Minnesota Statutes § 3.083 - RETENTION OF SENIORITY, FRINGE BENEFITS AND TENURE

§ Subdivision 1.Entitlement to benefits and position. A member of the legislature who is continued in or restored to a position in accordance with section 3.082: (1) shall be continued or restored without loss of seniority; (2) may participate in insurance or other benefits offered by the employer under its established rules and practices; and (3) shall not be discharged without good cause from the position for three years after the continuation or restoration except in the reverse order of seniority with the employer within the field of the legislator's training and experience. § Subd. 2.No employer discrimination. No employer or employee organization may discharge or otherwise discriminate against an employee or member who is or was a member of the legislature in retribution for statements made or beliefs held by the employee or member in the capacity as a member of the legislature. For purposes of this subdivision, "employee organization" means a union or organization of employees which exists, in whole or in part, for collective bargaining or dealing with employers concerning grievances or term or conditions of employment.
