ARTICLE 1 OEFINITIONS For the purpose of this Agreement, and unless the context otherwise requires, the following terms and expressions shall have the meaning as stated hereunder: "Additional Protocol" means the Additional Protocol to the OAU General Convention on Privileges and lmmunities, adopted in July 1980 and acceded to by the Republic of Rwanda on 22 July 1985; "AiiA" means the African Medicines Agency; "AMA Headquarters and Premises" means areas designated as offices', laboratory, lands and any space, buildings, structures, equipment and other installations and facilities, as well as surrounding ground, occupied temporarily or permanently by the AMA located in the Host Country; "AMA Treaty" means the Treaty for the Establishment of the African Medicines Agency, adopted in February 2019 and entered into force on 05 November 2021 ; 'Agreement" means the present Headquarters Agreement between the African Medicines Agency and the Govemment of the Republic of Rwanda on the hosting of the AMA Headquarters and Premises; "Appropriate Authorities" means such national, local or other authority in the Host Country, as may be appropriate under the laws of the Host Country; "Archives" includes records, conespondence, documents, manuscripts, still and motion pictures, films and sound recordings, electronic records, belonging to or held by the AMA Headquarters and Premises in furtherance of its official functions; "Commission" means the African Union Commission established by the Constitutive Act of the African Union; "Chairperson" means the Chairperson of the African Union Commission, as defined by Article 20 of the Constitutive Act of the African Union; "Director General" refers to the head of the Secretariat of the AMA, as established by Article 24 ol lhe AMA Treaty; "Experts" mean individuals, other than officials, who owing to their special qualifications are recruited on a temporary basis to perform a specific assignment in the AMA Headquarters and Premises; 1 2 ( Official Gazette n° Special of 14/07/2023501 "General Convention" means the General Convention on the Privileges and lmmunities of the Organization of African Unity (OAU), adopted in July 1964 and ratified by the Republic of Rwanda on 18 June 1974; "Government" means the Govemment of the Republic of Rwanda; "Host Country" means the Republic of Rwanda; "Member of the AMA" refers to a member of the Governing Board and the Technical Committees who is appointed by the Conference of State Parties and the Governing Board, respectively, in accordance with Article 15 and 20 of the AMA Treaty; "Officials" means the Director General and all staff members of the AMA P4 rank and above, serving in the AMA Headquarters and Premises, inespective of nationality, except those recruited locally on hourly rates of pay, as defined in the Staff Regulations and Rules; "Organs of AMA" refers to the Conference of the State Parties, Goveming Board, Secretariat and Technical Committees of the AMA, as established byReferenced legislation
