The Social Security (Use of Members Benefit Entitlements as Collateral for Home Mortgage) (Amendment) Regulations, 2025

1. These Regulations may be cited as the Social Security (Use of Members Benefit Entitlements as Collateral (Amendment) Regulations, 2025 and shall be read as one with the Social Security (Use of Members Benefit Entitlements as Collateral for Home Mortgage) Regulations, 2025 hereinafter referred to as the “principal Regulations”. The principal Regulations are amended in regulation 13 by adding immediately after subregulation (2) the following: “(3) The dispute under this regulation shall be submitted in writing to the mediator within thirty days from the date when the dispute arises stating brief facts of the disputes. (4) The mediator shall, within seven days after receipt of the dispute, notify the parties about the place, date and time of conducting mediation which shall not be later than twenty-one days from the date of receipt of the dispute. (5) The mediation may be conducted in one or more sessions but in either case mediation period shall not exceed a period of thirty days from the date of the first session of mediation. (7) The mediator shall act independently and impartially and facilitate communication between or among the parties to assist them in reaching a mutually acceptable resolution. (8) Where a consensus is reached regarding the dispute, the parties shall execute a settlement agreement.
