1. (1) A juristic person to be known as State Information Technology Agency (Pty) Ltd is established. (2) The Agency will be incorporated as a private company in accordance with sec- tion 3. Incorporation of Agency 5 3, (1) The Minister must effect the incorporation of the Agency as a private company in terms of the Companies Act. (1) The provisions of the Companies Act will apply to the Agency, except where 35 otherwise stated in this Act. (2) The Companies Act will not apply to the Agency where the Minister of Trade and Industry has issued a declaration under section 5 of this Act.
