Animal Health (Import and Export of Animal, Animal Product, Animal By-Product or Article) Regulations, 2020

1. These Regulations may be cited as the Animal Health (Import and Export of Animal, Animal Product, Animal By-Product or Article) Regulations, 2020. Title

2. In these Regulations, unless the context otherwise Interpretation requires— “ establishment ” means a public, quasi government or private entity which— (a) owns or rears animals; (b) slaughters animals; (c) is involved in the processing of animal products; (d) sells, stores, distributes, import or export animals, animal products, biological materials, animal feed and ingredients, and equipment; or (e) involved in activities that have an effect on the animal health, production and welfare; “ holder of a permit ” means a person to whom a permit has been issued under these Regulations; and “ permit ” means a permit issued under theseRegulations to import or export an animal, animal product, animal by- product or article. 3. (1) A person who intends to import or export an animal, animal product, animal by-product or article shall apply for a permit to the Director in Form I set out in the First Schedule on payment of the fee set out in the Animal (Veterinary Services Fees) Regulations, 2018. (2) The Director shall, in considering an application under this regulation take into account (a) reasons for the importation or exportation; (b) animal health and public health risks posed by the importation or exportation; (c) World Health Organisation Animal Health Standards, Sanitary and Phyto sanitary Agreements, Technical Barriers to Trade Agreements and other relevant local and international trade agreements, and any other relevant written law. (3) The Director shall, within ten days of receipt of an application under this regulation, reject the application in accordance with regulation 5 or issue the permit to the applicant in accordance with regulation 6. (4) Despite subregulation (3), the Director may take longer than ten days to issue an import or export permit if— (a) additional information is required; or (b) the import or export is for live animals which require longer processing times.

4. The Director may, on receipt of an application under regulation 3, request an applicant to submit additional information in relation to an application in Form II set out in the First Schedule.

5. (1) The Director shall reject an application for a permit— (a) if the applicant submits false information in respect of the application for a permit; or (b) in the public interest, if the issuance of the permit shall negatively affect animal health, human health and the environment. (2) The Director shall, where an application is rejected, inform the applicant of the decision in Form III set out in the First Schedule. 6. The Director shall, where the applicant meets the requirements under these Regulations, issue the applicant with an import or export permit in Form IV set out in the First Schedule. 13th November, 2020 Statutory Instruments 549

7. (1) A holder of a permit who intends to amend a permit, shall apply to the Director to amend the permit in Form V set out in the First schedule on payment of the fee set out in the Second Schedule. Amendment of permit (2) The Director may amend a permit where— (a) the name of the business changes; (b) the port of entry or exit in respect of which the permit was issued changes; or (c) there is a change of address of the holder of a permit. (3) Where an amendment of a permit has been approved, the holder of a permit shall surrender the original permit to the Director. (4) An amended permit is valid for the remainder of the validity period of the original permit.

8. A holder of a permit shall, where the import or export permit is lost, damaged or defaced, apply to the Director for a duplicate permit in Form VI set out in the First Schedule on payment of the fee set out in Second Schedule. Application for duplicate permit

9. (1) The Director shall suspend a permit if the holder of a permit contravenes the terms and conditions of a permit, these Regulations, the Act or any other written law. Suspension of permit (2) The Director shall, before suspending a permit, give notice in Form VII set out in the First Schedule to the holder of a permit of the Director’s intention to suspend the permit and request the holder of a permit to show cause, within a specified period, why the permit should not be suspended. (3) The Director shall not suspend a permit under this regulation if the holder of a permit takes remedial measures to the satisfaction of the Director within the period specified under subregulation (2). (4) The Director shall, in making a final determination on the suspension of a permit, consider the submissions made by a holder of a permit under subregulation (2). (5) The Director shall suspend a permit in Form VIII set out in the First Schedule, if the holder of the permit fails to take remedial measures within the period specified in the notice issued under subregulation (2). 550 Statutory Instruments 13th November, 2020 Revocation of permit (6) The Director may during the period of the suspension of the permit order for the quarantine of an item affected by the suspension at the cost of the holder of a permit.

10. (1) The Director shall revoke a permit if— (a) the holder of a permit contravenes the terms and conditions of a permit, these Regulations, the provisions of the Act or any other relevant written law; (b) the holder of a permit fails to take corrective measures following the suspension of the permit within the specified period under regulation 9; (c) the holder of a permit obtained the permit by fraud or negligently submitted false information; (d) it has come to the knowledge of the Director that the items in respect of which the permit was issued are not suitable or pose a risk to animal health, human health, or the environment; or (e) in public interest the sanitary and phytosanitary conditions on which it was issued in the importing or exporting country have changed and negatively affect, animal health, human health or the environment; or (f) the holder of a permit voluntarily requests for the permit to be cancelled. (2) The Director shall, before revoking a permit in accordance with subregulation (1) (a),(b),(c),(d) and (e), give notice in Form VII set out in the First Schedule to the holder of the permit of the intention to revoke the permit and request the permit holder to show cause, within a specified period, why the permit should not be revoked. (3) The Director shall not revoke a permit under this regulation if the holder of a permit takes remedial measures to the satisfaction of the Director within the period specified under subregulation (2). (4) The Director shall, in making a final determination on the revocation of a permit, consider the submissions made by a holder of a permit under subregulation (2). (5) The Director shall revoke a permit in Form VIII set out the First Schedule, if the holder of a permit fails to take remedial measures within the period specified in the notice under subregulation (2). 13th November, 2020 Statutory Instruments 551 (6) Where a permit is revoked, the holder of a permit shall immediately surrender the permit to the Director and cease the arrangements for import or export of the items which relate to the permit. (7) Where the permit is revoked, the Director may order the quarantine and disposal of the items at the cost of the holder of a permit.

11. The Director may inspect an animal, animal product, animal by product or article in the country of origin prior to the importation into the Republic at the cost of the importer to determine whether the animal, animal product, animal by product or article meets the national appropriate level of protection based on the assessed level of risk and the risk management measures. (1) The Director may inspect an animal, animal product, animal by product or article prior to the exportation to determine whether the animal, animal product, animal by product or article is fit for export. Inspection before exportation (2) The exporter shall before an inspection referred to under subregulation (1) pay the fee set out in the Animal Health (Veterinary Services Fees) Regulations, 2018. SI No. 22 of 2018 (3) The Director shall, on determining that the animal, animal product, animal by-product or article is fit for export, issue an international sanitary certificate in Form IX set out in the First Schedule or in an agreed format with the importing country.

13.
