About this statute

Anyone applying this Act must interpret it to give effect to its purposes and to the objects of the South African Qualifications Authority Act. The National Skills Authority is established. A SETA must be made up only of specified member groups, and the Minister has approval and intervention powers over a SETA’s constitution, chambers, finances, and administration. A SETA may establish a learnership only if specified learning and registration conditions are met. The lawfulness of dismissal is governed by this Act, the Basic Conditions of Employment Act, and the common law.
