1. These Regulations may be cited as the Urban and Regional! Planning (Administration of Appeals Tribunal) Regulations, 2025. litle

2. Inthese Regulations, unless the context otherwise requires Interpretation “associate” has the meaning assigned to the word in the Anti- Corruption Act, 2012; “Emoluments Commission” has the meaning assigned to the words in the Constitution: “legally disqualified” means the absence of legal capacity as provided in section 4 of the Mental [ealth Act. 2019; “member” means a member of the planning appeals tribunal; “nlanning appeals tribunal” has the meaning assigned to the words in the Act; and “relative” has the meaning assigned to the word in the word in the Anti-Corruption Act, 2012.

3. The planning appeals tribunal set out in the First Column in the Schedule are constituted as planning appeals tribunals for the provinces set out in the Second Column in the Schedule.

4. Amember, adviser, assessor and secretariat of the planning appeals tribunal shail be paid an allowance that the Emoluments Commission may, on recommendation of the Minister, determine. 5. (1) Amember ofa planning appeals tribunal shall hold office fora term of three years and may be reappointed for a further and final term of three years. (2) Amember shall, on the expiration of the period for which a member is appointed, continue to hold office until a successor is appointed, but in no case shall the further period exceed three months. (3) The office of a member becomes vacant if that member fa) dies; (b) is adjudged bankrupt: (c) is absent from three consecutive meetings of a planning appeals tribunal of which the member has had notice, without the prior approval of the planning appeals tribunal: (d) resigns, on giving one month’s notice to the Minister; fe) is legally disqualified from performing the functions of a member: or (fis convicted of an offence under any other written law and sentenced to imprisonment for a term exceeding six months without the option of a fine. (3) Whenever the office of a member becomes vacant before the expiry of a term of office, the Minister may appoint another person to be a member in place of the member who vacates the office for the unexpired term of that office.

6. The expenses and costs of the planning appeals tribunal shall be paid out of funds appropriated by Parliament for the performance of the planning appeals tribunal’s functions under the Act

7. (1) A person who is present at a meeting of the planning appeals tribunal at which any matter is the subject of consideration, and in which matter that person or that person’s relative or associate is directly or indirectly interested in a private capacity, shall, as soon as practicable afier the commencement of the meeting, declare the interest and shall not, unless the planning appeals tribunal otherwise directs, take part in any consideration or discussion of, or vote on, any question relating to that matter. (2) Adisclosure of interest made under this regulation shall be recorded in the minutes of the meeting at which the disclosure is made. 8. (1) A person shall not, without the consent in writing given by or on behalf of the planning appeals tribunal or as otherwise permitted by any written law, publish or disclose to a person, other than in the course of that person’s duties, the contents of a document, communication or information. which relates to. or Which has come to that person’s knowledge in the course of that person’s duties under the Act, 661 Prohibition of publication or disclosure of information to unauthorised person (2) A person who contravenes subregulation (1) commits an xeceding two for a term not offence and is liable, on conviction, to a fine not e hundred thousand penalty units or to imprisonment exceeding two years, or to both. (3) A person who, having information which to the knowledge of that person has been published or disclosed in contravention of subsection (1), unlawfully publishes or communicates that information to another person, commits an offence and is liable, on conviction, to a fine not exceeding two hundred thousand penalty units or to imprisonment for a term not excceding two years, or to both.

9. The Urban and Regional (Planning Appeals Tribunal) Regulations, 2018 are revoked.
