"Sentence" meons ony punishment or meosure involving deprivotion of liberty ordered by o Court of Low or Tribunol of one of the Controcting Porties for o determinont period of iime or for life imprisonment in the exercise of iis criminol jurisdiction. s) "Sentenced Person" meons o person undergoing o sentence of imprisonment under judgment possed by o criminol Court including the Courts estoblished under the Low for lhe lime being in force in the Controcting stotes. h) "Sentencing Stote" meons the Siote in which the sentence wos imposed on the person who moy be, or hos been, tronsferred. As forThe Republic of Zombio, "Sentencing Stote" is token to meon Zombio; The Republic of Rwondo, "Sentencing Stote" is token to meon Rwondo. "Tronsferring Stote" meons the stoie in which the sentence wos imposed on the person who moy be, or hos been tronsferred. ARTICTE 2 TRANSTER OF CONVICTED PERSONS t. 2. The Porties undertoke to offord eoch other the widest meosure of cooperotion in respect of the tronsfer of sentenced persons in occordonce with the provisions of this Agreement. A person senienced in the tenitory of o Porty moy be tronsferred to the lenitory of the other Porty, in occordonce with the provisions of this Agreement in order to serve the sentence imposed on him/her. Tronsfer moy be requested by ony sentenced person who is o notionol of o Controcting stote or by ony other person who is entitled to oci on his/her beholf in occordonce with the low of the Controcting stotes by moking on opplicotion to the Controcting stote. ARTICTE 3 COND]TIONS FOR TRANSFER l. A sentenced person moy be tronsfened under this Agreement on ihe following conditions: o) if thot person is o notionol, on ordinory or permonent resident of either of the Conkocting Stote; b) if the ludgment is enforceoble; c) if, ot the time of receipt of the request for tronsfer, the sentenced person still hos of leosl six months of the sentence to serve or is undergoing o sentence of life imprisonment; d) no criminol proceedings ore pending ogoinst the sentenced person in the tronsfening stote in which his/her presence is required; e) the sentence to be served in the Receiving Stote does not result from o conviction for on offence under the militory low; f) if the octs or omissions on occount of which the sentence hos been imposed constitute o criminol offence occording lo ihe 6ge3orr2 ?t" Official Gazette n° Special of 27/12/202444 low of the Administering Stote or would constitute o criminol offence if committed on its tenitory; g) if ihe tronsfer is consented 1o by the convicted person unless in view of his/her oge or his/her physicol or mentol condition one of the two Stotes considers it necessory; ond h) lf ihe Seniencing ond Administering Stote ogree lo the tronsfer. 2. ln exceptionol coses, the Sentencing Stote ond the Administering Stote moy ogree io o ironsfer even if the remoining sentence io be served by the sentenced person is less thon thot specified in Article 3 (l )(c). This con be due to the urgent need such os severe illness of the convicted person or ony other reoson prompling on emergency tronsfer. 3. This Agreement sholl be opplicoble to the enforcement of sentences imposed either before or ofter the dote of its entry into force. ARTICTE 4 OBTIGATION TO FURNISH INFORMATION I . A sentenced person to whom this Agreement moy opply sholl be informed by the Sentencing Stote of the substonce of this Agreement. 2. lf the sentenced person hos expressed on interest to the Senlencing Stote in being tronsfened under this Agreement, thot Slote sholl so inform the Administering Slote os soon os procticoble ofter the judgment hos become finol ond enforceoble. 3. The notificotion sholl include the following informotion: (o)The nome, dote ond ploce of birth of the sentenced person; Page4ofl2 \ {fl Official Gazette n° Special of 27/12/202445 (b)The oddress, if ony, of the sentenced person in the Administering Stote; (c)A stotement of focts upon which the sentence wos bosed; (d)A certified copy of the judgmeni ond copy of the relevonf provisions of the low under which the sentence hos been possed ogoinst the sentenced person; (e)The noture, durotion ond dote of commencement of the sentence; (f) A request of the sentenced person to be tronsferred or of on entitled io oct on his/her beholf in occordonce with the low of the Tronsferring Slote; (S) Any other informotion which the Receiving Stote moy specify os required, to enoble it to consider the possibility of tronsfer ond to enoble it to inform the sentenced person of the full consequences of tronsfer for him/her under its low. 4. lf ihe sentenced person hos expressed his/her interesl to the Administering Stote in being tronsferred under this Agreement, the Sentencing Stote sholl, on request, communicote to the Administering Stote the informotion referred to in Article 4 (3). 5. The Adminislering Stote sholl provide informotion on the possible legol effect to the sentenced person, orising from the opplicotion of ony legol provision on the continued enforcement of the sentence in the Administering Stote ofter the tronsfer, in porticulor the consequences orising from the opplicolion of Article 8 (2) of this Agreemeni. 6. The sentenced person sholl be informed in writing of ony oction token by the Seniencing Stote or by the Administering Stote under the preceding porogrophs, os well os of ony decision token by either Sioie on o request for tronsfer. e" Page5or12 Official Gazette n° Special of 27/12/202446 ARTICTE 5 REQUESTS AND REPTIES l. Requests for tronsfer ond the replies thereto sholl be mode in wriiing, ond oddressed by the Centrol Authority (Ministry of Foreign Affoirs) of the Tronsferring Stote through diplomotic chonnels to the Centrol Authority (Ministry of Foreign Affoirs) of the Receiving Stote. Replies sholl be communicoted through lhe some chonnels. 2. Copies of requests, replies ond other correspondences sholl be sent to the respective Correctionol Services. 3. The Receiving Stole sholl promptly inform the Tronsferring Stote of its decision whether or not to ogree to the requested tronsfer.

