Statute overview

About this statute

This provision gives the Act its short title: the High Court Act. This section defines words and phrases used in the Act, including Court, Judge, plaintiff, defendant, action, suit, and several registry and session terms. This section lists the Court’s divisions and gives the Chief Justice powers to prescribe additional specialised courts, set jurisdiction categories, and issue practice directions. Judges have equal power and jurisdiction, and any Judge may exercise some or all of the Court’s jurisdiction, unless another statute says otherwise. A civil trial may be held with assessors if the presiding Judge decides to do so, and there must be two or more assessors as the Judge thinks fit.
