RSA 151:30. Equitable and Other Relief.

I. Any person aggrieved by a facility's failure to abide by the provisions of this subdivision may seek equitable relief from the superior court, which shall have original jurisdiction over all proceedings under this subdivision. II. Damages shall be assessed in a proceeding against a facility which violates this subdivision and the facility shall be liable for the sum of $50 for each violation per day or part of a day or for all damages proximately caused by the violations, whichever is greater. If a facility is found to be in contempt of a court order issued under this section the facility shall be liable for the plaintiff's reasonable attorney fees and costs. III. Violations of this subdivision may be raised in any other proceedings for damages and by way of counterclaim, setoff, or recoupment. Source: Source. 1981, 453:1. 1983, 274:10, eff. Aug. 17, 1983.
