Statute overview

About this statute

This is the preamble to a Kosovo law on expanded powers to confiscate property obtained through a criminal offense. This law sets expanded powers to confiscate property acquired by people who have committed a criminal offense, when the procedures in the Criminal Procedure Code are not sufficient. This provision says the law applies to property acquired by people who have committed an offence under the Penal Code of Kosovo. This article defines several terms used in the law, including the agency, the ministry, confiscation, extended confiscation powers, property subject to those powers, and a bona fide buyer. The state prosecutor may ask the court to apply extended confiscation only if the prosecutor can prove the conditions in Articles 6, 7, or 8, and the request must describe each asset clearly enough to identify it.
