Statute overview

About this statute

This provision introduces a law about sterilisation and says it deals with when sterilisation may be performed, including for people who cannot consent or are mentally disabled. This section defines key terms and sets when sterilisation may or may not be performed, including consent rules, age limits, and special procedures for people who cannot consent. This provision defines “consent” for the Act and allows the Executive Council member to designate and, if conditions are not met, withdraw sterilisation facilities in writing. The person in charge of a section 5 facility, or a designated person, must be notified of each sterilisation and must keep a record of each one. The member of the Executive Council may delegate any power under the Act in writing, on conditions set by that member. The Minister may make regulations, after consulting the members of the Executive Council, on matters needed or helpful to achieve the Act’s objects.
