Repeal of S.I.104 of 2021 [12th January 2026] Communications Act 2 REPUBLIC O F SEYCHELLES SUPPLEMENT T O OFFICIAL G AZETTE SI S.I. 1 of 2026 COMMUNICATIONS ACT (Act 3 of 2023) Communications (Licensing) Regulations, 2026 In exercise of the powers conferred by sections 172 of the Communications Act, 2023 read with section 17 of the said Act, the Vice-President, being the Minister for Information Communication Technology makes the following regulations — Citation 1. These regulations may be cited as the Communications (Licensing) Regulations, 2026. Interpretation 2. In these regulations unless the context otherwise requires — “Act” means the Communications Act, 2023 (Act 3 of 2023); “Authority” means the Seychelles Communications Regulatory Authority established by section 5 of the Act; “commercial sound broadcasting services” means sound broadcasting services which provide programmes — (a) received by commonly available equipment; (b) made available free to the general public; and (c) funded by advertising revenue and operated for profit; “commercial television broadcasting services” means television broadcasting services which provide programmes — (a) received by commonly available equipment; (b) made available free to the general public; and (c) funded by advertising revenue and operated for profit; “international submarine cable network service for wholesale of international bandwidth capacity” means a licensed facilities based-operator that owns, deploys, maintains, or operates one or more submarine cable system composed of terminal equipment and submersible equipment connecting Seychelles to one or more international destinations network for the purpose of providing wholesale international capacity to other licensed electronic communications service providers; [12th January 2026] Communications Act 3 REPUBLIC O F SEYCHELLES SUPPLEMENT T O OFFICIAL G AZETTE SI “internet access service provider” means a licence holder who provides subscribers with internet access including fixed internet access through a public land mobile network; “internet resale service provider” means a licence holder who obtains internet access from an internet access service provider, through lease or other commercial arrangement and thereafter resells the internet access to the public; “mobile number portability” means a facility by which a subscriber of a mobile service can retain his or her existing mobile number, without any impairment of quality, reliability or convenience when changing from one operator to another operator, including portability from pre-paid to post-paid numbers or vice-versa; “public access mobile radio” means a Public Mobile Radio system, operated by a private operator to provide a radio service to a closed user group or a number of closed user groups; “private mobile radio” means a self-provided, self-used or closed user group mobile radio communication system; “public mobile communication services” means an electronic communications service provided to the public for the conveyance of voice, data, and messaging using a cellular electronic communications network for public mobile communications which permits end- user mobility; “public radio paging service” means a mobile service restricted to one-way non-voice selective communication; “public telephone services” means an electronic communications service provided to the public for direct, real-time, two-way conveyance of voice communications which is primarily associated with a fixed network termination point; “radio communication jamming equipment” means a radio communication equipment used with the intention to prevent the reception and transmission of radio frequency signals; “Radio Regulations” means the Radio Regulations of the International Telecommunication Union, as revised from time to time; “subscription television broadcasting services” means television broadcasting services provided to the general public on payment of subscription fees; and “Tribunal” means the Tribunal established by section 163 of the Act. [12th January 2026] Communications Act 4 REPUBLIC O F SEYCHELLES SUPPLEMENT T O OFFICIAL G AZETTE SI Application for licence 3.(1) A person who requires a licence for any of the activities specified in section 16 of the Act may make an application to obtain a licence in respect of the different types and specific categories as specified in Schedule II. (2) An application for a licence under subregulation (1) shall be made to the Authority in the form set out in Schedule II. (3) The applicant for a facilities-based operator, services-based operator or broadcasting service licence shall prepare and submit along with the application, its business and technical plan. (4) On receipt of the application under subregulation (1), the Authority may- (a) require the applicant to furnish any documents or additional information that the Authority considers relevant; and (b) cause any installation, apparatus or premises relating to the application to be inspected. (5) Where the applicant fails to submit the documents or additional information as required within the time frame specified by the Authority, the application shall be rejected and the applicant shall be informed of that in writing. (6) The Authority may upon evaluation of the application in accordance with section 25 of the Act — (a) grant the application; or (b) reject the application. (7) Where the Authority rejects an application, the applicant shall be informed of the reasons therefor in writing. (8) An applicant aggrieved by the decision of the Authority refusing to grant a licence, may within 45 days of the decision, file an appeal in accordance with section 14 Act. (9) A licence granted under these regulations shall be valid for the period as specified in Schedule I. (10) Where the Authority decides to grant the licence, it shall inform the applicant of the decision and request the applicant to pay the licence fee at the rates and the manner specified in Regulation 4. Licence fees 4.