LAW N°39/2006 OF 30/9/2006 DETERMINING THE RESPONSIBILITIES, ORGANISATION, AND FUNCTIONING OF RWANDA OFFICE OF TOURISM AND NATIONAL PARKS (ORTPN)

Ingingo ya mbere: Iri tegeko rigena inshingano, imiterere n’imikorere by’Ikigo cy’Ubukerarugendo na Pariki z’Igihugu mu Rwanda, cyitwa “Office Rwandais du Tourisme et des Parcs Nationaux”, “ORTPN” mu magambo ahinnye y’ururimi rw’igifaransa. ORTPN ifite ubuzimagatozi n’ubwigenge mu miyoborere, mu micungire y’umutungo n’abakozi bayo kandi icungwa hakurikijwe amategeko agenga inzego z’imirimo za Leta. Article one: This law determines the responsibilities, structure and the functioning of Rwanda Office of Tourism and National Parks referred to as “Office Rwandais du Tourisme et des Parcs Nationaux’’, abbreviated as “ORTPN” in French. ORTPN has a legal personality, administrative and financial autonomy and shall be governed in accordance with the laws governing Organs of Public Service. Article premier : La présente loi détermine les attributions, l’organisation et le fonctionnement de l’Office Rwandais du Tourisme et des Parcs Nationaux, « ORTPN » en sigle. L’ORTPN est doté de la personnalité juridique et de l’autonomie financière et administrative et il est géré conformément aux lois relatives à la fonction publique.

