Offences and proceedings AN ORDINANCE to make provision for the payment of fees in St Helena pursuant to the British Nationality Act, 1981, to impose fees for the issue of British passports, and for related matters. 1 Under section 10 of the Revised Edition of the Laws Ordinance, 1999 this text is authoritative and is the sole authentic edition in respect of the law contained in it as at 1 November 2017. 2 Short title and commencement 1. (1) This Ordinance may be cited as the British Nationality and Passports (Fees and Offences) Ordinance, 2017. (2) This Ordinance comes into force on the date when the Revised Edition of the Laws of St Helena, 2017 comes into force. Fees relating to British nationality 2. (1) The Governor in Council may by order specify the fees which, subject to this section, are payable in respect of the several matters and things specified in the order, being fees payable in St Helena on registrations, grants, declarations and other matters pursuant to the British Nationality Act 1981(UK) (“the Act”). (2) The fees to which subsection (1) relates are payable on the submission of the relevant application or declaration as appropriate. Fees relating to passports 3. (1) The fees set out in the Schedule are payable in respect of the matters to which they relate. (2) The Governor in Council may from time to time by order add to, alter, vary or replace the fees set out in the Schedule. Offences and proceedings 4. (1) It is an offence in St Helena for a person, for the purpose of procuring anything to be done or not done under the Act— (a) to make any statement which the person knows to be false in a material particular; or (b) recklessly to make any statement which is false in a material particular. Penalty: A fine of £250 or imprisonment for 3 months, or both. (2) A person who without reasonable excuse fails to comply with any requirement imposed on the person by regulations made under the Act with respect to the delivery up of certificates of naturalisation commits an offence in St Helena. Penalty: A fine of £250. (3) In the case of an offence under subsection (1), any information relating to the offence may be tried by the Magistrates’ Court if it is laid – (a) within 6 months after the commission of the offence; or (b) within 3 years after the commission of the offence and not more than 2 months after the date certified by the Attorney General to be the date on which evidence sufficient to justify proceedings came to the notice of a member of the police service (4) For the purpose of the trial of a person for an offence under subsection (1) or 3 (2), the offence is deemed to have been committed either at the place at which it actually was committed or at any place where the person is. The fees payable in St Helena on registrations, grants, declarations and other matters pursuant to the British Nationality Act, 1981 are those appearing in the Schedule to this Order.
