The Social Security Schemes (Benefits)(Amendment) Regulations, 2022

1. These Regulations may be cited as the Social Security Schemes (Benefits)(Amendment) Regulations, 2022 and shall be read as one with the Social Security Schemes (Benefits) Regulations, 2018 hereinafter referred to as the “principal Regulations” and shall come into operation on the 1st day of July, 2022. Amendment of regulation 3

2. The principal Regulations are amended in regulation 3 by inserting in its appropriate alphabetical order the following new definition: ““Division” means the Division responsible for social security within the Ministry responsible for social security matters.” Deletion and substitution of regulation 7

3. The principal Regulations are amended by deleting regulation 7 and substituting for it the following: “Pension benefit factors

7. The social security benefits factors to be used in the formula shall be as follows: (a) annual accrual factor shall be

12.5; (c) commutation rate shall be 33 per-centum of the annual full amount of the pension; and (d) monthly pension of 67 per- centum of full pension.”

4. The principal Regulations are amended by deleting regulation 8 and substituting for it the following: “Pension formula

8.-(1) Pension benefits under the be shall laws respective schemes calculated as follows: (a) full pension- 1/580 x number of months served x annual pensionable emoluments; (b) commuted pension- (1/580 x number of months served x annual pensionable emoluments) x 12.5 x 33 per- centum; (c) monthly pension- (1/580 x number of months served x annual pensionable emoluments) x 67 per-centum x 1/12. (2) Monthly pension of a is pensioner whose pension benefit calculated under this regulation shall be indexed in a manner prescribed under regulation 11.”

5. The principal Regulations are amended in regulation 12(1), by- (a) deleting the words “termination of service” appearing in the opening phrase and substituting for them the words “cessation of employment”; and (d) immediately after paragraph the (b) adding Deletion and substitution of regulation 8 Amendment of regulation 12 following: “(e) termination of employment for any reason other than resignation,” Addition of regulation 21A

6. The principal Regulations are amended by adding immediately after regulation 21 the following: “Payment of special 21A-(1) Save prescribed in these Regulations- as otherwise 2 Social Security Schemes (Benefits) (Amendment) GN NO. 357 (Contd) lumpsum (a) a member who is employed to perform a specific task, upon completion of such task; joins (b) a member who the Scheme after the age of forty five years, upon cessation of his employment; foreigner employed in Tanzania who mainland leaves upon the country cessation of his employment; or (c) a (d) a member who, of upon cessation employment, emigrates from and has no intention of returning to the United Republic, and the country to which he emigrates has no bilateral agreement with the United Republic that allows portability of benefits, may be entitled for the payment of special lumpsum. (2) A member shall not be paid a special regulation unless such this lumpsum under member has- (a) applied to the Director General of the respective Scheme; (b) submitted to the Director General of the respective Scheme a letter of cessation or completion of specific task duly signed by the employer; and employment of (c) submitted to the Director General a declaration in a form prescribed by the respective Scheme that he has not secured another employment. (3) For the purpose of this regulation, the tasks seasonal term “specific task” means performed in the following areas- (a) mining sector; (b) construction sector; (c) manufacturing sector; 3 Social Security Schemes (Benefits) (Amendment) GN NO. 357 (Contd) (d) agricultural sector; or (e) any other sector or area as may be specified by the Division.” Dodoma, 18th May, 2022 JOYCE L.