Ingingo ya 2: Icyicaro cya ORTPN kiri mu Mujyi wa Kigali, Umurwa Mukuru wa Repubulika y’u Rwanda, ariko gishobora kwimurirwa ahandi hose mu Rwanda igihe bibaye ngombwa. ORTPN ishobora kugira amashami mu gihugu hagati cyangwa mu mahanga igihe bibaye ngombwa byemejwe n’Iteka rya Minisitiri w’Intebe. J.O. n° 23 bis du 01/12/2006 UMUTWE WA II: INSHINGANO ZA ORTPN Article 2: The headquarters of ORTPN are in the City of Kigali, the Capital of Rwanda but may be transferred elsewhere in Rwanda if considered necessary”. ORTPN may, upon approval by an Order of the Prime Minister, have branches elsewhere in the country and abroad, if considered necessary. J.O. n° 23 bis du 01/12/2006 CHAPTER II: RESPONSIBILITIES AND POWERS OF ORTPN Article 2 : Le siège de l’ORTPN est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda. L’ORTPN peut, en cas de nécessité, établir des agences tant à l’intérieur qu’à l’extérieur du pays sur Arrêté du Premier Ministre. UMUTWE WA III: URWEGO RUREBERERA ORTPN Article 3: The main responsibilities of ORTPN are to: Participate in preparation of policies and strategies in matters relating to tourism and environmental 1º conservation in National Parks and other tourist attractions; 2º 3º 4º 5º Implement policies and strategies relating to tourism and environmental conservation in National Parks and other tourist attractions and monitoring its implementation by other agencies; Prepare the master plan of promoting tourism; Publicise Rwanda tourist attractions within Rwanda and abroad and widening markets especially by using modern technology; Collect and disseminating the required information relating to tourism, national parks and other tourist attractions; Participate in international negotiations in matters relating to tourism and conserving national parks and 6º other tourist attractions and to monitor the implementation of the decisions taken therein; 7º Increase and create tourism activities in all domains with emphasis on tourism which does not distort culture and environment; Identify tourist sites and request the concerned persons to include on the list the valuable immovables, Manage, conserve and protect National Parks and other tourist attractions the government placed under the 8º whether historic, intellectual, archaeological, cultural or those that promote tourism; 9º tutorship of the ORTPN; 10º 11º Promote research that is carried out in National Parks and other tourist attractions; Establish and monitor the program of management of Wild Life outside the National Park and other tourist attractions; Collaborate with institutions of other countries and other organs in conserving national Parks and other tourist attractions, especially countries with parks which share borders with Rwanda; 12º 13º Manage efficiently the movables and the immovables as its property and make them more productive. 14º 15º Advise the Government on matters relating to tourism; Establish relations and collaborate with other establishments with the same responsibilities at regional and international levels. CHAPTER III: SUPERVISING AUTHORITY OF ORTPN Article 3 : Les principales attributions de l’ORTPN sont les suivantes : 1° participer à l’élaboration de la politique et des stratégies en rapport avec le tourisme et la conservation de l’environnement dans les parcs et les autres sites touristiques ; 2° exécuter la politique et les stratégies en rapport avec le tourisme et la conservation de l’environnement dans les parcs et les autres sites touristiques et faire le suivi de leur mise en application par les autres organes ; 3° élaborer le schéma directeur de la promotion du tourisme ; 4° faire connaître les attraits touristiques du Rwanda à l’intérieur du pays et à l’étranger et élargir les marchés notamment par l’utilisation des technologies nouvelles ; 5° collecter et diffuser les informations relatives au tourisme, aux parcs et aux autres sites touristiques ; 6° participer aux négociations internationales relatives au tourisme et à la conservation des parcs et des autres sites touristiques et faire le suivi de la mise en application des décisions qui en découlent ; 7° accroître et créer des activités touristiques dans tous les domaines en donnant la priorité au tourisme qui ne nuit pas à la culture et à l’environnement ; 8° déterminer les sites touristiques et proposer aux instances concernées le classement des biens immeubles qui présentent un intérêt historique, scientifique, archéologique, culturel ou touristique ; 9° gérer, conserver et protéger les parcs nationaux et les autres sites touristiques que l’Etat a placés sous tutelle de l’Office ; 10° promouvoir la recherche dans des parcs et autres sites touristiques ; 11° fixer et assurer les programmes de gestion de la faune sauvage à l’extérieur des parcs et des autres sites touristiques ; 12° promouvoir la collaboration avec les agences des autres pays ayant les parcs et le tourisme dans leurs attributions, spécialement ceux ayant des parcs qui partagent les frontières avec les parcs du Rwanda ; 13° assurer la gestion des biens meubles et immeubles affectés à son patrimoine et à sa tutelle et en accroître la productivité ; 14° conseiller le Gouvernement en matière du tourisme ; 15° établir des relations et collaborer avec les agences de même nature tant régionales qu’internationales. CHAPITRE III : DE L’ORGANE DE TUTELLE DE L’ORTPN

