Part I: Preliminary Section Short title and commencement Section This Act may be cited as the Uganda Cancer Institute Act, 2016. This Act shall come into force on a day appointed by the Minister , by statutory instrument.

Preliminary - Interpretation
Part I: Preliminary Section Interpretation Section In this Act, unless the context otherwise requires— " Board " means the Board of Directors of the Uganda Cancer Institute established under section 7 ; " Currency point " has the meaning assigned to it in Schedule 1; " Executive Director " means the Executive Director of the Institute appointed under section 17 ; " highly specialised medicines " include chemotherapeutic agents and devices related to cancer treatment; " Institute " means the Uganda Cancer Institute specified in section 4 of this Act; " Minister " means the Minister responsible for health.

Preliminary - Purpose of Act
Part I: Preliminary Section Purpose of Act Section The purpose of this Act is to— establish an autonomous cancer institute with the mandate to undertake and coordinate the management of cancer and cancer related diseases in Uganda; establish a modern cancer institute with international standards to address the challenges of treating cancer and cancer related diseases; reduce the referral of cancer patients abroad; ensure timely access to highly specialised cancer medication; and increase the capacity of the Ugandan oncologists to handle specialised cancer conditions and to empower an institute that will oversee the management of other health units which handle cancer related conditions.

Part III: General provisions Section Vesting of control and management of health units Section The Minister may by Statutory Instrument vest in the Institute the control and management of a health unit or a section of a health unit which is involved in the performance of function similar to those of the Institute .

General provisions - Protection from liability
Part III: General provisions Section Protection from liability Section A member of the Board , a member of staff of the Institute or any person acting on behalf of and on the authority of the Institute is not liable in his or her person capacity in any civil or criminal proceedings in respect of any act or omission done or omitted to be done in good faith in the performance of functions under this Act.

General provisions - Validity of acts of the Board
Part III: General provisions Section Validity of acts of the Board Section An act or decision of the Board shall not be invalid by reason of a vacancy in the membership of the Board where there is a defect in the appointment of a member or where a member was at the time in question disqualified or disentitled to act as a member of the Board .

Part III: General provisions Section Consultants Section The Institute may, in the performance of its functions under this Act, engage the services of or work in consultation with professional or technical experts or consultants, whether in the public service or not, to enhance the performance of the Institute .

General provisions - Regulations
Part III: General provisions Section Regulations Section Without prejudice to the generality of subsection (1), the Minister may make regulations— The Minister on the recommendation of the Institute may make regulations for the better carrying out of the functions of the Institute . providing for the custody and application of the seal of the Institute ; providing for the proper management, control and administration of the Institute ; regulating the disciplining of the staff of the Institute and providing for the disciplinary proceeding for the staff of the Institute ; prescribing the conditions and terms, including the fees and charges, upon which any services offered by the Institute within the functions of the Institute are to be offered to the patients of the Institute ; providing for any matter which in the opinion of the Institute is necessary for the efficient performance of the functions of the Institute ; and prescribing for any matter or thing which is required or permitted to be prescribed under this Act. Transitional and savings - Transfer of assets and liabilities
Part IV: Transitional and savings Section Transfer of assets and liabilities Section All property vested in the Uganda Cancer Institute immediately before the commencement of this Act, shall, on the commencement of this Act, remain vested in the Uganda Cancer Institute subject to all interests, liabilities, charges, obligations and trusts affecting the property.

Transitional and savings - Pending proceedings and claims
Part IV: Transitional and savings Section Pending proceedings and claims Section All legal proceedings and claims pending in respect of actions and activities to which the relevant laws apply shall be continued or enforced by or against the Institute in the same manner as they would have been continued or enforced by or against the Government had this Act not been enacted.
Section 36
Transitional and savings - Employees of the Uganda Cancer Institute
Part IV: Transitional and savings Section Employees of the Uganda Cancer Institute Section On the commencement of this Act— all persons who, immediately before the commencement of this Act were employed in the Institute shall continue to be so employed under this Act; and the terms and conditions, including the salary, on which a person referred to in paragraph (a) is employed after the commencement of this Act, shall be no less favorable than those that applied to that person’s office immediately before the commencement of this Act. Subject to subsection (1) (b), the terms and conditions of employment referred to in subsection (1) may be varied after the commencement of this Act. Nothing in this Act affects the pension rights under the Pension Act of any person referred to in subsection (1).
