, NAFA est investi de la compétence suivante : ordonner la suspension des 1° activités de reboisement ou de déboisement, de commercialisation des produits forestiers, d’importation ou d’exportation des arbres et des produits forestiers qui ne sont pas en conformité avec les dispositions légales relatives à y y g g y y g cyangwa gutema amashyamba, gucuruza ibiyakomokaho, kwinjiza cyangwa gusohora mu Gihugu ibiti n’ibibikomokaho mu gihe bitubahirije amategeko agenga ibyerekeye amashyamba mu Rwanda; 2° to give to Districts, public institutions, associations and to the private sector, relevant instructions concerning activities of forestry; gutanga amabwiriza ku Turere, 2° ku bigo bya Leta, ku mashyirahamwe n’abikorera, mu rwego rwo guteza imbere ibikorwa by’amashyamba; gusura nta nteguza aho ariho 3° hose hakorerwa ibikorwa by’amashyamba; gutanga ibihembo n’inkunga 4° zishoboka mu rwego rw’ubushakashatsi, kurinda no guteza imbere gahunda n’ibikorwa by’amashyamba. Article 5: Relations entre NAFA et les entités administratives locales Les relations entre NAFA et les entités administratives locales se manifestent dans les cas suivants: NAFA appuie les entités 1° administratives locales dans la mise en œuvre de tous les programmes de reboisement, de gestion et de la promotion de la foresterie ; NAFA donne des conseils 2° techniques afin d’éviter que les décisions du Conseil de District et les instructions sur l’environnement ne portent préjudice à la bonne gestion des forêts ; les entités administratives 3° locales assurent la supervision quotidienne des programmes de pépinières, de reboisement, d’entretien de récolte des forêts et transmettent le rapport y relatif à la direction de NAFA ; les entités administratives 4° locales assurent la supervision de toutes les activités relatives à la bonne utilisation des dérivés conformément aux lois et aux règlements en vigueur dans le pays selon la nature de l’utilisation et des besoins du District. CHAPTER IV: ORGANISATION AND FUNCTIONING OF NAFA Article 7: Contenu du contrat de performance Le contrat visé à l’article 6 de la présente loi doit préciser notamment les points suivants : les engagements du Conseil 1° d’Administration, ceux de la Direction et ceux de tous les principaux organes de NAFA; 2° NAFA ; les réalisations attendues de la source du patrimoine de 3° NAFA, ses modalités de fonctionnement et d’audit permanent. Members of the Board of Directors shall be mainly selected among the knowledgeable persons with expertise and experience in forestry or any other related field.
