[8th June 2021] Supplement to Official Gazette i SEYCHELLES TOURISM BOARD (REPEAL) BILL, 2021 (Bill No. 22 of 2021) EXPLANATORY STATEMENT The Seychelles Tourism Board Act, Cap 223 (hereinafter the “Act”) established the Seychelles Tourism Board (hereinafter the “STB”) and provided for its status, composition, functions and powers. Under the Act, the STB principally serves as a body for the promotion and marketing of Seychelles as a tourist destination. The affairs of the STB are managed and administered by a Board of Directors consisting of representatives of various public authorities. The President of the Republic, in his address to the Nation on 1st February, 2021 announced the restructuring of Government, statutory and other public bodies including the STB. In order to give effect to the said announcement, it is proposed to repeal the Act. On the repeal of the Act, the STB shall stand dissolved and its function shall be taken over and discharged by the Tourism Department of the Government of Seychelles, all its employees shall become employees of the Government and the assets and liabilities of the Board shall, vest into, and become assets and liabilities of the Government. ENACTED by the President and the National Assembly. Short title 1. This Act may be cited as the Seychelles Tourism Board (Repeal) Bill 2021. iv Supplement to Official Gazette [8th June 2021] Repeal of Cap 223 2. The Seychelles Tourism Board Act, Cap 223 is hereby repealed. Continuation of employment 3. Notwithstanding any law, a person employed with the Seychelles Tourism Board under section 10 of the Act on the date of the repeal of the Act shall continue his or her employment with the Government of Seychelles in its Tourism Department on terms and conditions no less favourable than those subsisting immediately prior to the date of the repeal of the Act until these are amended, varied or repealed in accordance with any scheme of service applicable to employees of the Government. Assets, liabilities and contracts 4. On the repeal of this Act — (a) all movable or immovable property, asset, rights, interest and privileges acquired, accrued by, or vested in, the Seychelles Tourism Board under the repealed Act shall stand transferred to and vested in the Government of Seychelles; (b) all liabilities and obligations incurred by the Seychelles Tourism Board prior to the date of this Act shall be deemed to have been incurred by the Government of Seychelles; (c) any contract or agreement executed by the Seychelles Tourism Board prior to the date of the repeal of the Act shall continue to have effect in accordance with its terms as if it was originally made and entered into by the Government of Seychelles; and (d) any right, privilege obligation or liability acquired or incurred by a person under the repealed Act shall not be affected by the repeal and any legal investigation, legal proceedings or remedy in respect of such right, privilege, obligation or liability may be instituted, continued or enforced by or against the Government of Seychelles. The mention of the particular matters referred to in sections 3 and 4 shall not be held to prejudice or affect the general application of section 31 of the interpretation and general provisions act (cap 103) with regard to the effect of repeal.