Ingingo ya 4: ORTPN irebererwa na Minisiteri ifite Ubukerarugendo na za pariki z’Igihugu mu nshingano zayo. Hagati y’iyo Minisiteri n’Inama y’Ubuyobozi hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza ububasha, uburenganzira n’inshingano za buri ruhande mu kugeza ORTPN ku nshingano zayo. Ayo masezerano amara igihe gihwanye na manda y’abagize Inama y’Ubuyobozi, ashyirwaho umukono na Perezida w’Inama y’Ubuyobozi na Minisitiri ureberera ORTPN. Article 4: ORTPN is supervised by the Ministry in charge of tourism and National Parks. There shall be concluded contract of performance between the Ministry and Management of ORTPN, indicating powers, rights and responsibilities of each party in fulfilling the attributions of ORTPN. Such a contract shall be valid for a period of the term of office of the members of the Board of Directors and it shall be signed by the Chairperson of the Board of Directors and the Minister supervising ORTPN. Article 4 : L’ORTPN est placé sous tutelle du Ministère ayant le tourisme et les parcs nationaux dans ses attributions. Il est signé, entre ce Ministère et le Conseil d’Administration, un contrat de performance déterminant les pouvoirs, les droits et les obligations de chaque partie en vue de la réalisation de la mission de l’ORTPN. Ce contrat est valide pour une durée égale au mandat des membres du Conseil d’Administration et est conjointement signé par le Président du Conseil d’Administration et le Ministre de tutelle de l’ORTPN. Ingingo ya 5: Mu byo amasezerano avugwa mu ngingo ya 4 agomba guteganya mu buryo bwumvikana harimo: J.O. n° 23 bis du 01/12/2006 inshingano z’Inama y’Ubuyobozi ,iz’Ubuyobozi n’iz’inzego zose z’ingenzi za ORTPN; ibigomba kugerwaho na ORTPN; 1° 2° 3° aho umutungo wa ORTPN ukomoka, imikorere yayo n’uburyo buhoraho bwo kubigenzura. UMUTWE WA IV: IMITERERE N’IMIKORERE BYA ORTPN Article 5: Among the contents of the contract mentioned in Article 4, of the present law that should be provided in a clear manner are: 1◦ the responsibilities of the Board of Directors and the management as well as the main responsibilities of ORTPN; 2◦ expected results of ORTPN; 3◦ the source of the property of ORTPN; its functioning and regular evaluation procedures. J.O. n° 23 bis du 01/12/2006 CHAPTER IV: ORGANISATION AND FUNCTIONING OF ORTPN Article 5 : Le contrat de performance visé à l’article 4 doit préciser notamment les points suivants : 1° 2° 3° les engagements du Conseil d’Administration et celles de la Direction ainsi que celles de tous les organes principaux de l’ORTPN ; les réalisations attendues de l’ORTPN ; la provenance des ressources de l’ORTPN, ses modalités de fonctionnement et d’audit permanent. CHAPITRE IV : DE L’ORGANISATION ET DU FONCTIONNEMENT DE L’ORTPN

Ingingo ya 6: ORTPN igizwe n’inzego z’ubuyobozi ebyiri (2) zikurikira: 1° Inama y’Ubuyobozi; 2° Ubuyobozi. Icyiciro cya mbere: Inama y’Ubuyobozi Article 6: ORTPN is comprised of the following two (2) administrative organs: 1° the Board of Directors; 2° the Management Section one: The Board of Directors Article 6 : L’ORTPN est doté de deux (2) organes suivants : 1° 2° le Conseil d’Administration ; la Direction. Section première : Du Conseil d’Administration

Ingingo ya 7: Inama y’Ubuyobozi ya ORTPN ni rwo rwego ruyiyobora kandi rushinzwe gufata ibyemezo. Ifite ububasha busesuye n’inshingano byo gucunga umutungo wa ORTPN kugira ngo ishobore kugera ku nshingano zayo. Iteka rya Minisitiri w’Intebe rishyiraho abagize Inama y’Ubuyobozi barindwi (7) barimo Perezida na Visi–Perezida. Nibura mirongo itatu ku ijana (30% ) by’abagize Inama y’Ubuyobozi bagomba kuba ari abagore. Nibura babiri (2) mu bagize Inama y’Ubuyobozi, ni abantu bafite ubuhanga cyangwa uburambe mu birebana n’ibidukikije cyangwa ubukerarugendo. Abagize inama y’Ubuyobozi bafite manda y’imyaka itatu (3) ishobora kongerwa inshuro imwe gusa. Article 7: The Board of Directors of ORTPN is the authority which directs ORTPN and which is in charge of taking decisions. It shall have full powers and responsibilities to manage its property in order for ORTPN to fulfil its attributions. The Prime Minister, through an Order, appoints seven (7) members of the Board of Directors including the Chairperson and the Vice Chairperson. At least thirty percent (30%) of the members of the Board of Directors shall be women. At least, two (2) members of the Board of Directors shall be selected among the knowledgeable persons with expertise and experience in matters related to environment and tourism. Members of the Board of Directors are appointed for a period of three (3) years renewable only once. Article 7 : Le Conseil d’Administration de l’ORTPN est l’organe suprême de gestion et de décision. Il est investi des pouvoirs étendus et de la mission d’assurer la gestion du patrimoine en vue de la réalisation de la mission de l’ORTPN. Un Arrêté du Premier Ministre nomme sept (7) membres du Conseil d’Administration dont un Président et un Vice- Président. Trente pour cent (30%) au moins des membres du Conseil d’Administration sont de sexe féminin. Au moins deux (2) membres du Conseil d’Administration sont choisis parmi des personnes possédant de larges connaissances ou une longue expérience dans le domaine de l’environnement ou du tourisme. Les membres du Conseil d’Administration sont désignés pour un mandat de trois (3) ans renouvelable une seule fois.

