TERRITORIAL INTEGRITYAND PROHIBITION OF HOSTILITIES The Parties agree to the fottowing terms to ensure respect for territoriat integrity and the promotion of peacefuI relations: (i) (ii) Respect for the Democratic Repubtic of the Congo,s Territoriat lntegrity: Disengagement of Forces/Lifting of Defensive Measures by Rwanda: The Parties agree to imptement the Harmonized ptan for the Neutratization of the FDLR and Disengagement of Forces/Lifting of Defensive Measures by Rwanda (CONOPS) of Octo ber 31 , 2024, as provided for in this Agreement. Respect for the Republic of Rwanda's Territoriat lntegrity: Neutralization of the FDLR: The Parties agree to implement the Harmonized ptan for the Neutratization of the FDLR and Disengagement of Forces/Lifting of Defensive Measures by Rwanda (CONOPS) of October 31,2024, as provided for in this Agreement. (iii) PeacefuI Resotution of Disputes: The Parties agree that differences shatt be resotved through processes estabtished by this Agreement and other retevant agreements, rather than through hostitities. (iv) Prohibition of Hostile Acts: The Parties agree to refrain from any acts of aggression. The Parties agree not to engage in, support, or condone any mititary incursions or other acts, whether direct or indirect, that threaten the peace and security, orthat undermine the sovereignty orterritoriat integrity of the other Party. (v) Prohibition of Support for Hostile Acts or Armed Groups: The parties shatt not a[ow any mil.itary or other hostile activities against each other on or from their respective territories or provide support for such activities abroad. To that end, the Parties undertake to work to take any and atl measures necessaryto ensure that such activities shatt not be initiated, ptanned, carried out, directed, orfinanced from their respective territories towards each other. (vi) Territoriat Scope: The prohibition of hostite acts appties without geographicat restriction, regardtess of the [ocation of the armed forces invotved. (vii) Responsibitity with Respect to Non-State Armed Groups: The parties shatt take att possibte measures to ensure that au armed groups within the conftict area cease engaging in hostitities that are inconsistent with the prohibition of hostitities estabtished in this Agreement. (viii) Protection of Civitians and Humanitarian personnet: The parties shatt facititate the free movement of civitians, inctuding humanitarians. DISENGAGEMENT, DISARMAMENT, AND INTEGRATION OF NON-STATEARMED GROUPS To promote an enduring end to conf[ict and to unlock the economic potentiat of the region, the Parties sha[[ supportthe ongoing negotiations between the DRC and the AFC/M23 under the mediation of the State of Qatar in Doha and efforts to disarm and demobitize nonstate armed groups. This shatt inctude the fottowing: (i) (ii) (iii) Ending State Support to Armed Groups: The Parties shatt immediatety and unconditionalty cease any state support to non-state armed groups except as necessary to faciIitate implementation of this Agreement. Disengagement: ln a manner sequenced and coordinated with the disengagement of forces, and as provided for in other forthcoming Agreements, the Parties sha[[ support the disengagement, disarmament, and integration of non-state armed groups as provided for by other Agreements or processes and the Disarmament, Demobitization, Community Reintegration and Stabitization Process (P-DDRCS) and the Joint Security Coordination Mechanism as set out in Section 3 of this Agreement. ConditionaI lntegration into Security Forces: Any potentiat reintegration of combatants into the Armed Forces of the Democratic Repubtic of the Congo (FARDC) and the Congotese National Potice (PNC) shatt be carried out in a rigorous, individuatized, and conditionaI manner, on a case-by-case basis, based on ctear criteria, inctuding morat and physicat fitness, in particutar, respect for and absence of serious viotations of internationa[ humanitarian taw and toyatty to the State and its institutions. 3. JOINT SECURITY COORDINATION MECHANISM The Parties shatl work together and with regionat and international partners to promote stabitity, security, and development in the region, recognizing that peace and prosperity are interdependent. The Parties hereby establish and agree to taunch within 30 days of this Agreement,s entry into force a joint DRC-Rwanda security coordination mechanism that shatt operate sotety in accordance with terms decided between the Parties. The ioint Security Mechanism shatt estabtish shared operating procedures and reporting mechanisms to ensure transparency in the scale and scope of operations. Official Gazette n° Special of 29/08/202536 The Joint security coordination Mechanism shatt be governed by the fottowing principtes and the implementation plan set out in the Annex: (i) (ii) An irreversible and verifiable end to state support for FDLR and associated armed groups, and the total prohibition of atl domestic and foreign material and togistica[, financiat, or other support to the same. A commitment to identify, assess, tocate, and neutratize in accordance with the relevant provisions of the Harmonized Ptan for the Neutratization of the FDLR and Disengagement of Forces/Lifting of Defensive Measures by Rwanda (CONOPS) of October 31 , 2024, as