(1) The licence fees payable for the various activities specified in section 16 of the Act and the duration of each such licence shall be as specified in Schedule I. [12th January 2026] Communications Act 5 REPUBLIC O F SEYCHELLES SUPPLEMENT T O OFFICIAL G AZETTE SI (2) Where the licence is granted for one year, the licence fee for that year shall, subject to subregulations (4) and (5), be paid before the licence is issued. (3) Where the licence is granted for more than one year, the licence fee shall, subject to subregulations (4) and (5), be paid— (a) for the whole period before the issue of the licence; or (b) for the first year before the issue of the licence and for each subsequent year, on or before the 1st January of the subsequent year. (4) The licence fee for any year in which it is issued shall be paid on a pro-rata basis depending on the month in which it is issued. (5) The Authority may, on request, permit the licence holder, on reasonable grounds, to pay the licence fees in such instalments as may be determined by the Authority. (6) If a licence fee is not paid at the time payment becomes due, a surcharge of 10% of the licence fee shall be payable by the licence holder for each month or part thereof during which the licence fee remains unpaid. Effect of licence for broadcasting services 5. Where the Authority grants a licence to a person to provide or establish a broadcasting service, subject to the provisions of the Act, the licence holder also shall be authorised to install and operate radio communication equipment in relation to the broadcasting service for which the licence has been granted. Effect of licence for facilities-based operator licence for provision of electronic telecommunication services 6.Where the Authority grants a facilities-based operator and a service-based operator licence in relation to provision of publicly available electronic communication services, subject to the provisions of the Act, the licence holder also shall be authorised to install and operate radio communication equipment in relation to the licence for which a licence has been granted. Licence for experimental purpose 7. The Authority shall not require a person issued with a licence for experimental purposes under section 21 of the Act, to pay a licence fee. Obligations of a licence holder or a person authorised by the licence holder 8.The licence holder or a person authorised by the licence holder to operate or use radio communication equipment shall be subjected to the following conditions while using radio communications equipment — (a) adjust the radio communication equipment to operate on the radio frequency specified in the licence; [12th January 2026] Communications Act 6 REPUBLIC O F SEYCHELLES SUPPLEMENT T O OFFICIAL G AZETTE SI (b) not intercept a message which the radio communication equipment is not authorised to receive; (c) where there is an accidental reception of a message referred to paragraph (b), the licence holder shall not reproduce, communicate to any person or otherwise use the information received or divulge the existence of such message for any purpose whatsoever except when required to do so in accordance with paragraph (d), the Act or any other written law; (d) note and report instances of interferences with any radio communication equipment; (e) ensure that the radio communication equipment and the licence are at all reasonable times available for inspection by a public officer so authorised under section 146 of the Act; and (f) comply with any further condition stated in the licence. Requirements for specific licences 9.(1) A person, before being issued a licence to operate amateur radio communication equipment, shall satisfy the Authority that such person holds the relevant radio operator’s certificate showing that the operational and technical requirements under Article 25 of the Radio Regulations have been met. (2) A person, before being issued a licence to operate aeronautical radiotelephone radio communication equipment on board aircrafts, shall satisfy the Authority that such person holds the relevant radio operator's certificate issued in accordance with the requirements under Article 37 of the Radio Regulations. (3) A person, before being issued a licence to operate aeronautical radiotelephone radio communication equipment which are not located on aircrafts, shall satisfy the Authority that such person has the operational and technical capabilities to operate the aeronautical radio equipment. (4) A person, before being issued a licence to operate maritime radiotelephone radio communication equipment including land-based equipment, shall satisfy the Authority that such person holds the relevant radio operator’s certificate issued in accordance with the requirements under Article 47 of the Radio Regulations. Renewal of licence 10.(1) A licence holder who wishes to renew a licence shall, not later than 3 months prior to the expiry of the licence, apply to the Authority in the form set out in Schedule IV. (2) The Authority may evaluate the application and if satisfied with the eligibility of the applicant for the licence, renew the licence. [12th January 2026] Communications Act 7 REPUBLIC O F SEYCHELLES SUPPLEMENT T O OFFICIAL G AZETTE SI Modification of terms, conditions or restrictions 11.(1) A licence holder may apply to the Authority in the form set out in Schedule III for the modification or revocation of a term, condition or restriction of a licence. (2) The Authority may, after evaluating the reasons stated in the application for the modification, either grant or reject the application and inform the licence holder accordingly. Transfer of licence 12.(1) A licensee who intends to transfer a licence to another person may make an application to the Authority in the Form set out in Schedule V, jointly with the person to whom the licence is proposed to be transferred. (2) The Authortiy may take decision on an application made to it under sub regulation (1) as if it is an application for a new licence. Non-renewal of licence 13. A licence holder who does not intend to renew a licence shall inform the Authority in writing of his or her intention regarding the radio communication equipment used under the licence. Appeals 14. An applicant aggrieved by the decision of the Authority under these regulations may, within 45 days of the decision, make an appeal to the Tribunal in accordance with section 14 of the Act. Validation 15. Any licence issued by the Authority for any of the activities specified in section 16 of the Act before coming into operation of these regulations and remaining in force shall be deemed to have been issued under these regulations and shall continue to be in force, so far as it is not inconsistent with the provisions of the Act, until suspended or revoked under the Act or until the date of the expiry, whichever occurs first. Repeal of S.I. 104 of 2021 16. The Licences (Broadcasting and Telecommunication) Regulations, 2021 (S.I.104 of 2021) is repealed without prejudice to anything duly done thereunder. Electronic Communications (a) International Submarine Cable The annual licence 15 years Network Service for wholesale of fee shall be International Bandwidth Capacity SCR500,000 or 2% of the annual gross receipts of the service, whichever amount is greater. (b) Internet Access Service SCR40,000 per 15 years year or 2% of the annual gross receipts of the service, whichever amount is greater. (c) Internet Resale Service SCR250 per year 5 years or SCR1,250 for five years. (d) Public Access Mobile Radio SCR5,000 per year 10 years (PAMR) Service or 5% of the annual gross receipt of the service, whichever amount is greater. (e) Public Telephone Service 10% of the annual 15 years gross receipts of the service. (f) Public Mobile Communications 10% of the annual 15 years Service gross receipts. (f) Public Radio Paging Service SCR2,000 per year 1 year or 1% of the annual gross receipts, whichever amount is greater.