Ingingo ya 8: Inama y’Ubuyobozi ya ORTPN ifite inshingano zikurikira : 1° gutanga icyerekezo cy’ibikorwa na gahunda y’imikorere bya ORTPN; 2° kwemeza umushinga w’amategeko ngengamikorere ya ORTPN ashyirwaho n’Iteka rya Minisitiri ureberera ORTPN; 3° kwemeza imbanzirizamushinga y’ingengo y’imari ya buri mwaka, mbere yo kuyishyikiriza inzego zibishinzwe; 4° gusuzuma imikorere ya ORTPN hakurikijwe gahunda n’ingengo y’imari; 5° kwemeza raporo y’ibikorwa na raporo y’imikoreshereze y’umutungo z’umwaka urangiye; 6° gukurikirana imikorere y’Ubuyobozi bwa ORTPN n’abakozi bayo. Article 8: The Board of Directors of ORTPN has the following responsibilities: 1◦ to provide the vision and plan of action of ORTPN; 2◦ to approve the Rules and Regulations established by the Ministerial Order supervising ORTPN; 3◦ to approve the annual draft budget before it is submitted to relevant organs; 4◦ to examine the performance of ORTPN in accordance with the programs and budget of ORTPN ; 5º to approve the annual and financial reports for the previous year; 6º to monitor the performance of the administration and the personnel of ORTPN. Article 8 : Les attributions du Conseil d’Administration de l’ORTPN sont les suivantes : 1° déterminer la vision stratégique et le plan d’action de l’ORTPN ; 2° adopter le projet de règlement d’ordre intérieur de l’ORTPN qui sera approuvé par un arrêté du Ministre de tutelle; approuver l’avant-projet de budget annuel avant de le transmettre aux organes compétents ; évaluer les performances de l’ORTPN sur base du plan d’action et du budget ; approuver le rapport d’activités et le rapport d’utilisation du patrimoine pour l’exercice précédent; faire le suivi de la performance de la Direction de l’ORTPN et de son personnel. 3° 4° 5° 6°

