Statute overview
About this statute
This section replaces section 66 of the Constitution with a section titled “Rights and duties of President, Executive Deputy Presidents, Ministers and Deputy Ministers in Houses.” The President, an Executive Deputy President, a Minister, and a Deputy Minister may sit and speak in any House and at a joint sitting, but they may not vote where they are not members. This amendment changes how the Cabinet is made up and gives qualifying parties a right to Cabinet portfolios, while setting out the President’s powers to assign, appoint, fill vacancies, and end certain ministerial appointments. The President may remove a Minister from office if the Minister fails to comply with a Presidential requirement under subsection (3). The referenced section 88 provisions apply, with necessary changes, to Deputy Ministers.