estabtished under the Luanda process. (iii) A commitment to buitd on previous successfuI bitaterat security cooperation arrangements, where operations are targeted, punctuat, and directed at a specific threat. (iv) Protection of civitians and respect for internationat humanitarian taw. 4. REFUGEES, INTERNALLY DISPTACED PERSONS, AND HUMANITARIAN CONSIDERATIONS The Parties shal.t, with the support of uN agencies, retevant humanitarian organizations, and the international community: (i) (ii) (iii) Return of Refugees: Facititate the safe, votuntary, and dignified return of refugees, in coordination with territoriaI and/or customary authorities, of the respective States, to their countries of origin in a manner consistent with their internationa[ legat obtigations and the provisions of the Tripartite Agreements on the Voluntary Repatriation of Congotese and Rwandan Refugees signed in Kigati, on 17 February 2010, between the DRC, Rwanda, and UNHCR, recognizing the positive contribution of this mechanism. lnternatly Disptaced Persons: Recognize that an end to the conftict is necessary to enabte the return of lDps to their ptace of origin, in coordination with territoriaI and customary authorities of the Congotese State. Humanitarian Assistance: Create enabting conditions for the detivery of emergency retief and guarantee free, safe, unimpeded, and unconditionat access by humanitarian agencies to vutnerab[e poputations, consistent with their obtigations under internationat humanitarian taw and with retevant UNSC resotutions. The tocal authorities of the DRC shatt be responsibte for doing so under the supervision of the DRC centraI government. 5. MONUSCO AND OTHER MULTILATERAL SUPPORT Official Gazette n° Special of 29/08/202537 The Parties shatt support and promote the efforts of muttitaterat peacekeeping, inter- positionat, and verification forces and mechanisms: (i) The Parties shatt facititate and support MONUSCO'S capacity to protect civilian poputations and implement atl etements of its mandate, inctuding by respecting MONUSCO's freedom of movement and taking att appropriate measures to ensure the safety and security of UN personnet deployed in eastern DRC. (ii) The Parties commit to advance the imptementation of UNSC resolution 2773 (2025) and other retevant UNSC resolutions. (iii) The Parties recognize MONUSCO, as mandated by UNSC Resolution 2765 (2024), ptays an important role in [oca[ peace and security. 6. REGIONAL ECONOMIC INTEGRATION FRAMEWORK The Parties agree to taunch within three months of this Agreement's entry into force the phased regional economic integration framework to be set out in a separate agreement to be titted the "Regionat Economic lntegration Framework," that buitds on existing efforts, such as the AfCFfA, ICGLR, COMESA, and the EAC. The Parties shat[ use this framework to expand foreign trade and investment derived from regiona[ critical minera[ suppty chains and introduce greater transparency, which sha[[ ensure itticit economic pathways are btocked and both Parties derive greater prosperity-especiatty for the region's poputation- from the region's naturat resources through mutuatty beneficiat partnerships and investment opportunities: (i) (ii) (iii) Bilaterat tntegration: Under the framework, the Parties shatt taunch and/or expand cooperation on shared priorities such as nationat park managemenU hydropower devetopmenU derisking of mineraI suppty chains; joint management of resources in Lake Kivu; and transparent, formatized end-to- end mineral vatue chains (from mine to processed metat) that tink both countries, in partnership, as appropriate, with the U.S. government and U.S. investors. Regionat lntegration: Additionatty, with key partners, the Parties commit to exp[ore options to tink the framework to other internationa[ or regional economic devetopment initiatives, inctuding in infrastructure projects. Economic Oversight: Parties shatt estabtish or utiIize independent economic audit and anti-corruption mechanisms to monitor mineral suppty chains, infrastructure projects, and any future economic agreements betvveen the Parties, as set out in the RegionaI Economic lntegration Framework. IMPLEMENTATION AND DISPUTE RESOLUTION (i) (ii) Dispute Resolution: Any dispute arising from the imptementation of this Agreement shatt be resolved amicably between the parties with the facititation of the Joint Oversight Committee upon request of either party. Where the Parties faiI to resotve a dispute, the parties shatt refer the matter to Joint Oversight Committee for facilitation. ,oint Oversight Committee: For the effective imptementation of this Agreement, the Parties hereby estabtish a Joint Oversight Committee, subject to the foltowing terms: a. The Parties shatt be members of the JOC and shatt invite within three days the fottowing governments and intergovernmentaI organizations to Serve on the Joint Oversight Committee: i. African Union Facititator ii. Qatar iii. United States b. The Joint Oversight Committee shatt have as its mandate the fottowing: i. To receive comptaints from the parties about viotations of this Agreement and resolve disputes arising from the viotations of this Agreement; ii. To take measures, as appropriate, to address viotations; iii. Monitor and examine ctaims of viotations