Ingingo ya 9: Inama y’Ubuyobozi ya ORTPN iterana rimwe mu gihembwe n’igihe cyose bibaye ngombwa itumijwe na Perezida wayo cyangwa Visi-Perezida igihe Perezida adahari, babyibwirije cyangwa bisabwe mu nyandiko nibura na kimwe cya gatatu (1/3) cy’abayigize. Ubutumire bukorwa mu nyandiko ishyikirizwa abagize Inama y’Ubuyobozi hasigaye nibura iminsi cumi n’itanu (15) ngo inama iterane. Icyakora, inama idasanzwe itumizwa mu nyandiko hasigaye nibura iminsi itanu (5) kugira ngo iterane. Mu byigwa n’Inama y’Ubuyobozi mu gihembwe cya mbere cy’umwaka harimo kwemeza raporo y’ibikorwa n’imikoreshereze y’umutungo mu mwaka urangiye ; mu gihembwe cya gatatu hakabamo gahunda yo gusuzuma umushinga w’ingengo y’imari na gahunda y’ibikorwa by’umwaka ukurikira. Buri gihembwe kandi igomba J.O. n° 23 bis du 01/12/2006 gusuzuma raporo y’imari n’iy’ibikorwa byerekeranye n’igihembwe kirangiye igashyikirizwa Minisitiri ureberera ORTPN; Uburyo inama iterana n’uko ibyemezo bifatwa biteganywa n’amategeko ngengamikorere ya ORTPN. Article 9: The meeting of the Board of Directors of ORTPN is held once in every term and at any time it is considered necessary, it shall be convened by the Chairperson or its Vice Chairperson, in absence of the Chairperson, at his/her own initiative, or upon the proposal in writing by a third (1/3) of its members. The invitations shall be submitted in writing to the Board of Directors at least fifteen (15) days before the date of the meeting. However, the extra ordinary meeting shall be after a written notice of convened in writing at least five (5) days before it is held. Items to be examined by the meeting of the Board of Directors in the first term of the year shall include approval of the activity report and the use of the property in the previous year; in the third term, there shall be included the examination of the draft of the annual budget and the plan of action of the following year. Also, in every term, the Board of Directors shall examine the financial and activity reports relating to previous term and the report shall be transmitted to the Minister supervising ORTPN. The procedures through which the meeting is convened and the mode of taking decisions shall be determined by the rules and regulations of ORTPN. J.O. n° 23 bis du 01/12/2006 Article 9 : Le Conseil d’Administration de l’ORTPN se réunit une fois par trimestre et chaque fois que de besoin, sur convocation de son Président ou de son Vice-Président en cas d’absence du Président, à leur propre initiative, ou à la demande écrite d'un tiers (1/3) de ses membres. La convocation est faite par notification écrite et doit parvenir aux membres du Conseil d’Administration au moins quinze (15) jours avant la tenue de la réunion. Toutefois, en cas de réunion extraordinaire, la convocation se fait par notification écrite au moins cinq (5) jours avant sa tenue. J.O. n° 23 bis du 01/12/2006 A l’ordre du jour du premier trimestre de l’année figurent notamment les points relatifs à l’approbation des rapports d’activités et de gestion du patrimoine pour l’exercice précédent. L’ordre du jour de la réunion du troisième trimestre comprend notamment l’examen de l’avant-projet de budget et du programme d’activités pour l’exercice suivant. Chaque trimestre, le Conseil d’Administration doit également examiner le rapport financier et le rapport d’activités pour le trimestre écoulé et le soumettre au Ministre de tutelle. Les modalités de réunion et de prise de décisions sont prévues par le règlement d’ordre intérieur de l’ORTPN.

Ingingo ya 10: Inama y’Ubuyobozi ishobora gutumira mu nama yayo umuntu wese ibona ko ashobora kuyungura inama ku ngingo runaka ifite ku murongo w’ibyigwa. Uwatumiwe ntiyemerewe gutora no gukurikira iyigwa ry’izindi ngingo ziri ku murongo w’ibyigwa. Article 10: The Board of Directors may invite in its meeting any person from whom it may seek advice on a specified issue on the agenda. The invitee is not allowed to vote and follow the debates on other issues on the agenda. Article 10 : Le Conseil d’Administration peut, au cours de ses réunions, consulter toute personne qu’il juge compétente pour l’examen d’un point inscrit à l’ordre du jour. La personne invitée n’a pas de voix délibérative et participe uniquement aux débats concernant le point sur lequel elle est consultée.

