The Wildlife Conservation (Non-Consumptive Wildlife Utilization) (Amendment) Regulations, 2024

1. These Regulations may be cited as the Wildlife Conservation (Non-Consumptive Wildlife Utilization) (Amendment) Regulations, 2024 and shall be read as one with the Wildlife Conservation (Non-Consumptive Wildlife Utilization) Regulations, 2016 hereinafter referred to as the “principal Regulations”.

2. The principal Regulations are amended by deleting regulation 2 and substituting for it the following: “Applicati on

3. The principal Regulations are amended in regulation 3 by adding in their appropriate alphabetical order the following new definitions: ““annual land rent” means a payment for the use or occupation of an investment site paid annually to the Authority by an investor; “Authority” means Tanzania Wildlife Management Authority established 1 Wildlife Conservation (Non-Consumptive Wildlife Utilization) (Amendment) GN. No. 135 of 2014 the Wildlife Conservation under (The Tanzania Wildlife Management Authority) Establishment Order 2014; “concession fee” means a fee paid per person per night spent at an accommodation facility within a conservation area and other areas with wildlife and managed by the Authority; controlled “conservation area” means a game reserve, game area, wildlife management area, wildlife corridor, migratory route, buffer zone and dispersal area; and “Conservation Commissioner” has the meaning ascribed to it under the Act;”. 4. The principal Regulations are amended in regulation 6- (a) in subregulation (6), by- (i) (ii) (iii) deleting the word “and” appearing at the end of paragraph (a); deleting the fullstop appearing at the end paragraph (b) and substituting for it a semicolon and the word “and”; and adding immediately after paragraph (b) the following: “(c) protect the surrounding environment against pollution which may endanger the ecological the area.”;and integrity of (b) in subregulation (7) by deleting the words “concession fee” and substituting for them the words “land rent fee”. 11.-(1) Non consumptive use activities may be conducted in a hunting block allocated to a hunting company in accordance with the provisions of these Regulations. (2) Notwithstanding subregulation (1), a hunting company to which the hunting block is allocated may enter into an agreement with another company for the purposes of conducting non consumptive use activities, Provided that the hunting company shall obtain a prior written consent from the Director.”. Amendment of regulation 12

7. The principal Regulations are amended in regulation 12 by- (a) deleting the words “seventy thousand United States Dollars” appearing in subregulation (2) and substituting for them the words “twenty percent of the Chief Government valuer’s established market value”;and (b) adding immediately after subregulation (2) the following: GN. 8. The principal Regulations are amended by deleting regulation 15 and substituting for it the following: “Entry and exit from conservatio n areas

15. A person shall not enter into or exit from a conservation area or other areas containing wildlife resource except through entry or exit points designated as such by the Authority.”. Amendment of regulation 16

9. The principal Regulations are amended in regulation 16 by- (a) deleting subregulation (2), and substituting for it the following: “(2) Notwithstanding the generality of subregulation (1), fees in respect of- (a) game reserves shall be in the the manner prescribed under Third these Schedule Regulations; and to (b) game controlled areas, Wildlife Management Areas, wildlife corridors, migratory routes, wildlife dispersal areas, buffer zones, open wildlife ranches, public captive facilities and other areas with wildlife resources shall be in the manner prescribed under the Fourth Schedule to these Regulations.”; (b) deleting subregulation (4) and substituting for it the following: “(4) in Fees of accommodation facilities managed by the Authority shall be as prescribed in the Fifth Schedule to these Regulations.”; and respect (c) deleting subregulations (5), (6), (7) and (8). 19.-(1) Revenue accrued from non- consumptive wildlife utilization activities shall be distributed as follows: (a) in Game Controlled Areas and by areas managed other Authority: (i) (ii) (iii) 70% shall be directed to the Authority; 15% shall be directed to the District Council of the respective area; and 15% shall be directed to the Village Council surrounding the Game respective Controlled Area.; (b) in other areas with wildlife resources: (i) (ii) (iii) 60% shall be directed to the Authority; not less 15% shall be directed to the District Council of the respective area; and 25% shall be directed to the Village Council of the respective area. (2) Subject to regulation 19 (1) the revenue distributed to District and Village Council shall be directed : (a) 60% to development projects; and (b) 40% to conservation activities. (3) The District and Village council shall, for the purpose of implementing the distribution of the revenue accrued under subregulation (1), identify and prepare development projects to be implemented. 5 Wildlife Conservation (Non-Consumptive Wildlife Utilization) (Amendment) GN. NO.875 (Contd.) (4) The projects prepared by the District and Village council shall be approved by the District Executive Director. (5) The District Executive Director shall be responsible for implementation and monitoring of the development projects referred to in subregulation (3). (6) The District Executive Director shall prepare and submit to the Conservation Commissioner an annual implementation report the development projects implemented from the revenue accrued from non-consumptive wildlife utilization distributed in the respective District and Village Council. for (7) The revenue distributed in District and Village Council shall be audited in accordance with the auditing procedures of Local Authority Councils.”.