and resotve disputes; iv. The Committee may appoint another representative or estabtish an appropriate ad hoc mechanism to assist in the resotution of any dispute retated to this AgreemenU v. The committee sha[[ endeavor to make decisions and resotve disputes by consensus. The JOC shatt endeavor to estabLish its Terms of Reference at the first meeting of the JOC. c. The first meeting of the Joint Oversight Committee shatt be as soon as practicable but not taterthan 45 days from entry into force. The parties shatI exptore hostingthe first meeting of the Committee in Washington, D.C. (iii) Clarification: This Agreement does not create obtigations on any non- Party states serving on the Joint Oversight Committee. Official Gazette n° Special of 29/08/202539 Annex Agreement on the Operating Procedures of the Joint Security Coordination Mechanism Exponding on the provisions of lhe Peoce Agreement Between the Democrotic Republic of the Congo ond the Republic of Rwanda, the Democratic Republic of the Congo ("DRC") and the Republic of Rwanda ("Rwanda") hereby further agree to the following regarding the operating procedures ofthe Joint Security Coordination Mechanism ("JSCM"): 1. lncorporation and Reference to the CONOPS a. The Parties reaffirm their commitment to the terms and obligations of the Concept of Operations of the Harmonized P[an for the Neutralization of the FDLR and Disengagement of Forces/Lifting of Defensive Measures by Rwanda of October 31, 2024 ("CONOPS"), and hereby incorporate the CONOPS, except as otherwise provided for in this Agreement and its Annexes. b. ln the event of a conflict between this Agreement and the CONOPS, this Agreement and its Annexes shall prevail. 2. Composition of the JSCM a. The JSCM shall be composed of a minimum of three (3) permanent representatives of each Party, to include military, intelligence, and foreign ministry representatives. b. The Parties may agree to invite additional representatives to participate in the JSCM meetings as needed to address specific agenda items or tasks. c. The Parties shall select and announce their permanent representatives immediately upon signing the Agreement. 3. Mission and Capabilities of the JSCM a. The Parties agree that the mission ofthe JSCM is to identify, assess, and locate the FDLR and affiliated groups in order to allow for the neutralization of the FDLR and affiliated groups. b. To further this mission, the Parties agree that the JSCM is empowered to: i. Monitor and assess the implementation of the CONOPS and relevant provisions of this AgreemenU ii. Conduct intelligence and information exchanges between the Parties for purposes of implementing this agreement and the CONOPS; iii. ldentify and define the status and membership of the FDLR and affiliated groups; iv. Establish and monitor the locations of FDLR and affiliated groups; v. Verify all information, data, and activities relating to the FDLR and affiliated groups; vi. Coordinate with international actors in furtherance of its mission; Official Gazette n° Special of 29/08/202540 vii. Assess the nature ofthe threat ofthe FDLR and affiliated groups and determine appropriate actions to neutralize; viii. Coordinate on other steps to neutralize the FDLR and affiliated groups in accordance with the CONOPS. c. The JSCM shall determine the geographic scope of its activities, based on conditions on the ground and with full respect to territorial integrity and sovereignty. d. The Parties also agree to leverage the JSCM to communicate on and ensure compliance of any coordinated movements or repositioning of militaries or other armed groups. 4. Meeting and Coordination Procedures a. The JSCM shall meet on a monthly basis. lmmediately upon signing, the parties shall agree on the date and location of the first meeting. b. The monthly meeting location shall then alternate monthly between venues in the DRC and in Rwanda, and the host country of each meeting shall be responsible for all logistical, administrative, financial, and security arrangements for each meeting. c. The permanent mem bers of the JSCM shall attend each meeting. d. The Parties shall designate one of their permanent members of the JSCM to be the primary point of contact to facilitate coordination for planning meetings and other activities. e. At its first meeting, theJSCM shall adopt a Terms of Reference to further govern its operating procedures. 5. Reporting Requirements a. TheJSCMshall draft and adopt a single, joint report after each month ly meeting b. The JSCM shall submit the report to their respective military, intelligence, and ministries, at the ministerial level. 6. Third Party Participation a. The Parties agree to invite the United States and Qatar, as represented by the relevant Defense attach6 and/or other representative, to attend the JSCM meetings as an observer. b. The JSCM may invite other third-party states or organizations to participate in the JSCM, and the JSCM may jointly solicit additional financial, logistical, and technical support from external third-party states or organizations. 7. Duration of the JSCM a. The JSCM shall continue to operate until the completion of its mandate, as provided for in this Agreement and in accordance with the CONOpS, or as otherwise expressly agreed by the Parties.