Ingingo ya 11: Inyandiko y’ibyemezo by’inama y’Inama y’Ubuyobozi ishyirwaho umukono n’abayigize inama ikirangira, kopi yayo ikohererezwa Minisitiri ureberera ORTPN mu gihe kitarenze iminsi itanu (5) kugira ngo agire icyo abivugaho mu gihe kitarenze iminsi cumi n’itanu (15) kuva ayishyikirijwe. Iyo icyo gihe kirenze ntacyo arabivugaho imyanzuro y’inama iba yemewe burundu. Inyandikomvugo y’inama ishyirwaho umukono na Perezida n’umwanditsi bayo, ikemezwa mu nama ikurikira. Kopi y’inyandikomvugo yohererezwa Minisitiri ureberera ORTPN mu gihe kitarenze iminsi cumi n’itanu (15) guhera umunsi yemerejweho. Article 11: The resolutions of the meeting of the Board of Directors shall be signed by its members immediately at its completion, and a copy shall be sent to the Minister supervising ORTPN in a period not exceeding five (5) days in order to give his/her views in a period not exceeding fifteen (15) days from its reception. If this period expires when he/she has not given his/her views, the decisions of the meeting shall be definitively approved. The minutes of the meeting shall be signed by the Chairperson and its rapporteur, and shall be approved in the following session. The copy of the minutes shall be sent to the Minister supervising ORTPN in a period not exceeding fifteen (15) days from the day of its approval. Article 11 : Les résolutions du Conseil d’Administration sont immédiatement signées par les membres présents à la séance et transmises au Ministre de tutelle de l’ORTPN dans un délai ne dépassant pas cinq (5) jours pour avis et considérations endéans quinze (15) jours à dater de leur réception. Passé ce délai sans réaction du Ministre, les décisions du Conseil sont réputées définitives. Le procès-verbal de la réunion du Conseil d’Administration est signé conjointement par son Président et son rapporteur et soumis à la séance suivante pour approbation. Une copie du procès-verbal est envoyée au Ministre de tutelle de l’ORTPN dans un délai ne dépassant pas quinze (15) jours à compter du jour de son approbation.

Ingingo ya 12: Abagize Inama y’Ubuyobozi bitabiriye inama z’Inama y’Ubuyobozi bahabwa amafaranga agenwa n’Iteka rya Perezida. Article 12: Members of the Board of Directors who are present in the meeting of the Board of Directors shall receive sitting allowances to be determined by a Presidential Order. Article 12 : Les membres du Conseil d’Administration bénéficient de jetons de présence dont le montant est déterminé par Arrêté Présidentiel.

Ingingo ya 13: Ntibyemewe ku bagize Inama y’Ubuyobozi cyangwa ibigo bafitemo imigabane gukora umurimo uhemberwa muri ORTPN. Article 13: Members of the Board of Directors and companies in which they have shares are not allowed to perform any remunerated activity in ORTPN. Article 13 : Il est interdit aux membres du Conseil d’Administration et aux sociétés dont ils sont associés d’exercer des fonctions rémunérées au sein de l’ORTPN.

