The Standards (Recall Seizure and Disposal of Product (Amendment) Regulations 2022

1. These Regulations may be cited as the Standards (Recall, Seizure and Disposal of Product) (Amendment) Regulations, 2022 and shall be read as one with the Standards (Recall, Seizure and Disposal of Product) Regulations, 2021 hereinafter referred to as the “principal Regulations”. Deletion and substitution of enabling provision

2. The principal Regulations are amended by deleting the enabling provision and substituting for it the following: “(Made under section 36(1) and (3)(g))” Amendment of regulation 4 4-

The principal Regulations are amended in regulation (a) in subregulation (1), by inserting the words “from the supplier, manufacturer, consumer” between the words “information” and “or”; and (b) in sub regulation (3), by adding immediately after paragraph (a) the following: (b) disclose to the public, or to a class of person specified in the order, in the manner and within the period so specified- (i) (ii) (iii) the nature of any defect in any commodity identified in the order; the circumstances in which the use of any of such commodity is dangerous; procedures for disposal of such commodity; or 1 Standards (Recall, Seizure and Disposal of Product) (Amendment) GN.No. 416 (Contd) (c) notify the public or a class of persons specified in the order, in the manner and within the period specified in the order, that the supplier undertakes to - (i) (ii) (iii) take corrective and preventive action or repair the defective commodity; replace the defective commodity; or refund to a person to whom the commodity was supplied the price of the commodity, whether by the supplier or by another person, within the period specified in the order.
