[12th April 2021] Supplement to Official Gazette i NATIONAL INSTITUTE OF SCIENCE, TECHNOLOGY AND INNOVATION (REPEAL) BILL, 2021 (Bill No. 19 of 2021) OBJECTS AND REASONS The National Institute of Science, Technology and Innovation Act, 2014 (the said Act) was enacted to provide for the establishment of the National Institute of Science, Technology and Innovation, to provide for its composition, functions and powers which shall serve as an umbrell body providing leadership and coordination for research in science, technology and innovation and for matter connected therewith or incidental thereto. The affairs of the Institute is managed and administered by a Board of the Institute consisting of representatives of various Ministires and other bodies. 2. The President, in his address to the Nation on the 1st February, 2021, made announcement of restructuring of statutory and other parastatal bodies. 3. In order to give effect to the announcement made by the President, it is proposed to repeal the said Act. On the repeal of the said Act the functions entrusted to the Institute shall be performed by the Minister. It is also proposed that the employees of the Institute shall become the the employees of the Government and shall be adjusted within the Ministry and the assets and liabilities of the Institute shall, vest into, and become the assets and liabilities of the Government. 4. Accordingly, the National Institute of Science, Technology and Innovation Act, 2014 is proposed to be repealed. 5. The Bill seeks to achieve the above objectives. Dated this 9th day of April, 2021. ENACTED by the President and the National Assembly. Short title 1. This Act may be cited as the National Institute of Science, Technology and Innovation (Repeal) Act, 2021. iv Supplement to Official Gazette [12th April 2021] Repeal of Act 6 of 2014 2. The National Institute of Science, Technology and Innovation Act, 2014 (Act 6 of 2014) is hereby repealed and the National Institute of Science, Technology and Innovation established under section 3 of the said shall stand dissolved. (2) On the repeal of the National Institute of Science, Technology and Innovation Act, 2014 — (a) the officers and other employee of that Institute and holding office as such immediately before such dissolution shall be deemed to be the employees of the Government appointed for the same term of appointment on the same terms and conditions of employment until they are amended, varied or repealed in accordance with any scheme of service applicable to the employees of the Government; and (b) the assets and liabilities of that Institute under the repealed Act shall, vest into, and be deemed to be, the assets and liabilities of the Government. (3) The mention of the particular matters referred to in subsection (2) shall not be held to prejudice or affect the general application of section 31 of the Interpretation and General Provisions Act (Cap 103) with regard to the effect of repeal.