J.O. n° 23 bis du 01/12/2006 Icyiciro cya kabiri: Ubuyobozi n’inzego z’imirimo bya ORTPN Article 14: A member of the Board of Directors shall leave his/her position if: 1◦ his/her mandate expires; 2◦ he or she resigns through writing; 3◦ he or she is no longer able to perform his/her duties due to physical or mental disability certified by an authorized medical doctor; 4◦ he/she is definitively sentenced to unsuspended sentence of a term of imprisonment equal to or exceeding six (6) months; 5◦ he or she is absent in meetings for three (3) consecutive times in a year with no justified reasons; 6◦ it is clear that he or she no longer fulfils the requirements considered at the time of his or her appointment in the Board of Directors; 7◦ he or she demonstrates behaviours contrary to his/her responsibilities; 8◦ he or she jeopardises the interests of ORTPN; 9◦ he or she confesses and pleads guilty of the crime of genocide; 10◦ he or she dies. The Minister supervising ORTPN shall indicate in the report meant for competent organs, if one of the members of the Board of Directors is not worth its membership or if he or she is no longer in his/ her position in accordance with the preceding paragraph. In case one of the members of the Board of Directors leaves his/her duties before his/her term of office has expired, the competent authorities shall appoint his/her substitute. The appointee shall complete the remaining term of office. J.O. n° 23 bis du 01/12/2006 Section 2: Management and Departments of ORTPN Article 14 : Un membre du Conseil d’Administration perd la qualité de membre dans les cas suivants : expiration du mandat ; incapacité physique ou mentale constatée par un médecin agréé ; condamnation définitive à une peine d’emprisonnement supérieure ou égale à (6) mois sans sursis ; trois (3) absences consécutives dans une année aux réunions sans raisons valables ; constat qu’il ne remplit plus les conditions requises pour lesquelles il avait été nommé ; comportement incompatible avec ses fonctions ; agissement contre les intérêts de l’ORTPN ; aveu et plaidoyer de culpabilité pour crime de génocide ; 1° 2° démission par notification écrite ; 3° 4° 5° 6° 7° 8° 9° 10° décès. Le Ministre de tutelle constate que l’un des membres du Conseil d’Administration n’a plus la qualité d’être membre ou que son poste est vacant dans un rapport adressé à l’organe compétent conformément aux dispositions de l’alinéa précédent. Si un membre du Conseil d’Administration perd la qualité de membre avant l’expiration de son mandat, l’autorité de nomination désigne le remplaçant. By’umwihariko Umuyobozi ashinzwe ibi bikurikira: 1° gutanga amabwiriza y’akazi ka ORTPN n’ay’ubuyobozi bw’amashami yose y’Ubuyobozi; 2° gutegura no gushyikiriza Inama y’Ubuyobozi imbanzirizamushinga y’ingengo y’imari izakoreshwa mu mwaka ukurikira na raporo y’ingengo y’imari y’umwaka ushize; 3° gushyira mu bikorwa ingengo y’imari no gucunga umutungo wa ORTPN; 4° gukurikirana imicungire y’abakozi ba ORTPN akurikije amategeko; 5° kumenyesha mu nyandiko Inama y’Ubuyobozi imigendekere n’ibikorwa bya ORTPN, nibura rimwe mu gihembwe; 6° guhagararira ORTPN imbere y’amategeko. Hagati y’Inama y’Ubuyobozi n’ubuyobozi hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza nibura inshingano za buri ruhande n’ibyangombwa bikenewe kugira ngo ORTPN igere ku nshingano zayo. Article 15: The management of ORTPN is entrusted to its Director who is appointed by an Order of the Prime Minister. He or she coordinates and directs the daily activities of ORTPN and shall be answerable to the Board of Directors on how its recommendations are implemented. In particular, the Director is responsible for: 1◦ issuance of ORTPN work and all administrative branch directives; 2◦ preparing and transmitting to the Board of Directors the draft budget proposal for the following year and the budget report of the previous year; 3◦ executing the budget and managing the property of ORTPN; 4◦ ensuring the management of the personnel of ORTPN in accordance with law; 5◦ informing the Board of Directors, in writing, of the performance and activities of ORTPN at least once a term; 6◦ representing ORTPN before the law. Article 15 : La gestion journalière de l’ORTPN est assurée par son Directeur nommé par Arrêté du Premier Ministre. Il coordonne et dirige les activités journalières de l’ORTPN et est responsable devant le Conseil d’Administration de la mise en œuvre de ses décisions. Le Directeur de l’ORTPN est spécialement chargé de : 1° donner des instructions de service de l’ORTPN et de la direction de tous les départements ; 2° élaborer et soumettre au Conseil d’Administration l’avant-projet de budget pour l’exercice suivant ainsi que le rapport d’exécution du budget pour l’exercice précédent ; assurer l’exécution du budget et la gestion du patrimoine de l’ORTPN ; assurer la gestion du personnel de l’ORTPN conformément aux lois ; informer par écrit au moins une fois par trimestre le Conseil d’Administration de l’état d’avancement des activités de l’ORTPN ; représenter l’ORTPN devant la loi. 3° 4° 5° 6° Est signé, entre le Conseil d’Administration et la Direction, un contrat de performance déterminant au moins les obligations de chaque partie et les besoins nécessaires à la réalisation de la mission de l’ORTPN.

