Animal Health (Bee Keeping) Regulations, 2020

1. These Regulations may be cited as the Animal Health (Bee Title Keeping) Regulations, 2020.

2. In these Regulations, unless the context otherwise requires— Interpretation “beehive” means a habitation or dwellingplace constructed for bees and does not include a natural habitation of bees; “bee keeping farm” means a farm which is involved in keeping bees or bee cultivation for the purposes of honey production; “bee enterprise” means an entity which engages in apiculture; “holder of a permit” means a person to whom a permit has been issued under these Regulations; and “permit” means a permit issued under these Regulations for the import or export of honey, bee or a hive product or to operate a bee keeping farm or enterprise, for the purpose of sale.

3. A person who intends to import or export honey, bee or a hive product for purpose of sale shall apply to the Director for a permit in Form I set out in the First Schedule on payment of the fee set out in the Animal Health (Veterinary Services Fees) Regulations, 2018. Application for permit to or import export SI No. 22 of 2018

4. A person who intends to operate a bee keeping farm or enterprise for the purpose of sale shall apply to the Director for a permit in Form II set out in the First Schedule. 5. A person who applies for a permit to import or export honey, bee or hive a product or operate a bee keeping farm or enterprise for the purpose of sale under regulations 3 and 4 shall— (a) undergo routine health surveillance; and (b) meet the standards for the local and export markets under the relevant written law. 6. The Director may, on receipt of an application under regulations 3 and 4, request an applicant, in writing, to submit additional information.

7. The Director shall, within thirty days of receipt of an application under regulations 3 and 4, where an application meets the requirements under these Regulations grant- Rejection of application for permit Amendment of permit (a) an import permit in Form III set out in the First Schedule; (b) an export permit in Form IV set out in the First Schedule or a format agreed between the exporting and importing country; and (c) a permit to operate a bee keeping farm or enterprise in Form V set out in the First Schedule.

8. The Director shall reject an application for a permit under these Regulations, where that application does not meet the requirements of the Act and shall inform the applicant in Form VI set out in the First Schedule.

9. (1) A holder of a permit who intends to amend a permit for the import or export of honey, bee or hive product for the purposes of resale shall apply to the Director in Form VII set out in the First schedule on the payment of the fee set out in the Second Schedule. (2) The Director may approve an application under subregulation (1) where (a) the name of the business changes; (b) the port of entry or exit in respect of which the permit was issued changes; and (c) there is a change of address of the permit holder. (3) A holder of a permit who intends to amend a permit to operate a bee keeping farm or enterprise for the purpose of sale shall apply to the Director in Form VIII set out in the First Schedule. 13th November, 2020 Statutory Instruments 569 (4) The Director may approve an application under subregulation (3) where— (a) the name of the business changes; or (b) there is a change of address. (5) Where an amendment of a permit has been approved, the holder of a permit shall surrender the old permit to the Director who shall issue the applicant with an amended permit for the remainder of the validity period of the original permit.

10. (1) A holder of a permit whose permit is lost, damaged or defaced may apply to the Director for a duplicate permit in Form IX set out in the First Schedule on payment of the fee set out in the Second Schedule. Application for duplicate permit Suspension of permit (2) The Director shall within thirty days of receipt of an application under subegulation (1), issue a duplicate permit to the applicant.

11. (1) The Director shall suspend a permit if (a) there is an outbreak of a notifiable disease or presence of a notifiable pest of bees at the bee keeping farm or bee enterprise; (b) a holder of a permit contravenes the provisions of the Act, these Regulations or any other relevant written law; or (c) a holder of a permit obtained the permit on the basis of fraud, negligence or misrepresentation. (2) The Director shall, before suspending a permit, give notice in Form X set out in the First Schedule to the holder of a permit of the Director’s intention to suspend the permit and request the holder of a permit to show cause, within a specified period, why the permit should not be suspended. (3) The Director shall not suspend a permit under this regulation if the holder of a permit takes remedial measures to the satisfaction of the Director within the period specified under subregulation (2). (4) The Director shall, in making a final determination on the suspension of a permit, consider the submissions made by a holder of a permit under subregulation (2). (5) The Director shall suspend a permit in Form XI set out in the First Schedule, if the holder of the permit fails to take remedial measures within the period specified in the notice issued under subregulation (2). 570 Statutory Instruments 13th November, 2020 (6) The Director may order for the— (a) destruction of a bee hive, bees, bee farm products and equipment in respect of the suspended permit at the cost of the holder of a permit; or (b) quarantine of the bee farm or bee enterprise products affected by the suspension at the cost of the holder of a permit during the period of the suspension of the permit. Revocation of permit

12. (1) The Director shall revoke a permit if (a) a holder of a permit contravenes this Act, these Regulations or any other relevant written law; (b) a holder of a permit fails to take remedial measures following the suspension of the permit within the specified period; (c) a holder of a permit obtained the permit by fraud or negligently submitted false information or statements; (d) it has come to the knowledge of the Director that the activities or products of the bee keeping farm or bee enterprise in respect of which the permit was issued are not suitable or have become known to cause danger to human health, animal health or the environment; or (e) in public interest, the sanitary and phytosanitary conditions on which the permit was issued in the importing or exporting country have changed and negatively affect animal health, human health or the environment; or (f) a permit holder voluntarily requests for the permit to be cancelled. (2) The Director shall, before revoking a permit in accordance with subregulation (1) (a),(b),(c),(d) and (e), give notice to the holder of the permit of the intention to revoke the permit and request the permit holder to show cause, within a specified period, why the permit should not be revoked. (3) The Director shall not suspend a permit under this regulation if the holder of a permit takes remedial measures to the satisfaction of the Director within the period specified under subregulation (2). 13th November, 2020 Statutory Instruments 571 (4) The Director shall, in making a final determination on the suspension of a permit, consider the submissions made by a permit holder under subregulation (2). (5) The Director shall revoke a permit, in Form XI set out in the First Schedule if the holder of a permit fails to take remedial measures during the period specified. (6) Where a permit has been revoked the— (a) holder of a permit shall immediately surrender the permit to the Director; and (b) Director shall order the quarantine and disposal of the honey, bee or hive products as directed by the Director at the cost of the holder of a permit.

13.
