DAAR WORD BEPAAL deur die Parlement van die Republiek van Suid-Afrika, soos volg:— Wysiging van artikel 1 van Wet 41 van 2008 1. (1) Artikel 1 van die Spesiale Begrotingswet op Eskom Ondergeskiktelening (Finansiële Jare 2008/09-2010/11), 2008 (hierna die Hoofwet genoem), word hierby gewysig— (a) deur subartikel (2) deur die volgende subartikel te vervang: ‘‘(2) Die geld in subartikel (1) beoog moet in elke ﬁnansiële jaar aan Eskom Beherend MSB Beperk (hierna Eskom genoem), oorgedra word ter ondersteuning van sy investering om elektrisiteitopwekkingsvermoë te vermeerder en elektrisiteitsvoorsiening te verseker, onderhewig aan [’n leningsooreenkoms wat tussen die Minister en Minister van Finansies en Eskom aangegaan word] die uitreiking van gewone aandele deur Eskom aan die Staat ter waarde van R60 miljard.’’; en (b) deur subartikel (3) te skrap. (2) Die leningsooreenkoms tussen die Minister van Finansies en Eskom aangegaan ingevolge artikel 1(2) van die Hoofwet, voor die wysiging daarvan deur hierdie Wet, sal verval en nietig wees met ingang van die datum van die uitreiking van aandele bedoel in artikel 1(2) van die Hoofwet, soos deur hierdie Wet gewysig.