Ingingo ya 16: Umuyobozi akurikira inama z’Inama y’Ubuyobozi , akazibera umwanditsi. Ashobora kuyitangamo ibitekerezo ariko ntatora mu ifatwa ry’ibyemezo. Umuyobozi wa ORTPN ntajya mu nama zifata ibyemezo ku bibazo bimureba; icyo gihe Inama y’Ubuyobozi yitoramo umwanditsi. Amategeko ngengamikorere ya ORTPN agena umusimbura iyo adahari. Article 16: The Director shall attend the proceedings of the meeting of the Board of Directors and shall serve as their rapporteur. He or she may give views but is not allowed to vote during decision making. The Director of ORTPN shall not participate in the meetings that take decisions on issues that concern him or her; in that case, the Board of Directors shall elect a rapporteur from among itself. The internal rules and regulations of ORTPN shall determine his/her substitute in case of his/her absence. Article 16 : Le Directeur assiste aux réunions du Conseil d’Administration et en est le rapporteur. Il peut participer aux débats du Conseil mais sans voix délibérative. Il est interdit au Directeur de prendre part aux réunions du Conseil d’Administration qui traite des points qui le concernent personnellement. Dans ce cas, le Conseil d’Administration élit en son sein un rapporteur. Le Règlement d’Ordre Intérieur de l’ORTPN détermine son remplaçant en cas d’absence.

Ingingo ya 17: Ibyo Umuyobozi n’abakozi ba ORTPN bagenerwa biteganywa n’amategeko agenga ibyo abakozi b’ibigo bya Leta bagenerwa. Article 17: Benefits of the Director and the members of staff of ORTPN shall be determined in accordance with legal provisions that govern members of staff of public institutions. Article 17 : Les appointement accordés au Directeur et au personnel de l’ORTPN sont déterminés conformément aux lois régissant la rémunération du personnel des établissements publics.

Ingingo ya 18: Imiterere n’inshingano by’inzego z’imirimo ya ORTPN, kimwe n’amashami yayo bigenwa n’Iteka rya Minisitiri w’Intebe, abisabwe na Minisitiri ureberera ORTPN, amaze kumva icyo Inama y’Ubuyobozi ibivugaho. Abakozi ba ORTPN bagengwa n’amategeko rusange agenga abakozi ba Leta n’inzego z’imirimo ya Leta. UMUTWE WA V: UMUTUNGO N’IMARI Article 18: The organisational structure and the responsibilities as well as the branches of ORTPN shall be determined by an Order of the Prime Minister, upon request by the Minister supervising ORTPN, after consulting the Board of Directors. ORTPN personnel shall be governed by the General Statutes governing Rwanda Public Service. CHAPTER V: PATRIMONY AND FINANCE Article 18 : L’organisation et les attributions des services et des départements de l’ORTPN sont déterminées par Arrêté du Premier Ministre, sur proposition du Ministre de tutelle de l’ORTPN, après avis du Conseil d’Administration. Le personnel de l’ORTPN est régi par le statut général de la fonction publique rwandaise. CHAPITRE V: DU PATRIMOINE ET DES FINANCES

Ingingo ya 19: Umutungo wa ORTPN ugizwe n’ibintu byimukanwa n’ibitimukanwa . Article 19: The patrimony of ORTPN is comprised of movables and immovables. It comes from the following: 1◦ the State budget; 2◦ Government or donor subsidies ; 3◦ funds from the activities performed by ORTPN; 4◦ interest from its investments; 5◦ donation and bequest. Article 20: The use, management and audit of the patrimony of ORTPN shall be carried out in accordance with State property audit regulations. The audit responsible for daily auditing of the use of the property of ORTPN shall submit a report to the Board of Directors and reserves a copy to the Director of ORTPN. Article 20: L’utilisation, la gestion et l’audit du patrimoine de l’ORTPN sont régis par les dispositions légales en la matière. Le service d’audit interne de l’ORTPN transmet son rapport au Conseil d’Administration et réserve copie au Directeur de l’ORTPN.

Ingingo ya 21: Ingengo y’imari ya ORTPN yemezwa kandi igacungwa hakurikijwe amategeko abigenga. UMUTWE WA VI: INGINGO ZISOZA Article 21: The budget of ORTPN is approved and managed in accordance with the relevant legal provisions.