ARTICLE 6 SUPPORTING DOCUAAENTS I . The Administering Stote, if requesied by the Sentencing Stote, sholl furnish it with: o) A document or stotement indicoting lhot the sentenced person is o notionol of thoi Stote; b) A copy of the relevont low of the Administering Stote which provides ihot the octs or omissions on occount of which the sentence hos been imposed in the Sentencing Stote consiitutes o criminol offence occording to the low of the Administering Stote, or would constiiute o criminol offence if committed on its ierritory. 2. lf o tronsfer is requested, the Sentencing Stote sholl provide the following documents to the Adminisiering Stote, unless either Stote hos olreody indicoted thot ii will noi ogree to the tronsfer. Page6or12 )r' Official Gazette n° Special of 27/12/202447 o) A certified copy of the judgment ond the low on which it is bosed; b) A stotement indicoting how much of the sentence hos olreody been served, including informotion on ony pre-triol detention, remission, ond ony other foctor relevont to the enforcement of the sentence; c) A document, of whotever noiure, contoining the express consent of the sentenced person; d) Where oppropriote, ony medicol or sociol reports on the senienced person, informotion oboui treotment in the Sentencing Stote, ond ony recommendotion for further treotmeni in ihe Administering Stote. 3. Either Stote moy osk to be provided with ony of the documents referred to in Article 6 (l ) or (2) before moking o request for tronsfer or toking o decision on whether or not to ogree to ihe tronsfer. EFFECTS OF TRANSFER FOR TIIE SENTENCING AND ADMINISIERING STATES ARTICTE 7 1 . The octuol toking into chorge of the sentenced person by the outhorities of ihe Administering Stote sholl hove the effect of suspending ihe enforcement of the senience in the Seniencing Stote. 2. The Sentencing Stote moy no longer enforce the sentence if the Administering Stoie considers enforcement of the sentence to hove been completed. 3. The enforcement of the sentence sholl be governed by the low of the Receiving stote (Administering) ond the Stote olone sholl be competent to toke oll oppropriote decisions. b- +, Page 7 of 12 Official Gazette n° Special of 27/12/202448 ARIICTE 8 CONTINUED ENFORCEMENT OF SENIENCE I . The Receiving Stote sholl be bound by the legol noture ond durotion of the sentence os determined by the Sentencing Stole. 2. lf, however, the sentence is by its noture or durolion incompotible wiih the low of the Receiving Stote, or its low so requires, thot Stote moy, by o Court Order, odopt the sonction to the punishment or meosure prescribed by its own low for o similor offence. As to its noture the punishmeni or meosure sholl, os for os possible, correspond with thot imposed by the sentence to be enforced. lt sholl noi oggrovole, by its noture or durotion, lhe sonction imposed by the Sentencing Stote, nor exceeding ihe moximum prescribed by the low of the Receiving Siote. ARTICTE 9 PARDON, AMNESTY, COMMUTATION AND PAROTE Boih the Sentencing Siote ond the Receiving Stote, upon mutuol consultotion moy opply their respeclive lows on pordon, omnesty, or commutotion ond Porole. ARTICTE I5 ENTRY INIO FORCE OF THE AGREEMENT This Agreement sholl enter into force on the first doy of the lost written notificotion, in writing through the Diplomotic chonnel by either porty informing the other porty of the fulfillment of internol formoliiies. ARTICTE I6 AMENDMENT Any omendment to this Agreement shofl be mutuoly ogreed between the Porties ond sholl be effected in writing. Notwithstonding ony terminotion, this ogreement sholl continue to opply io the enforcement of sentences of inmotes who hove been tronsferred under this Agreement before the dote on which such terminotion tokes effect. ARTICTE 'I9 HANDING OVER OF SENTEhICED PERSONS The honding over of the tronsferred sentenced person by ihe Tronsferring Stote to the Receiving Stote sholl occur ot o ploce to be ogreed upon between the Tronsferring ond Receiving Stote. The Receiving Stote sholl be responsible for the tronsport of the inmote from the Tronsferring Stote ond sholl olso be responsible for the custody of the sentenced person outside the territory of the Tronsferring Stote.
