Government Employees Pension Fund Condonation of Interrupted Service Act

1. In this Act, unless the c o n t e xt indicates o t h e r w i s e, a word or expression to which a meaning has been assigned in the G o v e r n m e nt E m p l o y e es P e n s i on Fund Law, 1996 (Proclamation N o. 21 of 1996), has the m e a n i ng assigned to it in that Act. C o n d o n a t i on of i n t e r r u p t ed s e r v i ce 2. (1) Despite anything to the contrary in any other law, the service of A d v o c a te A b r a h am G e r h a r d us K e l l e r m a n n, as rendered to the former D e p a r t m e nt of Justice for the period 1 January 1980 until 31 January 1991 and for the period 1 S e p t e m b er 1991 until 6 S e p t e m b er 2 0 0 0, m u st be regarded as c o n t i n u o us service of 20 years for the purposes of calculating the pension benefits d ue to his surviving spouse, C h l oe J e m i ma K e l l e r m a n n. under the G o v e r n m e nt E m p l o y e es Pension F u nd L a w, 1996 (Proclamation N o. 21 of 1996), and the R u l es issued under that Law. (2) T he benefits to which his s p o u se is entitled to in t e r ms of subsection (1) is p a y a b le from the date of his death on 6 S e p t e m b er 2 0 0 0. and is payable by the G o v e r n m e nt E m p l o y e es Pension Fund. (3) T he benefits payable u n d er subsection (2) must be paid to his spouse within 60 d a ys of the c o m m e n c e m e nt of this Act. C o m p e n s a t i on of F u nd 3. (1) (a) T he e m p l o y er must pay a single one-off a m o u nt calculated by an actuary appointed by the Fund as c o m p e n s a t i on in full for the liability incurred by the F u nd in t e r ms of section 2. (b) In calculating the liability c o n t e m p l a t ed in subsection (1), the actuary must take into a c c o u n t— (i) (ii) any c o n t r i b u t i o ns paid to the Fund or a previous fund, by the e m p l o y er or A d v o c a te A b r a h am G e r h a r d us K e l l e r m a n n, not paid to A d v o c a te A b r a h am G e r h a r d us K e l l e r m a nn on termination of his services on 31 January 1 9 9 1; and interest on the contributions c o n t e m p l a t ed in s u b p a r a g r a ph (i).
